Linderman pre- siding. ROLL CALL: By clerk, councilmen present, John Beck, Karl Casey, Chas. Diemond, R.J. Larson, Walter Nelson, D.P. Rodkey and C.R. Wallis, also City Attorney D.W. Zent. REGULAR ORDER -OF BUSINESS SET ASIDE: by unanimous consent to hear from visitors. BUS FRANCHISE: i Fred E. Miller of 417 guest Shoshone requested a fran--hise to operate a bus line within the City of Pasco, this was turned to the Street and Police Committees to Iconsider and make report. CHANGING PLANNING ZONES: 1 A.H. Avery and son Delbert with other residence of the East side, Owens Addition and different parts of the city were present to be heard on planning zone changes, they were informed that the proposed Ordinance sitting out,changes had -not been reviewed by the council after study has been made and meeting arranged with the j Planning. Commission, the Ordinance will be published for public hearing. Mr. Hamman wants the East Side Commercial and manufacturing zones to remain as they i now are. I GRAVEL PIT ON AINSIVORTH: Mr. Jones stated he thought that negotiations between property owners and Central + Sand and Gravel Co. were about to get underway. REGULAR ORDER OF BUSINESS RESUMED by unanimous consent. { COMMUNICATIONS: U.S.O. BUILDING (PURCHASE): A letter was read from L.R. Durkee relative to selling the U.S.O. Building, he would + like an expression as to what was derived from Mr. C.L. Tomlinsonts visit to Pasco. If less that 50 % of the capital cost was offered a complete justification of the Citys inability to pay should be submitted. The Citys request that a lease be executed at this time with option to buy at a figure to be determined at some future date, was not deemed advisable for either party. Recreation Committee to suggest or make recommendations regarding the negotiation for this deal. FORREST CAMPBELL ( PATROLMIAN) : A letter was read from Chief of Police McKibbin stating Forrest Campbell requests to return to work February 15, 1946, motion made by Beck seconded by Larson that Campbells request be accepted, motion carr=ied so ordered. TRANSFER FOR y�594.36: gg9 By Qversite the ae%,rer Maintenance Department was not set up in January 1946 and W�rrants were issued by the clerk from the Sewer Extension Fund; to correct this error, I request permission to transfer $594.36 from the Sewer Maintenance Fund � to the Sewer Extension Fund. Motion made by Beck seconded by Diemond to authorize this transfer, motion carded so ordered. SEWER MAINTENANCE FUND VARRANTS : City Clerk, explains, she has a book of warrants made for the Parking Meter Fund, with only 49 Warrants used and would like to restamp the Warrants and stubs so they could be used by the Sewer Department, it would take a long time to have new ones printed for this department as we are just now getting the budgets ordered in 1945. Warrants to start with No. 50 for the Sewer Fund instead of No. 1, motion made by Beck that the City Clerk be authorized to use vouchers and warrants set up for Parking Meters, for the Sewer Department by cancelling name of fund on check and restamping and be permitted to start with Warranty No. 50, motion seconded by Larson, carried so ordered. SEWER CONNECTION CHARGES BECOME DUE: A letter was read from the City Treasurer regarding sewer connection charges be- cominj due, would like an established date for both East and vilest side Sewers from which/to work, motion made by Beck to turn this to the Sewer Committee, motion died for want of a second, in conclusion this was turned to the Sewer Committee to bring in report. ADDITIONAL FIREMAN NEEDED: A letter from L.A. Matthias, Fire Chief was read, he requests that a position of Assistant Chief be created and one more man be added to the paid force, Mayor asked all council men to study this over until next meeting, Fire Committee to make recommendation. 1170 PASCO, WASHINGTON COMMITTEE ROOM 1 CARD TABLE LICENSE: An application presented by W.P. Godfrey to operate a card table was read, motion made by Beck.seconded by Larson to, issue license, motion carried. Also that a business license in addition to card table license be collected. City Attorney ; advises that the card table Ordinance sets out the price of card table license ; fee as $100.00 regardless of other business activities, CHANGING PLANNING ZONES: 1 A letter was read from Virginia E. Eelley, Sunnyside, `"Nashington owner of some lots on the East Side, she requests that the zones not be changed. PLANNING CHANGES (TENTATIVE ORDINANCE 571): A letter from Mr. Booth transmitting the commissions,recommendations for a revision of the zoning Ordinance No. 435. Copies prepared by the committee were furnished and each member of the council, Maoyor, City Attorney and City Clerk obtained a , copy of the proposed Ordinance also the existing Ordinance No, 435. NAVY SEWER REVOCABLE PERMIT TO CITY: The revocable permit from United States of America to the City of Pasco, Washington, file No. 1740 -2 -PA with sketch attached was read and discussed, motion made by Rodkey seconded by Diemond that Mayor Linderman be authorized to sign permit on approval by the City Attorney, motion carried, the permit allows the installation and connection of sixteen (16) private sewer lines, there are no Y's in this line j and locations of Y's will have to be established, motion made by Beckthat the City Clerk notify people to be served on Henry facing the South to come in and read the Revocable Permit. Location of the Y to be established through the Water department ' with a copy to the City Treasurer, motion seconded by Diemond, carried so ordered. Motion made by Beck that parties on this line pay all costs of installation in e addition to connection fee of $50.00, motion seconded by Larson, carried so ordered. REPORT FROM COMMITTEES: RENT FROM MORNING MILE COMPANY: a Mayor Linderman called the councils attention to the fact that the Morning Milk Company parked three (3) milk trucks in the Citys yard in 1945, since January 15 1946 thay have four trucks parked in there every night, they have not secured a permanent place to park or mentioned renting the present space and he suggested ' that they be contacted relative to renting this space and paying back 'rent for time used, motion made by Beck to authorize the Mayor to negotiate with the Morning Milk Co. for rent on truck parking space, motion seconded by Casey, carried so ordered. GARAGE AND SERVICE STATION, FOURTH AND COLUMBIA: Mr. Haylett presented plans for a service station and garage to be erected at 4th and Columbia by Elmer Smith, the building will cost $10,000.00 or more therefor the Building Th-sbector requests authority from the Council to issue permit, motion made by Beck seconded by 'arson that Building Inspector be authorized to issue permit to Elmer Smith fora garage and servicd station on fourth and Columbia, motion carried so ordered. SEWER EXTENSION ON NO. LUCAS: Calling for bids on Sewer Extension_ to serve Block 3, 4, and 9 Kurths Addition, estimates on permanent trunk line, obtaining blue prints, grades and profiles from John W. Cunningham were all discussed, motion made by Rodkey seconded by Beck that we write John W. Cunni.nghams office to furnish plans grades and profiles on trunk line to be extended North on Lucas from the alley in Block 7 O'Keefes Addition.to the alley in Block 9, Kurths Addition, motion carried by roll call vote of seven. Mr. Pence would probably be available in case John. W. Cunningham wanted him to ; help out. SEWER SERVICE TO BLOCK 5, KURTHS ADDITION: Requested by I.I. Grigg;from a manhole at the alley in Block 6 and Aurilia Street Griggs wishes to bring a sewer line across the street and up the alley of Block ' Five to serve all that Block., Grigg to make installation, this was favored unanimously. BLOCK D- SEWER: John Beck spoke about sewer service to his home in Block D and Murray. The near- est manhole is in the alley of Block One, O'KeefAs Addition, approximately one hundred and fifty'from there to lamphole on East side of Murry. Becks contract calls for ara 4 1ne1f.n line to sewer, it was suggested that a 6" line be installed to allow other connections the city paying the difference between the cost of the 4" and 6" pipe. Fall in sewer line was considered Beck claims the grade is ample, motion made by Casey that the regular Sewer Committee investigate this situation and be given power to act, motion seconded by Larson, carried so ordered. i REPORTS FROM OFFICERS: CITY TREASURERS REPORT for January 1946 was read. BUILDING INSPE"'TORS report for January 1946 was read. 1171 PASCO, WASHINGTON WATER DEPARTMENTS monthly report was read. CHIEF OF POLICES report for December 1945 and January 1946 was read. POLICE JUDGES report for January 1946 was read. CITY CLERK furnished each member a copy of the December 1945 budget. FIRE CHIEFS report for January 1946 was read. READING OF RESOLUTIONS AND ORDINANCES: RESOLUTION NUMBER 256: Empowering a Recreation Committee to _spend Budgetbs money: Nelson objected to the division of money by monthly allotments, City Attorney favors this set up but amends Resolution to read, "or accumulated portion thereof,t' Resolution read as amended, motion made by Beck seconded by Diemond to adopt Resolution number 256 as amended, motion carried by roll call vote ofo:.( $), Nelson,Rodkey, and Wallis voting "nay". READING OF ORDINANCES: ORDINANCE NUMBER 569: AN ORDINANCE AUTHORIZING THE ISSUANCE OF THE "CITY OF PASCO SPECIAL FUND WATER - SEWAGE REVENUE BOND OF 1944-1946, SERIES B" IN THE PRINCIPAL AMOUNT OF $20,000.00, BEING A PART OF THE "CITY OF PASCO SPE-CIAL FUND WATER-SEAfAGE REVENUE BOND OF 1944", AUTHORIZED BY ORDINANCE NO. 531 OF SAID CITY, PASSED AND APPROVED AT A REGULAR MEETING OF THE CITY COUNCIL ON MARCH 7, 1944, DECLARING THE DENOMINATIONS AND MATURITIES OF SAID BONDS AND THE TERMS THEREOF: PRECRIBING THE SUBSTAFTIAL FORM OF SAID BONDS AND INTEREST COUPON, PROVIDING THAT THE SAME STALL BE PAYABLE OUT OF THE SPECIAL FUND KNOWN AS "THE WATER REVENUE SPECIAL BOND FUND OF 1944 "CREATED BY SAID ORDINANCE NO. 531 AND THIS ORDINANCE, AND PROVIDING FOR THE PAYMENT OF SAID BONDS OF SERIES B OUT OF AND FROM THE EARNINGS AND REVENUES OF THE WATER WORKS SYSTEM AND SEWAGE DISPOSAL SYSTEM OF THIS CITY AND CONFIRMING THE SALE OF SAID BONDS TO PAINE, RICE & COMPANY OF SPOKANE, WASHINGTON: PROVIDING FOR THE PUBLICATION OF THIS O11DINANCE A ND ITS EFFECTIVE DATE. Motion made by Rodkey seconded by Diemond that Ordinance No. 569 be given the third reading, motion carried, motion made by Beck seconded by Diemond that Ordinance No. 569 has been given the third reading, motion carried, motion made by Beck seconded by Larson that Ordinance number 569 be adopted, motion carried by roll call vote of seven. ORDINANCE NUMBER 570: AN ORDINANCE PROHIBITING SMOKING IN THEATRES, PUBLIC DANCE HALLS AND PUBLIC INDOOR ATHLETIC ENTERTAINMENTS AND PROVIDING A PENALTY THEREROR, AND THE EN:: FORCEMENT THEREOF. Motion made by Beck seconded by Rodkey that Ordinance No. 570 be given the first reading, motion carried. Motion made by Rodkey seconded by Diemond that Ordinance Number 570 has been given the first reading, motion carried, motion made by Rodkey seconded by Diemond that Ordinance number 570 be given the second reading by title only, motion carried. Motion made by Beck seconded by Diemond that Ordinance no. 570 has been given the second reading by title only, motion carried. Fires, smoking etc. were discussed, rollerdrome was thought to be a hazard as there is only one exit, crowds are large when fighting bouts are being held; Fire Committee and Fire Chief to make examination and bring in report. UNFINISHED BUSINESS: CEMETERY BUILDINGS: The barn and chicken house erected at the cemetery are not located on City property steps should be taken to acquire a strip of land adjacent on the East as it is needed for this purpose. GARBAGE FRANCHISE: Mr. Dietrich would like the city to sign a franchise with him, this was discussed lightly with no action taken. ENGINEERING SERVICES: Chas. Diemond states an engineer from Coulee Dam would be down here soon and his services could probably be obtained when the city is in need of that type of service. He did not know if he was a registered engineer. CHRIS ROUGUST REPAIR SHOP: The Chief of Police informed the committee that Rougust claims he is not charging for his repair work and the Chief did not see any money exchanged, therefore he could do nothing about it unless a warrant was obtained. TAXI FROM KENNEWICK: Much friction is being caused by the Kennewick taxis working out of Pasco only at night, one parks at the Northern Pacific Depbt. Nothing can be done about itat this time; mote equipment needed by Police to enforceZOrdinance. taxi i 1172 PASCO, WASHINGTON MATHESON GRAVEL PIT: Changing hands, Matheson wishes to sell the city some gravel from the pit at a dollar ($1.00) per yard delivered; Purchasing gravel needed at this time was favored unanimously RAISING WATER CONNECTION FEE: Water Committee recommend that the rates for water service connection be raised to $30.00, this will have to be done by Ordinance amendment or a new Ordinance. HERMAN SCHULTZ SEWER CONNECTIONS: H. Schultz was notified February 1, 1946 to pay $50.00 for each sewer connection h made, he paid for one connection but still owes the city $50.00 which he refuses to pay, motion made by Rodkeyseconded by Diemond that this be turned to the City Attorney for collection, motion carried. SHELDONS CONTRACT: Sheldons contract -rias discussed, council would like to get this taken care of. TWO HOUR PARKING: Two hour parking signs was suggested for side streets of Lewis in some cases it would only be a half block account parking meters.
