CALL T(P ORDER:
Meeting called to.order at eight o'clock P.M..Honorable Mayor E.. S. Johns on
presiding.
ROLL CALL:
By City. Clerk Councilmen present were D. Byron Baker,' Harry Chenoweth,
C. V. Downey, R. 0. Hall, Robert James and PiT. J. Linderman; Councilman absent
was M. J. McDonnell.
REGULAR ORDER OF BUSINESS _SET ASIDE:
14 -tion made by Linderman seconded by Chenoweth that the regular order of
business be set aside for _the publiQlihearing on tacating Nineth Street between
Bohnevilld and Shoshone streetti.motion carried so ordered. Rex Phillips and C. A
Jones referring to a petition protesting vacating of 9th, signed by property holdars
not desiting to be completely deprived the privilege of using 9th Street for all
times, and owing to the fact that school hours constitute one-quarter of the time
they favor barricading this street during School houts; Mr. C. -L. Booth and Leig
:Sachs supported a petition in favor of vacating, on account of the desire to con-
solidate the Play Grounds by removing side walks and curbs thus eliminate the haz rd
of accidents by falling over'them; The decision of the Council was posponed for mbre
study and consideration. City Attorney to contact the School Board to ascertain
the nature of concessions if any.
VACATING ARTHUR AVENUE BETWEEN NIXON AND SYLVESTER STREETS:
This request was made by the Park Committee for the purpose of making
Sylvester ]Rark into one unit; I -lotion made by Linderman seconded by James that th
expression of the Council for the beat interest of the public, with the City Att
be instructed to draw up an ordinance covering: the vacating of this Avenue, Doti
carried so ordered.
'ChOSINGri AN `ALLEY
Lee Smith wishes to have a short alley closed in block nine Pettits
Second Addition. this was referred to the Street and Alley Committee.
LABOR ON ROOM .OF RESIDENCE AT CEMETERY
Five men having worked as laborers'on the one rook addition to the re-
sidence asked the Council to pay them for services rendered; They were re4udstz*d
by the City Attorney to present vouchers showing their hours and rate of pay, ani
they would be acted on at the next regular meeting May 1st.

OPENING BIDS ON TRUCK FOR WATER DEPARTLIENT.
In response.to a call.for bids on a pick-up truck for the Water Dept
the following bids were received, opened and read.
1- TWIN_CITY TRUCK & IMPLEMENT CO_ One 1941 Model K-1 International Pick-up.
conforming with all State Laws. Price $865.59, State Tax.' $17.31, less trade in
1936 Ford Pick-up of $392.90, balance $490.00'
2 --DODGE & PLYMOUTH: One Dodge one-half ton pick-up 1941 Model, conforming with all
State Laws, Price $867.50, State Tax 17 .53, less trade in on 1036 Ford pick-up
of $250.00, balance $644.03.

Price7$9.00, allowance on 1936 Ford pick-up $325.00 State tax 15.78 making a
total cost of $479.78.
5- PASCO AUTO CO. One one-half ton pick-up 1941 Chevrolet, conforming with all Stat
Laws Price T823.45, sales tax $16.47, less trade-in allowance on 1936 Ford pick - p
Tbtal cost $539.92. After due consideration the bid was awarded to the Pasco gut
Company, by unanimous consent of the Council reported by Purchasing Abent Harry
Chenoweth.
READING OF THE MINUTES:
Minutes of the previous meeting were read and approved as read.
BILLS AND COMMUNICATIONS::
RE: EASEMENT FROM S. P.€{e. S. ON SOUTH FOURTH:
A letter to the City Attorney from J. C. Davies, Right of Way & Tax Agent for tha
S.P.& S Railway Co. was read stating this company desires a compensation for that
part of Block five and block twelve Grays Addition impaired by the extension of
South Fourth Street. This was turned to Street Committee and City Attorney for
investigation and report..
N.I.P.Agent H. V. Custer requests by letter that he be notified in advance should
the City have a trial black out, thus avoiding traffic delay.
A letter from the Water Superintendent of Seattle, advising the Mayor and Council
that the District Convention of the American Water Works Association will be helc
in Seattle May 8,9 & 10, 1941, Headquarters at the dlympic.-.Hotel.
A letter was read from Mr. J. E. Blum Field Consultant for the Association of
Washington Cities, commenting on the outstanding service rendere&.Cities, by
Senator Stinson; Also the splendid support from representatives of this District.
PROJECT #7073; Works Projects Admisistrator Carl W. Smith informs the Mayor tha
X7073 covering the removal of trees, excavating, laying storrd Sewers,._constructi
catch basins and concrete curbs, gravel surfacing etc; has been submitted to Whah
ington B. C. for approval.
Chester Biesen reminds the City Officials by letter, that the Annual Convention
of the Association of Washington Cities will be held at Walla Walla, Washington
May 22nd & 23rd. All who can are urged to attend.

REPORTS FROM COMMITTEES::
Police Committee -reports 26 arrests and 34 warrings in traffic rule violation, al;
that the Dog restriction Ordinance now in exixtance becomes operative the first o:
May 1941.
Light.Committee reports material obtained in Kennewick to complete ornamental lig]
extension.
PUblic_Buildings_Committee reports the City Hall clean up work is progressing the
interior is all most completed, the exterior and gutters to be taken of next.
STREET Committee reports, a slow sign had been erected on South 10th, This was
requested of the Council by petition.
PUblic Building & Property Committee report in favor of obtaining two adding mach
ines one for the City Treasure and one for the City Clerks officeq, Linderman
requests that this purchase be made by calling for bids also that different makesi
of machines be given a trial to determine which type would best suit the nedds;
Motion made by Baker seconded by Linderman that the Committee and City Clerk
prepare call for bids in thirty days Motion carried so ordered.
HEARING ON SALE OF RIVER LOTS: James suggested that the hearing on the sale of
four River lots to the Port District be held May the first; Linderman moved that
the time be set ahead to the 15th on account of paying,bill the first meeting
Motion seconded by Hall carried so ordered.
DELAY ON BIDS FOR PRINTING: Linderman made inquire as to the delay in calling fo:
bids on Ct,y Printing, and was informed that both the Pasco Press and the Pasco
Herald editors had asked for more time; this was turned to the Printing and Audit:
Committee they are to get together with the City Attorney to make necessary arrant

REPORTS FROM OFFICERS::
The City Clerk furnished each member with a monthly budget report for -all depart-
ments.
The Building Inspector's Annual -report was read.
The City Water Manager's monthly report was read.
Police Judge reports $30.00 received in fines for the Month of February 1941.
and $30'.50 for the Month of March, 1941.
The Department of Highways submit a form showing the route of Primary State High-
ways, From the same department the City Budget Control report showing an unappro-
priated balance of $1,375.82 in gas tax money at the first of March 1941. Also
informing us that since April 1939 the City of Pasco has received $15,252.21 in
gas tax money.
A booklet from the Association of Washington Cities showing uniform curb markings
was reviewed `and a copy given I. N. Brickey. '
ORDINANCES AND RESOLUTIONS:P
A.resolution dedicating.a street between block "D" of Pettit's Addition to Pasco,
and blocks one and four of O'keefes Second Addition to Pasco -for the use of the
general public. Motion made by Hall seconded by Linderman to accept the resolutia

A.resolution authorizing the State Highway Department to paint a yellow strip mn
the highway within the coperate limits of the City of Pasco, and reserve and cred:
to the Department of Highways in payment for such mainte.4ance work, throught the
Motor Vehicle fund. Motion made by Baker seconded by Linderman to accept the re-
solution, motion carried so ordered.

VETOING AIJIEND14ENTS NO. ONE AND TWO TO ORDINANCE NO. 459: A notice in writing was
submitted by Ma yor E. S. Johnston vetoing amendments number one and two to Ordina.
Number 459."Number one, the amendment which causes section three, paragraph one, t
allow the construction of one and two family dwellings in fire zone No. one "o con
struction less substantion and fire proof than typethree construction as outlined
in the Uniform Building Code. IVly objection to this is that it would open up the en
tire commercial zone to the construction of flimsy dwellings which would be creati:
a serious fire hazard." SECOND "The amendment to section three and section four wh
would enlarge the boundries of fire zone number one and decrease the boundries of
fire z one number two correspondingly. Ily objection to these amendments is the fac
that they have the effect of restricting the building of residences in certain part
ofresidential districts. I believe that the ordinance as it previously stood is
sufficient in the way of fire protection and am convinced that the irregularity of
the North boundry line of fire zone Number one as therein constituted does not conf
special privileges upon anyone, since the original boundry conform to the line of
demarcation between commercial district No, one a4d residential districts." E.S.J.

NEVI BUSINESS::
JOHN BECKS DEED INSUFFICIENT:: Motion made by Chenoweth seconded by Hall author-
izing the Mayor and City Clerk to execute corrected deed, motion carried so ordered
FILLING IN OLD DUMP::
Some filling and leveling work needed at the odid City Dump was discussed, in concl
sion it was agreed that R. 0. Hall was to contact the County Engineer in regard to
doing this work while working in that location with necessary equipment.

CITY ATTORNEY'S BUDGET::
City Attorney Karl J. Grimm asked the Council permission to -use the money,bud-
geted for the Pierce Code, on Municipal Corporation instead, mation made by
Chenoweth seconded by Hall that this request be granted, motion carried so orde ed.
These volumes to be property of the City.
LEASE ASSIGNMENT N0.2a_U0;
For notation. recording and filing duplicate original of assignment of permit
No.22330, which was issued November 20, 1909 to the Yakima Valley Power Compan
and later assigned to the Pacific Power & Light Company. This assignment now
transfers said permit to the City of Pasco. For Water pipe line across lot eight
of section thirty one TWP. nine North, Range 30 East along the center line of
Chelan Street produced in Riverside Addition to Pasco Washington according to
the official plat thereof.,
Tart SCELIANEOUS : :
SEVER LATERAL ON SOUTH FIFTH:
There has been no further developments on a sewer lateral for South 5th
Street, pending an answer from'a letter to the Division of Public Health
Engineering, State Department of Health , Seattle Washington.
