ROLL CALL: By Clerk, Councilmen present were Karl ail. Casey, Charles Diemond, Walter Nelson, D.F. Rodkey and C.R. Wallis, absent were John Beck and R.J. Larson also City Att- orney D.W. Zent. BILLS: McATEE AND HEATH: A voucher presented by McAtee & Heath was read in the amount of $6,356.74 for M -C-2 plant mix and hauling as per contract of October. 2, 1945, motion Trade by Rodkey seconded.by Wallis to/pay $700.00 at this time, balance to be paid in January 1945, motion carried by roll call vote of five. f lFVAL`I'ER H. ROTHE (ARCHITECT) A voucher and letter was read from Mr..Rothe regarding charges for sketches sub- mitted to the Planning Commission on a proposed City Hall Building, the Council feels that the Commission acted without authority when Mr. Rothe was employed but that services were rendered and bill should be paid, amount not to be in any way interperted as a retaining fee, motion made by Wallis seconded by Rodkey to honor voucher presented by Mr. Rothe in the amount of $300.00, motion carried by roll call vote of five, letters to be filed. Mr. Hall was present and stated that the amount was not out of line. D.J. SPEIERtS DAMAGES: A letter was read from D.J. Speier requesting that the City make repairs to his C garage without further delay, the cost of this work has been estimated at 58.00; letter ordered filed. 4 TRACTOR LOADER ( STREET DEPARTMENT) A letter was read from the Nelson Equipment Co. stating this piece of equipment should arrive in Pasco, November the 9th or 10th. yta� REPORTS FROM COMMITTEES: WEST SIDE CONTRACT: B.H. Sheldon i The final payment for Mr. Sheldon was discussed. A letter was read from City Attorney D.W. Zent rendering opinion requested by the council, states that in regard to the $25.00 per day penalty for time extending beyond completion, the clause in the contract might be enforced, however he feels that it would not be equitable, motion made by Casey seconded by Wallis that this be held over for consideration when more of the Councilmen are present, motion carried so ordered. LIGHTS ON WEST HENRY: Moen's Project and one at Bonneville and Tacoma, Morning Milk Company was turned to the Light Committee for investigation and report. REGULAR ORDER OF BUSINESS SET ASIDE: by unanimous consent. i BRO*IVNING' S NEW STORE BUILDING: Mr. J.D. Browning presented a sketch of a new store building to be erected on North 3rd at Nixon, at this time the Planning Commission report was read re- commending that_thp Browning application be approved subject to removal of the .tore,&trailers -8�11oimprovement of the cabins; plans to be submitted showing remodeling to'conform to the appearance of the store building. Motion made by Nelson ,seconded by Wallis to accept the Commissions recommendation an.��.�siness Licensissue4, motion carried so ordered. HAMMU NN' S TAVERN: Mr. Hammannts request for Building permit to build a cafe and store building on East Lewis at Main. The Commission reviewed the plans and recommend that a i building permit be issued. Tourist cabins now located on the property will be removed. The Police and Building Committees also favor this construction and activity, motion made by Rodkey seconded by Nelson to accept recommendation of i the three committees to grant permit, motion carried so ordered. REGULAR ORDER OF BUSINESS RESUMED: by unanimous consent. OLD FIRE TRUCK: { Old fire truck has not been tested for pulling power; C.R. Wallis to check with Brickey on this; Casey to have firemen clean leaves off the City Hall roof. PRICE OF GRAVES: Relative to the City Treasurer's request for an amendment to the present Ordinance setting out prices to be charged, more time was granted. SEVi,= BONDS Call for bids to be drawn up and advertised as per Resolution Number 252, part of 1139 PASCO, udASHINGTON this amount to enelude construction on West Henry and Block 121 and 122, Land Company's First Addition to Pasco. GIRL SCOUT'S REQUEST OFFICE SPACE: Building Committee to act on this request and advise Myrtle C. Hatton. POLICE DEPARTMENT RADTO LTCRNS-R! . A letter was read from H.L. Talen regarding his license being posted at the Police Departments Radio transmitter, subject to call 24 hours per day and requesting compensation. Motion made by Nelson seconded by Rodkey to turn this to the Police Committee with Talens letter, motion carried so ordered. REPORTS FROM OFFICERS: FILT'P,4TION PLANT NEEDED FOR PASCO: A report from The State Department of Health to Dr. C.C. Tudor was read, City Treasurers report for October was read, Water Managers Monthly report was read. PLANNING COMMISSION reports for two meetings were read. READING OF ORDINANCES: Ordinance No. 561 requested by the Council to amend Building Ordinance No. 435 was read; after due consideration and acting in accordance with recommendation of the Planning Commission, proposed Ordinance No. 561 was ordered tabled. Section 10 of Ordinance No. 435 covered the purpose set out in Ordinance No. 5613, motion so made by Rodkey seconded by Nelson, carried so ordered. ORDINANCE NO. 562; AN ORDINANCE DEFINING THE CRIME OF PETIT LARCENY AND PROVIDING A PENALTY THEREFORE. Motion made by Rodkey seconded by l�elson that Ordinance No., 562 has been given the first reading, motion carried. Motion made by Nelson seconded by Rodkey.that Ordinance Number 562 be given the sedond reading by title only, motion carried, motion made by Rodkey seconded by Nelson that Ordinance number 562 has been given the second reading, motion carried. ORDINANCE NO. 563: AN ORDINANCE AMENDING ORDINANCE NO. 478 OF THE CITY OF' PASCO, BEING AN ORDINANCE RELATING TO AND PROVIDING FOR A LICENSE OR OCCUPATION TAX UPON CERTAIN BUSINESSES, OCCUPATIONS, PURSUITS, AND PRIVILEGES: DEFINING OFFENSES AND PROVIDING PENALTIES, AND REPEALING SECTIONS 31, 65, and 72 OF ORDINANCE NO. 4241 BY ADDING PARAGRAPH (d) to SECTION 5, OF SAID ORDINANCE. Motion made by Casey seconded by Nelson that Ordinance No. 563 has been given the first reading, motion carried, motion made by Casey seconded by Rodkey that Ordinance No. 563 be given the second reading by title only, motion carried, motion made by Rodkey seconded by Casey that Ordinance number 563 has been given thessecond reading, motion carried. NEW BUSINESS WATER MAIN REPLACEMENT AND EX`T'ENSION: D,W. McGhee presented figures and data to cover the proposed replacement of wooden 4 pipe and main extensions; following a detailed discussion, motion was made by Nelson !� seconded by Rodkey authorizing the Water Manager to call- for bids on approximately E $25,200.00 worth of pipe and approximately $3,000.00 worth of fittings; bids callable December 18, 1945, motion carried by roll call vote of five. i UNFINISHED BUSINESS: ASSOCIATION OF WASHINGTON CITIES: A letter was read from Geo. F. Christensen, extending his regrets at not being able to attend the Regional meeting to be held here November 28, 1945. A letter was alsoread from Joshua H. Vogel, and enclosed were post cards to mail out to other cities inviting them to the Regional Fleeting, BRO1,11NINGIS STORE: A letter was read from the School District No. stating that according to,Ord.inance number 435, when the property owner wishes to appeal -from the Planning Commissions decision the council are empowered to -take such action as they deem proper after a public hearing._ The Commission would like to be informed of the date and hourof any such meeting. This was acted upon at a meeting by the Council and Planning Commission before the Council meeting.
