Adjournei Sessiog _ December 30th, 1938
ROLL CALL: City council met in an adjourned session to clean up the year's business
with Mayor Hicks presiding and following councilmen present on roll call: Burns, Christer
Haylett, Leroux, Partch and Wirth; absent O'Herin.
MINUTES OF SESSIONS HELD Dec. 15th, 20th and 22nd were read and approved.
Mr. Hansen of the State Highway Dept, thanked the council for co-operation received
them in testing equipment.
RAISING WATER TANK: Mr. Owens of the Steel Construction Co., low bidders on job
raising the old 200,000 gal. water tank appeared before the council and advised that he h
brought along bonds in connection with their contract which Mr. O'Brien was to examine,
The latter stated he had not yet completed examination of the bonds and would do so next
day and would draw up contract to include some suggestions made by Mr. Cunningham; Mr. 0
had been told of these suggestions and they met with his favor. City Attorney suggested
that the mayor and city clerk be authorized to sign the contract as soon as bonds satisfa
to the city attorney had been supplied. The city desired a performance bodd of about ?7
or amount of contract and $17,500. indemnity bond. Mr. Owens stated that as long as he
would be penalized $15.00 per day for delay in completing the work, he believed as a matt
of fairness that in figuring date on which the job was to be completed, the time at which
received the stress diagrams for the city's engineers should be taken into consideration,
It was informally suggested that March 15th be set as the date for completing the raising
of the tank, instead of March lot.
Mr. Owens objected to furnishing two bonds, one for $17500. for indemnity and the
other $7391. to cover performance, as specifications called for only bond of yj17,500. to
be furnished to cover indemnity. He was informed that the state law nrovided for a perf
bond to be filed and that was the reason it was not mentioned in the specifications.
AT THIS POINT, Mayor Hicks left the meeting, being obliged to resume his work;
motion made by Partch, seconded by Wirth end carried, they Haylett be elected as mayor pr
A motion was then made by Partch, seconded by Christensen and carried without diss
on roll call, that the city pay for the additional bond of $7381., by adding the amounto
$111. to the contract.
A motion was then made by Wirth, seconded by Christensen and carried, that the
mayor and city clerk get in touch with the city attorney and when the bonds are found sat,
factory, that they be authorized to sign the contract.
LETTER FRO'S Division of Municipal Corporations advised the city that it will be
expensive to send an examiner to make transfer from old to new city treasurer, as none is
closer to Pasco that Waitsburg. A motion was then made by Partch, seconded by Christens
and carried, that the Mayor and Finance Committee check opt the old city treasurer and
check in the new one and the State Auditing Dept. be advised by wire not to send a state
examiner to Fasco to make the transfer, and that copy of the ,,ire be sent to the state
examiner in care of the city clerk, at Waitsburg.

Clerk reported that $129.00 had been collected for 1939 licenses
and that the
total
for 1939 was $7936.00.
ORDINANCE No. 439, FIXING PRICE OF GRAVE LOTS IN CITY VIEW CEI'IETERY, PROVIDING
ANNER OF PAYMENT THEREFOR, and providing for certain other regulations of the cemetery
as read. Motion made by Wirth, seconded by Lehoux and carried, that Ordinance 439
e declared to have had its firstreading. Motion made by Wirth, seconded by Partch and
arried, that Ordinance No. 439 be given its second reading by title only; ordinance read
y title and Partch moved, seconded by Wirth, that the ordinance be declared to have had
its second reading; carried.
Motion made by Partch, seconded by Christensen and carried, that the rules
e suspended and the ordinance be given its third reading;k ordinance was given its third
wading. Motion made by Christensen, seconded by Wirth and carried, that the ordinance
e declared to have had its third reading.
Motion made by Christensen, seconded by Partch and carried without dissent on roll
all, that Ordinance No. 439 be declared adopted.
F. R. LEROUX HANDED IN HIS RESIGNAtLON AS A COUNCILILAN; motion made by Wirth,
econded by Partch, that the resignation be accepted ,vith regret; motion carried
nanimously.
A. M. WESTBY WAS ELECTED TO FILL THE UNEXPIRED TER14 OF F. R. LEROUX as councilman,
motion to that effect being made by Wirth, seconded by Christensen and carried. A
otion was then made by Partch, seconded by Wirth and carried, that a vote of thanks'be
xtended to Mr. Leroux by the council for the nife co-operation he was able to give the
ouncil when he was able to attend.
THATTHE COUNCIL will meet Tuesday, January 3rd, was the understanding of the
ouncil, at which time the old council will adjourn sine die and the new council will
rgani ze .
ADJOURNMENT: Motion made by Wirth, seconded by Christensen and carried, that the
ouncil meeting adjourn until 9 PAA, Tuesday, January 3rd, 1939.
