CALL TO ORDER:
Meeting called to order at eight o1clock P.M., Honorable Mayor Fred Huber presiding.
ROLL CALL,
By clerk, councilmen present were John Beck, Karl W. Casey, Charles Diemond,
R.J. Larson, ,Walter A. Nelson, D.F. Rodkey and C.R. Wallis. City.Attorney D.W. Zent
was also present.
REGULAR ORDER OF'BUSINESS SET ASIDE by unanimous consent.
BENTON-FRXNKLIN COUNTY HEALTH DISTRICT:
A letter to the Mayor from A.E. Taylor, County Auditor of Benton County was read
relative to creating a Benton -Franklin County Health District in accordance with
the provisions of the 1945 Supplement, being Chapter 183, Pierces Code. Letter
read by Mr. Dent; a Resolution and copy of the law was turned to the City Attorney
to be checked. Three (3) cities and two (2) counties create the district,. Pros`ser',
nnewick, Pasco; Franklin & Benton counties.

A copy of an opinion from Smith Troy forwarded to Wm. J. Gaffney was read stating
that in his opinion it was legal to elect a Mayor in the 1946 election to full fill
the vacancy caused by Mayor Linderman resigning; with reference to the 1915 laws
which supersede the 1907 laws, dealing with vacancies in elected offices and
further that the elected officer is to take office as soon as a certificate of
election has been issued. Mr. Nelson suggested that Huber continue with the
meetings.
BIDS ON SEWER EXTENSION HELM'S SECOND ADDITION:
Sealed bids call for this date on Approximately 1200 feet of 811 concrete sewer
pipe; 3 standard manholes, rings and covers, 3 lampholes, were read at this time;
Twin City Construction Co. bid 12,130.00, Brown Sand & Gravel Co. bid $20099.00,
$7.00 per foot for all manholes over seven (7) feet deep. E.M. Brown's bid was
accompanied by a certified check deposit in the amount of $104.95. The committee
and water manager adjourned to the water office to study the bids, nor. Browns
bid was on 1200 feet, the blocks are 440 feet or 1320 feet, Mr. Brown intended
that his bid cover each block, so filled in with the.words"full three block" and
signed following the insertion. The committee recommend that Brown s bid be
accepted, motion made by Beck seconded by Diemond that the Brown Sand & Gravel Co.
be awarded the bid, motion carried by roll call vote of seven (7).
HAMMANS SEt,7VER CONNECTION BLOCK 134 LAND COMPANYS FIRST ADDITION:
Mr. Head, a plumber, is making inquiry for Mr. Haman, regarding the �,p400.00
advance payment on sewer installation to serve his property from the alley, he
wished to know what other charges would have to be taken care of other thatL
the $400.00 such as connecting or inspecting fees, motion made by Beck that Mr.
Head representing Mr. Haman be notified that the X400.00 fee plus inspection
charges constitute his obligations to the city, motion seconded by Diemond, carried
by roll call vote of four (4), other members of councilvv°7' uring on bids in water
office.

PEARSONS PROPERTY BLOCK 158 PASCO LAND COMPANYS FIRST A DDITION:
A letterwas read from James Leavy, attached was a quit claim deed and a Partial
satisfaction of mortgage, description of property involved to be checked by Beck
at the Citizens Abstract office.
READING OF RESOLUTIONS AND .ORDINANCES:
RESOLUTION NO. 271:
Authorizing City Treasurer to sell $20,000.00 worth of U.S. War Bonds, Series G
now held by the 'Nater Department and to transfer from such sale together with an
additional $5,000.00 from the operating fund of the water department to be used to
retire Sewer Extension Bonds, No's. 101 to 125 inclusive; Series A in accordance
with Ordinance No. 531. Resolution No. 271 was read in full--, motion made by Nelson
seconded by Rodkey that Resolution No. 271 be adopted, motion carried by roll call
vote of seven (7).
RESOLUTION NO. 272: To correct error in printing 1947 Budget, whereas Extension
and Disposal Plant Bond to read Series "C" Bond instead of Series "G", the
Resolution No. 272 was read in full, motion made by Diemond seconded by Rodkey to
adopt Resolution No. 272, motion carried by roll call vote of seven (7).
ORDINANCE NO. 581: GARBAGE ORDINANCE AND CONTRACT:
AN ORDINANCE RELATING TO THE PUBLIC HEALTH A ND SANITATION: PROVIDING FOR AND REG-
ULATING THE COLLECTION, REMOVAL AND DISPOSAL OF GARBAGE: AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK OF THE CITY OF PASCO, WASHINGTON, TO ENTER INTO A CONTRACT
THEREFOR UPON THE TERMS AND CONDITIONS AS SET FORTH INT HE CONTRACT ANNEXED HERETO
NHICH CONTRACT SHALL EXTEND FOR A PERIOD•ENDING DECEMBER 31, 1951; defining
offenses, and providing penalties for the violation thereof.
ORDINANCE NO. 581: GARBAGE ORDINANCE & CONTRACT: AS AMENDED was given the third
reading, motion to so do was made by Beck seconded by Diemond, carried so ordered,
further amendments were suggested namely following title "Be it Ordained by" should
be stricken; The City Council of the City of Pasco do ordain as follows, is the
correct form.
Section 4, line nine (9) surety bond should be $2,000.00 instead of $1,000.00. In
the contract paragraph 8, no charges are to be made f to, the city for garbage
collections.
Paragraph 10, line two (2) following the word shall exceed to be used in place of
be, A, B, C, and D of paragraph 10, there should be no increase in present prices;
F of the same paragraph, the three words (for the city) is to be added or follow
the word -herein. Paragraph 12, added to the last line following the word request,
add, (with approval of the Street Committee); paragraph 19, $ 1,000.00 to read
$2,000.00, paragraph 20, line 11, following the word ended, add, and the contractor
held liable on his performance bond. Also that no garbage be hauled to the Pasco
dump other than Pasco Garbage without the consent of the council, also that
contractor operate under present fate for three years with option -to revise
after the expiration of that time; following this discussion m6tion was made by
Rodkey that the Health Committee meet with Dietrich and the City Attorney to make
amendements as suggested, motion seconded by Nelson, carried so ordered.
ORDINANCE NO. 582:, SALE OF GENERAL OBLIGATION BONDS.
AN ORDINANCE PROVIDING FOR THE ADVERTISEMENT, SALE AND ISSUANC1. OF $132,000.00 OF
GENERAL OBLIGATION NEGOTIABLE SERIAL COUPON BONDS, FOR THE CAPITAL PURPOSE OF
CONSTRUCTING A WATER FILTRATION PLANT, IN ACCORDANCE '01= 1 THE PROPOSITION SUBMITTED
BY ORDINANCE NO. 579 OF THE CITY OF PASCO, PASSED AND APPROVED SEPTEMBER 17, 1946,
AND A.BOBTED BY THE QUALIFIED ELECTORS OF THE CITY OF PASCO AT AN ELECTION HELD
THEREIN ON NOVEPIBER.5, 1946.
+ WHEREAS, this city council of the ''ity of Pasco, Washington, heretofore
enacted Ordinance No.'579 on 6eptember 17, 1946, and said Ordinance, upon passage
and approval was published on September 19, 1946, in the "Pasco Herald", a newspaper
published in said city, and became in full force and effect at the expiration of
five days from and after the date of said publication; and
WHEREAS, in accordance with said Ordinance No. 579, and in accordance with the
applicable provisions of law, the following Proposition:
PROPOSITION
SHALL THE CITY OF PASCO CONSTRUCT A WATER FILTRATION PLANT AT AN
ESTIMATED COST OF 83003,000.00, AND FOR THAT CAPITAL PURPOSE ONLY
BECOME INDEBTED AND ISSUE GNNE RCiL OBLIGATION NEGOTIABLE SERIAL COUPON
BONDS IN THE AMOUNT OF $1321000.002 TO BEAR INTEREST NOT EXCEEDING THREE
PER CENTUP.1 (3%) PER ANNUM AND TO BE PAID IN FULL IN TNENTY ( 20 ) YEARS,
WITH PRINCIPAL MATURITIES PAYABLE COMMENCING AT THE 'END OF THE SECOND
YEAR AFTER DATE OF SAID BONDS AND THEREAFTER ANNUALLY AT THE END OF
EACH FURTHER YEAR, TO THE END OF THE TWENTIETH YEAR, AND MEET AND PAY THE
PRINTCIPAL AND INTEREST THEREOF BY APPROXIMATELY EQUAL ANNUAL TAX LEVIES
IN EXCESS OF ANY STATUTORY AND CONSTITUTIONAL -LIMITATIONS, ALL AS
PROVIDED BY ORDINANCE NO. 579?
was submitted to the qualified voters of the ity of Pasco for their approval
and ratification or rejection at a special election held within said city on
Tuesday, November 5, 1946, in conjunction with the general election held on
said date; and
WHEREAS, at said special election qualified voters of the 6ity of Pasco,
in the number and in the majority required by the constitution and laws of the

State of Washington, approved and ratified said Proposition for the issuance of
said bonds;

Motion made by Beck seconded by Casey that Ordinance No. 582 be given the second
reading by title only, motion carried, title was read, motion made by beck
seconded by Rodkey that Ordinance No. 582 has been given the second reading by

NOTICE OF CALL FOR BOND BIDS: was read, motion made by nelson that the notice be
approved and the clerk instructed to publish, motion seconded by Rodkey carried
by roll call vote of seden (7).

COUNTY, 'WASHINGTON.

ORDINANCE NO. 584: BUS FRANCHISE:
Motion made by Nelson seconded by Diemond that Ordinance No. 584 be given the
first reading, motion carried, Ordinance was read, motion made by nelson seconded
by Beck that Ordinance No. 584 has been given the first reading, motion carried;
Ordinance discussed, corrections requested as follows; in second line of title
following the name Miller, the remainder of that line and to the word, assigns,
in the second line be stricken; Section 2 -line two, parties should be party;
Section five, stricken completely; Sec 6, line 5 should read, ,"A" St. instead of
"R" Street,, Section seven, second line following city council, except as here-
inafter provided, be stricken, motion made by beck seconded by Diemond that
Ordinance No. 584 be given the second reading by title only, motion carried, title
of Ordinance No. 584 was read, motion made by Nelson seconded by Rodkey that Order;'

Huber to notify Mr. Millers attorney of amendments recommended.
REGULAR ORDER OF BUSINESS SET ASIDE by unanimous consent.
J.C. Wade presents petition for fire hydrant within the area of 10th & Bonneville
for the purpose of rdducing insurance rates. The petition was signed by nine (9)
residence; setting back curbs and sidewalks in this area was also discussed, Street
Committee to investigate.

ORDINANCE NO. 586:
AN ORDINANCE PROVIDING FOR THE LICENSING OF CERTAIN MECHANICAL DEVICES, PROVIDING
REGULATIONS FOR OPERATIONS OF THE SAME AND PROVIDING PENALTY FOR THE VIOLATION
THEREOF: REPEALING ORDINANCE NO. 568.
Motion made by Beck seconded by Diemond that Ordinance No. 586 be given the first
reading, motion carried; Ordinance No. 586 was read, motion made by Wallis seconded
by Rodkey that Ordinance No. 586 has keen given the first reading, motion carried,

NAVY SE,TER:
A letter was read from the Naval -'ir bases Commander of the Thirteenth Laval
District, stating that the request by the city to make connection to the Navy
sewer in 6ylvesters Second Addition with out restrictions had been forwarded to
the Navy �ureau of Yards & Docks with the recommendation that the request be granted.

REPORTS FROM OFFICERS:
The City Clerk furnished a monthly budget report to each member of all departments.
{ MISCELLANEOUS:
T.R. BENSON EMPLOYED RECREATION DIRECTOR:
The Recreation Committee recommend that Mr. T.R. Penson be employed as Recreation
Director on an approval basis of ninety (90) days. He was recommended by Mr.
Willard H. Shumard of Spokane; at the expiration of the ninety (90) days the
E Committee will again make recommendation.
{ JUTE BOXES:
At the present time there are two jute boxes at the Recreation center, the large
box is not -the type to be operated succesfully by the teen-age group; Mr.
r Augustavo at one time offered $10.00 for this box, the offer was not accepted
so at this time he is offering yp35.00 and the committee recommend that this offer
be accepted, motion made by Rodkey seconded by Larson to accept the Committees
Recommendation to hire 1°lr. Benson and that they be authorized to sell jute box,
motion carried by roll call vote of seven (7).
ADJOURNMENT:
Motion made by Nelson seconded by Wallis that the meeting recess to Friday,
December 27, 1946, 6:00 o'clock P.M. to pay final bills for t year 1946.
