CALL TO ORDER: Meeting called to order at 8:10 P.M., Honorable Il,4ayor. W. A. Nelson
presiding.
ROLL CALL: By Clerk; Councilmen present were John Beck, Art Glasow, Jr., Charles Grigg,
A. T. Hostetter, H. G. Lake, T. G. Overlie and C. R. Wallis. Also-7City Attorney
D. W. Gent.
Proceeding with regular order of business was suggested by the Mayor.
REGULAR ORDER. OF BUSINESS SET ASIDE: Motion made by Beck, seconded by
Lake that we hear from the visitors; motion carried. ,
Ordinance No. 625: Board to .hear complaints. Motion made by Beck,
seconded by Overlie to hear from all visitors present; motion carried by roll
call vote of seven (7).
TAXI: G. I. CAB: The G. I. Cab operaters complained that the present
Taxi Ordinance was not being enforced. Also that stops at the Bus Depot should
be open to all cars. This was turned to the Police and License Committee. Glasow
to act as Chairman.
BOAT FOR RECREATION AT THE BEACH: Roy Rogers desires to lease River
Block below River Street, for location of a boat to be operated as a marine
restaurant and dining room and for allied purposes. Motion made by Grigg that if
the Port is willing to lease, the City will lease this property also at a fee of
4p25.0.0 per month on a revocable lease; motion seconded by Hostetter and carried
unanimous.
VACATING MURRAY STREET: This is riot favored by the City Engineer.
REZONING EAST -HALF OF BLOCK 3, TERRACE HEIGHTS ADDITION (Petition): A
letter was read .from the Planning Commission stating the Commission will gladly
concur in rezoning Blocks, 9, 10, 3 and 4 of Terrace Heights Addition from R-2
to Commercial. Newman spoke regarding Ordinance No. 435, and property surround-
ing the above mentioned property. A small group from the East side were present
to protest against the changing of zoning. Motion made by Lake, seconded by
Glasow that the petition be denied; motion carried.
A private club would be permissable in R-2 acco-rding to Ordinance.
WATER RATE CHANGES & COMPLAINTS: 'lir. IIue and others present discussed
water bills and payment of same.
Andy Monico, objects to paying $1.00 sewer charge shown as a part of
his last water bill. Mr. Frenger, Jr. objects to paying sewer charge account
not having sewer service.
VETERAN'S CLUB (Isaac Bell) OREGON & 'tA": Isaac Bell presented state
documents authorizing himself and others to operate a Veteran's non -profiting
club and Recreation Center at Oregon and "A" St and requests permission from
the Council to so do. Motion made by Beck, seconded by Lake that the operation
of this Recreation Center be allowed; motion carried unanimous.
THEODORE BENSON: Stated the Recreation Building roof had not been re-
paired. Also wished to know if Iie was going to have charge of Pylemorial Park. No
action was taken.
REGULAR ORDER OF BUSINESS RESUMED: By unanimous consent.
BILLS: Current Bills against the City were read as follows. Motion made by
Beck, seconded by Overlie that all vouchers properly signed and approved be
honored including the delivery of Warrant withheld for McAtee & Heathe and Harold
Blanton; motion carried by roll call vote of seven (7).

made by Grigg, that as long as the City Attorney can settle for no cost to the
City, that we disallow the voucher to Mr. Bintz, under City Attorney's instructions
as per his letter to each Councilman which is a part of this motion. (Letter) --

to Honorable Mayor and City Council:
Gentlemen:
I am informed through the columns of the Tri -City Herald that the
Mayor went to Seattle and. arbitrated the matter of the claim of Mr.
Bintz against the City of Pasco, and agreed to pay the sum of $2,350.00
in settlement of the claim.
This is to notify you that the claim is not a valid. claim against
the City of Pasco, that the 1,1ayor acted without authority of law, that
the City is not bound by the actions of the Mayor in the matter and an
action might lie against you as individuals if the claim is allowed and
paid.
The Claim is an illegal claim against the City.

REGULAR MEETING (Continued) COUNCIL CHAMBER JULY 6, 1948.
POLLUTION CONTROL COfvMISSION: A letter was read from Jack. Taylor to
Mayor Nelson acknowledging receipt of Ordinance No. 625 pertaining to Sewage
Treatment. This Ordinance gives definited assurance that the Plant will be built
in the near future, therefore extensions to the present sewer system can now be
approved; upon receipt of sufficient plant and specificAtions on anticipated
extensions.
BLOCK 2, KIRTH'S ADDITION: A letter was read from the Planning Commission
recommending that parties interested in erecting a building on the west portion of
the south half of Block 2, Kirth's Addition be permitted to build with 20 foot set
back, and to property line on sides and rear alley.
RICHARD SCHULTZ (Patrolman suspended): The dedision on hearing held
May 10, 1948 by Judge Timothy A. Paul was read stating that the order of the Civil
Service Commission was reversed. City Attorney D. W. Zent explained that the Judge
informed Mr. Schultz and the Court that the evidence was sufficient to warrant
the suspension but owing to a small technicality in the procedure of serving the
notice to Schultz, he was reversing the order..
CALL FOR BIDS (Plant Mix): One Bid was received, opened and read, as
follows: L. W. Vail Co. to furnish labor., equipment and MC -2 -Asphalt necessary
to take from Stock Pile, 400 Cubic Yards of aggregate and run thhough Pug Mill
Asphalt Mixer and repile @ $2.70 per ton. Motion made by Lake, seconded by Overlie to
reject bid on plant mix, andtturnctorCLity Eng,iheer to make purchase; motion carried.
READING OF ORDINANCES:
ORDINANCE NO. 627:
AN ORDINANCE RELATING TO THE VACATION OF THE NORTH AND SOUTH ALLEY IN
BLOCK.ONE, O'KEEFE'S SECOND ADDITION TO PASCO
VIHEREAS, A PETITION HAS BEEN FILED IN THE CF FILE OF THE CITY CLERK OF
PASCO, WASHINGTON, SIGNED BY ALL THE OWNERS OF PROPERTY ADJACENT TO
'THE ALLEY IN BLOCK ONE OF O'KEEFE'S SECOND ADDITION TO PASCO, V-JHICH
SAID ALLEY' RUNS NORTH AND SOUTH, AND WHICH SAID PETITION ASKS FOR THE
VACATION OF SAID ALLEY WHICH RUNS NORTH AND SOUTH:
AND WHEREAS, SUBSEQUENT TO THE FILING OF SAID PETITION, NOTICES OF THE
HEARING THEREON WERE POSTED IPI THREE OF THE MOST PUBLIC PLACES IN PASCO,
AND DUE PROOF OF THE POSTING HAS BERT FILED:

ROGERS VS. CITY OF PASCO: AN DECLARING AN EMERGENCY AND APPROPRIATING
THE SUM OF $1,906.85 FOR THE PURPOSE OF DEFRAYING THE EXPENSE OF AN
AERIAL SU13VP,Y' AND WASHINGTON STATE COLLEGE SURVEY OF THE CITY O -F PASCO:
AND DECLARING AN EI.4ERGENCY AND APPROPRIATING THE SUM OF $1,514.10 FOR

AN ORDINANCE PROVIDITTG FOR THE ANNEXATION OF COLUMBIA ADDITION TO
PASCO, EXCEPTING LOTS 11 TO 16 INCLUSIVE, IN BLOCK 9 THEREOF, TO THE
CITY OF PASCO.
Motion made by Grigg, seconded by Wallis that Ordinance No. 633 be
given the first reading; motion carried. Ordinance No. 633 was read. Motion made
by Glasow, seconded by Lake that Ordinance No. 633 has been given the first read-
ing; motion carried. Motion made by Grigg, seconded by Lake that Ordinance No.
633 be given the second reading by title; motion carried. Ordinance No. 633 was
read by title. Motion made by Grigg, seconded by Lake that Ordinance No. 633 has

ORDINANCE NO. 634:
A REVENUE AND REGULATING ORDINANCE GOVERNING PEDDLERS, SOLICITORS AND
ITINERANT MERCHANTS, ESTABLISHING FEES FOR SAHE AND PENALTIES FOR THE
VIOLATION OF THIS ORDINANCE. REPEALING ORDINANCE NO. 609 (THE GREEN
RIVER ORDINANCE) AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT THEREWITH.
Motion made by Beck, seconded by Overlie that Ordinance No. 634 be
given the first reading; motion carried. Ordinance No. 634 was read. Motion made
by Overlied, seconded by Lake that Ord.inance No. 634 has been liven the first
reading; motion carried. More consideration to be given this ordinance.
PETITION TO VACATE LOT 9 BLOCK. 12 AVERY'S ADDITION: Petition was read
praying that the following described property be vacated:

" Beginning at a point where the east boundary line of Avery's
Addition crosses the north right of way line of Lewis Street; thence
west along the north right of way line of Lewis street to the south-
east corner of lot nine (9); thence north forty five ('45) feet
along the east line of lot nine (9) to the northermost corner of
lot nine (9) lying on the southerly right of way of the county high-
way; thence northeasterly along; the southerly right of way line of
the county highway to a point on the east boundary line of Avery's
Addition; thence south along the east boundary line of Avery's
Addition to the place of beginning."
Motion made by Lake, seconded by Overlie that his property be vacated
and a public Hearing be held Tuesday, 8:00 o'clocl.P. M., August 3, 1948; motion
carried.
RESOLUTION NO. 294: Call FOR PUBLIC HEARING, ON VACATING LOT 9, BLOCK
12, AVERY'S ADDITION: Motion made by Lake, seconded by Overlie that Resolution
No. 294 be adopted.
MISCELLANEOUS:
SA LA'RY RAISE DISCUSSION: I47otion made by Lake, seconded by Grigg that this
be turned to the Finance Committee for .recommendation at the next regular meet-
ing; motion carried.
Finance Committee to meet with next two days.
