Ordinance eras read in full for .its first reading, by the Clerk, Whereupon it was moved
by Councilman Marshall, seconded by Councilman Drennan that Ordinance No. 531 had hadiits
first reading in full, which motion was carried with Councilman Rodkey voting No. It was
then moved by Councilman I,Ia.rshall, which motion was seconded by Councilman Diel,I.ond treat
Resolution No. 216 be adopted as read, which motion was adopted unanimously. It was
moved by Councilman Drennan and seconded by Councilman Diemond that Ordinance IIo. 53-1
have its second reading by title only. This motion was after discussion carried with
Councilman Rodkey voting; Ho. Ordinance No. 5_31 was thereupon given its second reading by
title only and it ,ras-movd.d by Councilman I:Iarshall and seconded by Councilman Drennan
1 that Ordinance No. 531 had had its second reading. Thereupon it was moved by Councilman
Marshall and seconded by Councilman Drennan that any and all rules or laws of any
1 character what so ever requiring third readings of any ordinance to be had at this or
subsequent meetings of the City Council be dispensed with and that the same be placed
u -on its third reading and passage at this meeting, which motion was lost uron an Aye
vote and Nay vote duly had and recorded with Councilman Rodkey vot_ng iio. After consider-
able discussion it Naas moved by Councilman Rodkey and seconded by Councilman Tlarshall �
that the foregoing motion be reconsidered, and upon question being put, said motion vas
passed unanimously. It was then moved by Councilman Rodkey and seconded by Councilman
Marshall that Ordinance No. 5.31 be given its third reading in full. Ordinance No. 5-41
was thereupon read in full and motion made by Councilman Drennan and seconded by
Councilr.ian Diemond that Ord-inance No. 531 had had its full reading, which notion was
passed unanimously; whereuron motion was rade by Councilman Marshall, Seconded by
Councilman Diemond that said Ordinance be enacted, passed and adopted, and the sane, was
placed Anon its rassage, whereupon an AYE and NAY vote being duly had and recorded, the

County, ?Tashington, for value received hereby ?promises to pay to bearer on the

per centum per annum, sayable semi-annually on the first day of !.larch and September
in each year upon l;he presentation and surrender of the annexed interest coupons as
they respectively mature; both principal and interest of this bond being payable in
lawful money of the United States of America at the office of the City Treasurer of
Pasco, in Pasco, Vlashington.
This bond and the int:er-�st t-fiereon are payable solely from a special
fund named and known as the "',eater Revenue Special Bond Fund of 1944" created by
Ordinance No. 5,-31 of said City, passed and approved I:larch 7, 1944, providing for
the monthly payment into said Special Fund from the earnings and revenues of the Water
Works System of said City, and, in certain contingencies, from the earnings and
revenues of the Sewage System of said City, of fixed and definite sums sufficient to
pay annually maturing principal of and interest accruing upon the issue of bonds of
which this is one, as the same become-a.7able, and as provided in said Ordinance and
other proceedings of said City; and the City of Pasco hereby cov=n.ants and agrees
with t -he holder of tris bond, and with each and every person who may become a holder
thereof, that it will pay into said Special fund monthly from such revenues said
fixed amounts sufficient to pay such principal and interest at maturity, and will keep
and perform all the covenants and provisions of said Ordinance; that said City shall
not sell, lease. or in any manner di_srose of, said water works system

r (as now owned and operated, or as the sane may be improved, bettered or extended
hereafter) or any substantial part or unit' thereof, until this bond and the bond issue
of which -it is one, together with interest thereon, shall be paid in full, unless and
until provision shall_ have been made for the full payment of all of said bonds and
interest; that said City (until all of said bonds and the interest thereon shall have
been fully paid) shell not reduce the rates demanded by it for water delivered to
consumers from slid system so that the gross revenues of said system (after paying
the cost of operation and maintenance thereof) shall be insufficient to permit the
making of the payments into said Special Fund as required by said Ordinance; that if at
any time the gross .revenues of said water works system or as hereafter bettered, extended,
added to and improved, or of said sewage system, shall not be sufficient to pay said
costs -,f oreration an,'. Y aintenance and the charge t'_aeron by said Ordinance created in
favor of the bonds authorized by said Ordinance, it, the said City , shall increase its
said rates to such rates and amoants as will be sufficient to provide for the payment
of all such costs of operation and-aintenance and of the bonds authorized by said
Ordinance; that, in order to preserve the priority of the said Special Fund, the said
City shall not create, or permit to be created, so long as any of said bonds shall'be
outstanding and unpaid, any indebtedness or charge :whatsoever which shall be a charge
i against the revenues of said ',rater -,works system and sewage system superior to tele
charge created by said Ordinance; that any future charge or srecial fund indebtedness
which may b=; created by said City to be rayable out of the revenues of said water system

This bond and the interest thereon are and will continue to be a first lien and
charge against the gross revenues os said ;nater works system and sewerage system in
accordance :,Pith the provisions of the foregoing Ordinance, prior to the charge of lien
of any other or future indebtedness tehi ch may be created by said City, payable out of
the relven.ues of said water works system.
This bond is one of an issue of t-1-- Special Fund `[[,,ter -Sewage Revenue Bonds of 1944
Series A, of siad City of like date, tenor and effect, except as to rates of interest
and provisions ''or redemption_ and prior call, aggregating One Hundred Twenty-five
Thousand Dollars ( 4125,000.00), numbered from One (1) to One Hundred Twenty-five (125)
inclusive, of the denomination of $1000.00 each, maturing in numerical order, lowest
numbers first, as follows: $5000.00 on Yarch lst in each of the years 1946 to 1949,
inclusive; $6000.00 on a similar date in each of the year 1950 to 1955, inclusive; j
$7000.00 on a similar date in each of tr:e years 1956 to 1959, inclusive; ?8000.00 on
a similar date in each of the years 1960 to 1963, inclusive, and $9000.00 on a sir,ilar �
date in the year 1964; Provided that bonds maturing on Harch lst in each of,the years
19621 196_13 and 1.964, being Bonds Nos. 101 to 125, inclusive, or any of them, shall_ be
redeemable prior to their dates o`' m--turity at the option of the city on any interest
payment date on or after three years from date of said bonds, and all bonds outstanding
and unpaid after i,�arch 1, 1954, shall be redeemable prior to their dates of fixed
maturity at th-3 option of the city on any interest paymont date on or after Larch 1,1954,
all in the inverse order of their nurlbering, highest numbers first, upon and after prior
publication of notice of t1le intention thus to redeem published at least once in a
Ne,:rspaper of general circulation published `,within Pasco, rranklin County, trTashington,
such publication to be had at least two w-=eks Prior to the date of such intended
redemption; all of which bonds have been issued by said City for the purpose of
paying the cost and expenses of adelitions extensions, betterments, and improvements
to the existing sewage system of the City of Pasco and the construction and installation
therein of a sewage treat-lerit and disposal pliant as an extension of, and by said
Ordinance made a part of, said ;rater works system; and this bond has been issued under
the authority of and in strict compliance with the Constitution and laws of the State
of ."lashington and the ordinances and resolutions of said City.
It is h=reby certified that all acts, conrlit ons and things required by the
Constitution and laws of said State and by the Ordinances and resolutions of said
City to happen, exist, and to be done and performed precedent to and in the issuance
of this bond have duly happened, have existed and do exist, and have been dobe and
performed.

The foregoing bond form having been read in_'?z11 by the City Clerk, it was moved
i; by Councilman Diemond, seconded by CouncilmanRodkey, that the foregoing bond form above
set forth in these minutes be adopted and approved as substantially the bond form to be d
used for the issuance of said bonds of $125,000.00. After discussion, an AYE and NAY
vote having been dul, had and recorded, the vote thereon resulted as follows:

hTayor, Clerk and City Treasurer were directed to cause the said bonds of �I
$125,000.00 to be executed substantially in the foregoing form.
(There were no other proceedings relating to said bond issue adopted at
said meeting.)
B. H..Sheldon awarded Bid:on Sewer Projects
A letter from John W. Cunningham was read recommending that B. H. Sheldon the low=
est bidder on the sewer project work, be awarded be-awai2ded thebid, he also recommends
the dry pit type pump installation motion made by Diemond seconded by Rodkey that the
recommendation be acdepted, awarding the contract to B. H. Sheldon however the contract
is not to be signed until priorities have been obtained motion carried by a roll call
vote of six (6).

to give a thirty year lease beginning April 1st, 1944 for the consideration of %1.00
for the entire term motion made by Booth seconded by Rodkey that the lease be accepted
motion carried so ordered.

P.Mr. Hostetter discussed +with the Council the purchase of city property on
Second and Columbia, this was turned to the St. Committee and planner Richard Rector,
NAZARENE TABERNACLE:
Mr. H. W. Midby of the Nazarene Churc7g & Tabernacle requests an extensic•n
of their temporary permit for an additional 90 days from March 15, 1944, he also spoke
of the intent of the church to build on their property the South East corner of Yakima
&_
7th. He was instructed to consult the building Inspector about the Church plans;
He also made inquery regarding the.possibiiity of being allowed to move the present
Tabernacle structure to their property this was not favored by the Council motion was
made by Rodkey seconded by I:Marshall that the 90 day permit be granted for the Tabernacle
in its present location motion carried so ordered.
Apartments on 4th and Yakima St.
I'JIr. Bolin plans to erect an apartment house a1' two storysstructure with{
four apartments.on each floor at 4th and Yakima, the City Attorney and Mr. Rector
state that this type of construction does conform with the present Ordinances and
Buidli.ng Code; It was unanimously recommended that the City Attorney write Mr. Bolin
and advise him that he may proceed with his plans. I
FIRE ZONE CHANGES:
The City Attorney was advised to go into the fire Zone Ordinance thor-
oughly before preparing an amendment.
SEWER CONNECTION::
The Water Committee recommend a sewer connection fee of $50.00 and a monthly fee of
.50 cents starting after 60 days; It was also eec6itm6ndedtto thent(bbuncil & dommittee
that the City Attorney set up a form for signatures ofdproperty owners, not now having
sewer service, but willing to pay for connections or desiring to protest motion made
by Marshall seconded by Diemond to accept the Recommendation motion carried so ordered.

The Water Manager was authorized to purchase fittings etc. for the pumps installation.
