REGULAR MEETING COUNCIL CHAMBER AUGUST 31 1948.
CALL TO ORDER: Meeting called to',, order at 8:15 o'clock P.M., Honorable Mayor W. A.
Nelson presiding.
ROLL -CALL: -By Clerk, Councilmen present were John Beck, Art Glasow, Jr., A. T.
Hostetter, T. G. Overlie and C. R. Wallis. Charles Grigg, H. G. -Lake and
City Attorney D. W. Zent were absent.
READING OF THE MINUTES:
Minutes of the meetings held July 20 and July 27, 1948 were read and
approved.
CORRESPONDENCE:
BIDS ON FILTRATION PLANT UNIT NO. 2: Two Bids were received opened
and read as follows:
J.P. Head Plumbing & Heating Co. $124,368.75;
Everett McKellar General Contractor $53,878.00.
Extension on prices was made by Mr. F. S. Zeidlhack who recommended that
the lowest bid be accepted. Motion made by Overlie, seconded by Glasow to accept
bid of Everett McKellar in the amount of $53,878.00; motion carried by roll call
vote of five (5).
REGULAR ORDER OF BUSINESS SET ASIDE; by unanimous consent.
AVERY PROPERTY PUBLIC HEARING ON VACATING: Notice of hearing was read.
No protest was registered. Attorney Skidmore to present Ordinance declaring
vacation.
JOE HANIE'S CAMP: A sketch presented by Mr. Rademiller on tentative
plan of a trailer and cabin camp, block 129, Pasco Land Company's Addition; the
Council favored the approval of this plan when completed.
PETITION TO ANNEX (Earl Perry): A petition signed by 32 signers was
read, requesting to be annexed to the City. Mr. Perry was requested to bring in
a plat of area to be effected.
RESOLUTION NO. 295: Resolution No. 295 presented by R. R. Skill re-
questing by resolution to transfer $14,000.00 from the Pasco Air Port General
account to.the Pasco Airport Maintenance and.operation. Motion made by Beck,
seconded by `Wallis to adopt Resolution No. 295; motion carried by roll call
vote of five (5) .
GROCERY STORE COLUMBIA ADDITION (Cecil Tindel): Mr. Tindall made
inquiry relative to a store location in Columbia Addition; he advised to contact
the Planning Commission.
FIRE HAZARD (George Hill): Mr. Hill reports a fire hazard near his
home, grass lumber, etc. states Fire Chief reluctant to burn off the grass.
Beck to contact Fire Chief.
SEWER CONNECTION CHARGE (J. E. Welsh): Mr. Welsh states he paid sewer
connection charge 6w Prspbrtyrin White House Addition, Block 2 Lots 23 and 24.
Mr. Welsh stated to the Council that -he paid Sewer connection charge last Feb-
ruary, 1948, since that time he finds that his house is on one-half of a lot not
paid for by front footage payment and feels that additional charge should be
under old rate. Motion made by Beck that Welsh's bill be corrected to $75.00
instead of $60.00 making a balance due of $15.00 error in billing; and author-
izing the City Treasurer to make this correction; motion seconded by Overlie
and carried by roll call vote of "five (5) .
BEER LICENSE (Mr. Kellerman): Mr. Kellerman states his application for
a beer License had been turned down by the Mayor and Mayor Pro -Tem and is making
an appeal for re -consideration, at this time. He was informed that his place
of business was within 500 feet of a Church, therefore could not be granted.
Purchasing a location further froin the Church was mentioned. No action taken.
GREEN RIVER ORDINANCE: Rev. Smith desires to solicit for his Church
and is interested in new ordinance repealing the Green River Ordinance. At this
time Ordinance No. 634 was discussed and read.
ORDINANCE NO. 634:
A REVENUE AND REGULATING ORDINANCE GOVERNING PEDDLERS, SOLICITORS
AND ITINERANT MERCHANTS, ESTABLISHING FEES FOR SAME AND PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE. REPEALING ORDINANCE NO. 609
(THE GREEN RIVER ORDINANCE) AND ALL OTHER ORDINANCES OR PARTS OF
GRDINANCES IN CONFLICT THEREWITH.
Motion made by Wallis, seconded by Hostetter that Ordinance No. 634 be
given the second reading by title only; motion carried. Ordinance No. 634 was
read by title. Motion made by Glasow, seconded by Hostetter that Ordinance No.
634 has been given the second reading by title only; motion carried. Motion
made by Beck to amend Section Six (6) line 5, the words (Police Dept.) to read
Police Committee, motion seconded by Glasow and carried unanimous. Motion made
by Hostetter, seconded by Wallis that Ordinance No. 634 be given the third read-
ing; motion carried. Ordinance No. 634 was read. Motion made by Wallis, seconded
by Hostetter that Ordinance No.,634 has been given the third reading; motion
carried. Motion made by Wallis, seconded by Hostetter that Ordinance No. 634 be
adopted as amended; motion carried by roll call vote of four (4). Overlie voting
"No".

OILING TO CURBS --F. H. Alexander: Mr. Alexander is interested in
oiling to curbs and cleaning lots and spraying a thin oil penetration; would
like the City to accept 10% of charge for making collections and checking.
Motion made by Beck that Mr. Alexander be allowed to go ahead and work with no
service from the City. Motion died for want of a second.
REGISTRATION: Two representatives from the Union Hall made inquiry
relative to opening an office for registering at the hall. 'They were advised
that the City Clerk's office would be open from 7 to 9 P.M., -Monday through
Friday, August 9th to 13th inclusive.
SEWER AND WATER BILL COMPLAINTS: Mr. George Hill, P. E. Anderson,
Anna Arnold, Mr. Fay Mudd, Cecil Downey and others registered verbal complaints
against Ordinance No. 625 sewer and water charges. John Beck also expressed
his disapproval of this Ordinance and suggested other methods of financing.
Motion made by Hostetter, seconded by Glasow that this discussion be turned to
a Committee appointed by the Mayor, motion carried.

CORRESPONDENGE:
JOHN W. CUNNINGHAM AND ASSOCIATES James Construction Co's
Contract:
A letter was read from John
W. Cunningham & Associates regarding the
completion
of the Filtration Contract,
also the 13th and final estimate, recommending
the
payment at this time and recommend
that the Council accept the work as
completed.
The retained percentage of $29,000.00 w111hbe released by recommendation
of the
Engineer with the exception
of $lpOOO.00 which will be released after
test has
'
been made. The Council agreed
unanimously to accept the recommendation.
CAST IRON PIPE (WAPATO): A letter was read from the Mayor of Wapato,
asking to borrow 1000 feet of 8 cast iron pipe for approximately 60 days. Motion
made by Beck, that the City of Wapato be notified that we need the pipe and can
not spare pipe, motion seconded by Glasow; motion withdrawn. Motion made by
Glasow that we loan Wapato 1000 ft. of 8" pipe upon positive guarantee from the
Pacifzic'States Cast Iron Pipe Co. and the City Council of Wapato on the return
of same within 60 days; motion seconded by Wallis; motion carried unanimously.
AGREEMENT (Bean & Minnick): An agreement was read, between the City
and Bean & Minnick, Attorney-at-law of Walla Walla covering their employment,
to assist City Attorney D. W. Zent in defending controversy and litigation with
Wesley Bintz. Motion made by Beck, seconded by Hostetter to accept the agree-
ment; motion carried by roll call vote of five (5). A letter was read from
H. B. Jacobson stating Bintz patent on pool had expired. NOTICE of hearing on
arbitration between the CittT and Wesley Bintz set for August 16, 1948, was read.
REFUND BUILDING PERMIT(SPEE3: Mr. Speer requests refund on building
permits for three houses No. 270, 271 and 272 in the amount of $62.00. Motion
made by Ovehlie, seconded by Beck authorizing refund. Motion carried by roll
call vote of five ,( 5) .
PETITIONS TO ANNEX TO THE CITY: Harvey M. Huston petitions to annex
his property north of the City and West of the Spokane Highway to be taken into
the City.
WATER LINE: E. V. Hurley, R. E. Simons; and Waldo Pierson petitions
for a water line to serve lots 5,6,7,8,9,10,11,12,13,14,15 & 16 Block 22, Helm's
Second Addition to Pasco.

ORDINANCES:
ORDINANCE No. 635:
AN ORDINANCE DECLARING AN EMERGENCY AND APPROPRIATING MONEYS WITH !'
WHICH TO MEET THE SAME AND PAY FOR THE CITY OF PASCO'S SHARE OF THE
INSTALLATION OF JOINT CITY AND COUNTY 250 WATT RADIO STATION TO
REPLACE THE PRESENT 50 WATT STATION NOW OWNED BY THE CITY OF PASCO.
Motion made by Beck, seconded by Overlie that Ordinance No. 635 be
given the third reading; motion carried. Ordinance No. 635 was read. Motion made
by Overlie, seconded by.Glasow that Ordinance No. 635 has been given the third
reading, motion carried. Motion made by Glasow, seconded by Overlie that Ordinance
No. 635 be adopted; motion carried by roll call vote of five (51.
FEDERAL WORKS AGENCY PROJECT Wash -45-243-F Recreation Facilities: A
letter and Contract Lease No. BCF -8-379 was read, advising that the Administrator
has executed the lease containing an option to purchase on rental basis of
806.59 annually for 19 years.
COMMITTEE REPORTS:
STREET COMMITTEE REPORTS: 10th Street should be a stop street account
wrecks occuring frequently. They recommend that 10th be a through street from
Columbia to Sylvester. Motion made by Beck that Engineer and Street Superintendent
be instructed to place stop signs at intersections between_ Columbia & Sylvester it
making 10th a through street; also slow signs approaching playfield at West side
School; motion seconded by Hostetter and carried.
LIGHTS VOLUNTEER PARK: Goulet to replace lights in Park. It was
recommended that a fence be placed around the wading pool at Sylvester Park to
keep out the dogs. Motion made by Glasow authorizing,a fence at the Wading Pool
in sylvester Park to cost not more than $150.00. Motion seconded by Beck; carried
by roll call vote of five (5).
