Hostetter presiding. ROLL CALL: By Clerk, Councilmen present, John Beck, Charles Grigg, A. T. Hostetter, H. G. Lake, T. G. Overlie and C. R. Wallis. Art Glasow, Jr. was absent. D. TV. Zent was present. REGULAR ORDER OF BUSINESS SET ASIDE by unanimous consent. •PUBLIC HEARING: EAST SIDE; DISTRICT BETWEEN MARVIN AND NO STREET TO BE REZONED: Public hearing notice was read which included Blocks 3, 4, 9, and 10 Terrace Heights Addition, Blocks 127, 128, 129, 130, 153 and 154 Pasco Land Company's First Addition. Objections were voiced on having blocks 3, 4, 9 and 10 changed from Residential Zone R-2, to Manufacturing Zone M-1. Motion made by Beck seconded by Grigg to amend Ordinance 621 deleting Blocks 3, 41 9, and 10 that these Blocks remain in Residential Zone R-2, motion carried. ORDINANCE NO. 621: AN ORDINANCE MAKING, CREATING AND ESTABLISHING CERTAIN PROPERTY WITHIN THE CITY OF PASCO, WASHINGTON AS A MANUFACTURING ZONE M-1, AND TO CONFORM TO FIRE ZONE 2, WITH DWELLING HOUSES THEREIN TO CONFORM TO RESIDENTIAL ZONE R-2. Motion made by Lake seconded by Beck that Ordinance No. 621 be given the third reading as amended, motion carried. Ordinance No. 621 was read as amended. Motion made by Grigg seconded by Overlie that Ordinance No. 621 has been given the third reading as amended, motion carried. Motion made by Overlie seconded by Lake that Ordinance No. 621 be adopted as amended; motion carried by roll call vote of six (6) . PUBLIC HEARING EXTENDING COMMERCIAL C-1 NORTH ON 4TH STREET: Notice of Hearing was read on changing that property situated 150 feet on either side of Fourth Avenue from the center line of Shoshone to the alley between Yakima and Park on the West and Nixon on the East from Residential R-1 to Commercial C-1. Two factions were present,,some for and some against the change. A letter from H. V. Custer and petition presented in opposition to the change, signed by thirty- six (36) property owners was presented following a discussion. Motion was made by Lake seconded by Grigg that the Council accept this property in a restricted Commercial zone to be drawn up by Ordinance; motion carried by roll call vote of five (5), Overlie being out of the room. PUBLIC HEARING AVERY'S ADDTION: Notice of Hearing read setting out that portion facing Lewis and one block deep on Kahlotus Highway, be zoned Commercial C-3 ORDINANCE NO. 623: AN ORDINANCE CREATING A COMMERCIAL C-3 ZONE WITHIN THE CITY OF PASCO AND DESCRIBING THE PROPERTY CONTAINED THEREIN AND DEFINING THE CLASS OF BUILDINGS TO BE ERECTED THEREIN, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. Motion made by Grigg seconded by Lake that Ordinance No. 623 be read to cover Public Hearing, motion carried. Ordinance No. 623 was read. Motion made by Grigg seconded by Overlie that Ordinance No. 623 has been given the first reading, motion carried. Motion made by Grigg seconded by Overlie that Ordinanbe No. 623 be given the second reading by title only, motion carried. Ordinance No. 623 was read by title. Motion made by Lake seconded by Overlie that Ordinance No. 623 has been given the second reading by title, motion carried. Motion made by Grigg seconded by Lake that Ordinance No. 623 be amended by description to include Blocks 1, 61 7 and 12, motion carried. PUBLIC HEARING COURT STREET FROM 4TH TO AURILIA: Notice of Hearing was read relative to rezoning that portion of Residential Distract facing Court,Street South to the alley between 4th and Aurilia, from Residential 'R-1 to Commercial C21. Petition signed by ten (10) property owners was presented. Motion made by Grigg to have Ordinance drawn to cover district as per Public Hearing, motion seconded by Overlie; motion carried. SWIMMING POOL: BIDS ON WADING POOL: One Bid was received opened and read from the James Construction Co. Wading Pool, 30 x 60 - - - - - - - - - - - - -$6,135.85 Incl. Tax. Alternate No. 1, if spray pedestal is omitted- 550.00 deducted Shelves, pipe racks for hanger baskets 2,247.30. Alternate No. 2, using wood verticals, etc.- - 383.00 deducted Bath house plumbing system - - - - - - - - - - 4,167.38 Incl. Tax. Electrical System- - - - - - - - - - - - - - - 12566.63 , FILTRATION UNIT NO. 3: A letter was read from John W. Cunningham and Associates recommending that the Neon E-iectric Co.'s bid be rejected and the work readvertised. Wtthtthe consent of the Council would separate the unit into two sections. One covering panel boards, the other or second section to cover installation boards as well as wiring electrical fixtures for the plant. They feel that no delay will be caused by this procedure.' Motion made by Lake to reject bid of Neon Electric Service Co. and follow Engineer's advice, deposit bonds to be returned; motion seconded by Wallis and carried unanimous. 35 1436 PASCO, WASHINGTON RECESSED MEETING(Continuedd) COUNCIL CHAMBER MARCH 23, 1948. FEDERAL HOUSING REFUND: HOUSING AUTHORITYs By error the Housing Authority overpaid the City of Pasco 41,551.30 and are requesting a refund. This amount should have been paid to Road District No. 1. Motion made by Lake seconded by Grigg authorizing the City Treasurer to refund to the Housing Authority $10551.30; motion carried by roll call vote of six (6). DEED MEMORIAL PARK: A deed from the Franklin County Post No. 34, American Legion and resolution passed by the Post, to the City of Pasco, Washington conveying Lots 9 to 24, inclusive and 31 and 32, Block 14 Helm's Second Addition to Pasco was presented and approved by the City Attorney. City Clerk to issued: Warrant in the amount of $3,590.00. BUSINESS LICENSE USED CAR SALES LOT (Basil Warren): An application to,joperate a used car sales lot at 9th and Lewis was presented by Mr. Warren. Motion made by Beck and seconded by Lake that the License be issued, motion carried. BID EMPIRE ELECTRIC CO.: Th6iEmpire Electric Co.'s Bid was received late, they were of the opinion that bi(b were called at 7:30 P.M. They bid only on the Elect"ric System in the amount of $1,067.68 including tax. Motion made by Grigg that the Empire Electric Co.'s bid be turned to Malony for consideration, motion seconded by Overlie and carried. Motion made by Overlie that Bids be turned to Mr. Malony for Recommendation,motion seconded. by Beck and carried. BINTZ CONTRACT: A letter from Mr. Bintz to Mayor W. A. Nelson was read stating Frank Funkhouser would represent him in connection with the arbitra- tion of his claim against the City of Pasco. Motion made by Grigg seconded by Lake that the demand for arbritration be turned to the City Attorney, motion carried. READING OF ORDINANCES: �ORDINANCE N0. 622: RE ZONE 3, WITHIN THE CITY OF PASCO, AND AN ORDINANCE CREATING A FI DESCRIBING THE PROPERTY CONTAINED THEREIN AND DEFINING THE CLASS OF BUILDING TO BE ERECTED THEREIN, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. Motion made by Overlie seconded by Hostetter that Ordinance No. 622 be given the third reading, motion carried. Ordinance No. 622 was read. Motion made by Grigg seconded by Lake that Ordinance No. 622 has been given the third reading, motion carried. Question discussed and held up for more consideration.
