The following answered troll call: Bryan, Jewell, Nelson, O®Herin, and Robbins. A letter -from Police Judge Bean asking that the council have.female prisoner removed to the county jail was read. After•and investigation of the,.City, jail O'Herin seconded by Jewell moved that the com- munication be plaeed.on file and no action taken. Carried. A letter from the City of Yennewick to The fire department was read. O'Herin seconded by Robbins moved the letter be acknowledged by the clekk and he thank them for their offer. Carried. Agreement with Notrthern Pacific RailwaynCompany read. axrxsAErGMtXXa a3Xrgff&y S/ The folluving resolution was read: WHEREAS, the City of Pasco is the owner and is now operating a water system known as the Pasco Municipal Water System, and WHEREAS, tbae Northern Pacific Railway Company, a corporation is the owner and is operating .a.water system witkin the City of Pasco, and WHEREAS, it is to the interest of both the said City of Pasco and the Notrthern Bacific, Railway Company that the said City and Company shall co-operate for the purpose of furnishim a supply of water at all times to both the residents of the City of Pasco and to the said Railway Company, NOW THEREFORE, he it resolved by the City Council of the City of Pasco that the Mayor of the City of Pasco add the City Clerk of the City of Pasco be, and they are hereby authorized to sign and enter into and. agreement with the said Northern Baeifie Railway Company for the mutual furnishing of water from one corporation to the other in the event of emergencies which may arise and said agreement shall be in words and figures as follows: to wit: This agreement made and entered into this day of April, A. D. 1924, be and between the City'of Pasco, anmunicipal corporation, party of the first part and the Northern Pacific Railway L'ompany, a corporation, party of the seeond part, WITNESSETH: WHEREAS, the said party of the first part is now owner am& of and is operating and con- ducting a Municipal Water System for the pumping and productAg and selling of water for domestic, irrigation and general purposes, and WHEREAS, the said Northern Pacific Railway Company is the owner of a private pumping and water system for the producing of water for railway purposes and for domestic purposes to the occupants of property owned by the said Northern Pacifid: Railway Company within the City .of Pasco, Franklin County, Washington; and WHEREAS, emergencies may arise by reason of which the water system of the City of Pasco may be incapable of furnishing sufficient water to supply the demands of the users and consumers within the said city; and emergencies may arise wherein the said Northern Pacific Railway Company may be unable to furnish water for railway purposes or for the use ( of the occupants of the property belonging to the said Northern racific Railway Company within the said City of Pasco. l NOW THEREFORE, it is hereby agreed by and between the said City of Pasco and the said Northern Pacific Railway Comapny that in the event of such emergency whenever the said Northern Pacific Railway Companyshall need water in excess of that which they are able to secure from their own water system the said City of Pasco shall furnish and supply to the said Northern Pacific Railway Company , by turning the same into the pipes and mains of the said Northern Pacific Railway Company or by allowing the said Notrthern Pacific Rail- way Uompany to use the said water from the pipes od the said City of Pasco, sufficient amount of water to supply -the need of the said'Northern Pacific Railway Company during the continuance of such emergency. And the said Northern Pacific Railway Company hereby agrees to furnish to the said City of Pasco; during the continuance of such emergency on its part a sufficient amount of water up to the capacity of the said Northern Paciiiei Railway Company's supply, to supply the needs of the said City of Pasco and its users and consumers during the continuance of such emergency. And in either eUent it is agreed that whenever water shall be furnish by rpe said City of Pasco to the Northern Pacific Railway Company art as hereinbefore stated, or whenever water shall be suppliedby the said Northern Pacific Railway Company to the said City of Pascp as here4.rbefore specified the same shall be paid for by the part; receiving the same to the party furnishing the same at the rate of 4¢ per one thousand (1000) gallong of water so delivered and furnished by one of the parties hereto to the other of the said parties. It is understood anti agreed that this contract shall continue and be in force a$d effect from and after the date hereof until such time as notice of the termination thereof shall be iven in writing by either party to the ether party hereto, such notice to be a thirty (3 day day notice of the intsdtion to terminate this agreement and the terms and conditions hereof. IN witness whereof we have hereunto set our hands add seals this 18th day of April, A. D. 1924. Robbins seconded by O'Herin moved that the resolution be adopted as read. Upon roll call all cowicilmen voted YsS. e new schedule of rates for the irrigation season were read. O'Herin seconded by Robbins moved that we adopt Schedule C in lieu of present schedule as a tentative schedule for irrigation season from meter reading in April to meter reading in October. Upon roll call all councilmen voted YES. O'Herin seconded ny Jewell moved that the salary of the water manager be fix6d at $200.00 per m )nth. Upon roll call Bryan and Nelson voted No, Jewell, O'Herin,and Robbins voted Yes. Robbins seconded by Bryan moved we adjourn. Carried. Passed for approval this day of May 1924.
