AN Ordinance to license certain trades and occupations in the City of
Pasco, '.Jashington.
BE IT ORDAI_dED BY THE CITY COUIICIL Or THE CITY OF PASCO:
SECTION 1. No person shall engage in, prosecute or carry on
any trade business or occupation within the corporate limits of the
CITY OF PASCO, for which a license is required by this ordinance,
without first having obtained a license therefor.
SECTION 2. Each applicant for a city license shall pay to the
City Clerk the sum or sume herein required to be paid for such license
and the clerk shall issue to the applicant a duplicate receipt therefor.
Such receipt and the stub thereof shall contain the name of the party
paying such license fee, the date, the amount paid and the business
licensed, a short description of the place '::here the business is to
be conducted. Such receipts and stubs shall be numbered, and in lieu
of a regular license be and constitute a sufficient license. Such
receipt shall contain the signature of the city Clerk and the impress
of the City se&l. Provided horiever that the city clerk „hall as soon
as practical procure a lice,se forms suitable to be used for all kinds
of busin sses for l:-ich license is reg.7ired, and shall thereupon tape
up all such receipts and issue instead such licenses.
SECTION 3. No license shall entitle the holder thereof to carry
on business except in the place named Herein, unless the place so named
sha7.1 have been first permanently closed. No license shall be assign-
able except by express vote or permi.sion of the city council.
SECTION 4. EVERY person engaged in any business or trade or occupa
tion for which a license is required, shall keep such license posted in
a conspicuous place abo-•t such place of bu,.iness, and shall produce such
license at any time on demand of the City Clerk or any police officer.
All licenses shall be conditioned upon the licensee conforming to all the
laws of the United States, of the State of Uashi.ngton and Ordinances
of the City of Pasco, pertaining to such bu:-iness or occupation. No license
shall be granted for any shorter period than as herein specified and no re-
bates shall be paid if the license shall fail to operate tl-B business 'or
the full pe ri od of the license.
SECTION 5. In every case where more than one o' the businesses of
occupation, for which a license is res ired is carried on in the same place
by the same person at the same time a license must be taken out for each
of said businesses. All licenses shall be for one year except as herein
otherwise provided, and ahal� be paid on or before the 30th day of June of
each year.
SECTION 6. Keepers of Billiard and Pool Halls shall pay an annual
license of $2.00 per year for each billiard or pool table belonging to or
used in concoction with such establishment. EVERY PLACE OPEII ` O THE puColic
where billiards or pool are played with or price shall be deemed
a billiard room under this ordinance.
SECTION 7. Bill Posters. Bill posters shall pay a license fee of

Section 8. Bowling Alleys. Keepers of bowling alleys shall pay a license
fee of Q8.00 per year for each alley used owned or operated in snch place of bus-
iness. Every place omen to the public where bowls are thr elm or •':here box ball is
played shall be deemed a bowling alley hereunder.
Section 9. Citcuses. Circuses shall be divided into two classes;
Class 1. shall in, lude all :shish charge a gene. --21 admission fee of fifty cents
or more and class two shall include all which charge a general admission fee of
less than fifty cents. The term circus shall be held to include a mena,-erie,
dog and pony shows and other emhibitions in tents or other enclosures where
trained performers ex' ibit whether human beings or' animals. Circuses of Class 1
shall. pay a license fee of `75.00 for each performance authorized to be given under
such license. Circ-,ises of Class 2 shall pay a license fee of 9`10.00 for each
performance aut',orized ti be given hereunder. Side Shows.Ehe proprietor of each
side show travelling with or connected with any circus or other travelling show
T a separate charge is made for admi-sion shall pay a license fee of five
dollars per day.
Section 10. Theatres and IaIoving Pictl-Te Shows. Proprietors or managers
^£ moving picture shows having a seatin capacity of more than (300) persons shall
pay a license fee of X50.00 per yee.r and those having a seating capacity lest than
the number above specified shall pay a liennse fee of 025.00 per year.
Section 11. The proprietor or manager of any other show not herein other
wise provided for shall pay a license fee of yp2.00 per day, unless such performance
sh al' be riven for the benefit of some local social, religious or fraternal or
educational organi^ation, or for some charitable purpose or shall be a reco--rized
Chautauqua.
Section 12. The proprietor of manager of each public dance hall or open
air lancing pavillion shall pay a license fee of j40.00 per year.
Section 13. Hawkers. Every person who shall of-Cer any article for sale
from any stand or wagon or conveyance upon any street, or p.blic place or open
ground within the city limits shall be deemed a hawker_ and when more than one
person shall sell or assist in the sale from the same stand, wagon or conveyance
each shall be required to take out a license. Hawkers license shall be five
dollars per day, but this shall not ap ily to the sale or farm or garden products.
Section 14. Each Iderry-Go-Round operated in the city where a charge is made
shall pay a license fee or one dollar per day, except that upon holidays or circus
days such charge shall be five dollars per day. Each skating rink shall pay
an annual license fee of •;p25.00 per year. Each Cane Rack, Knife =lack or other
similar defice operated for profit and not for the benefit of any local charity
church or society, :hall pay a license fee of ir2.00 per day.
Section 15. Any Peddler or person who goes about from place to place „ithin
the city and offers for sale any goods wares or merchandise shall be required to
secure a license as herein provided. Peddlers shall be of two clas es. Those of
the first class to include any person wiao goes abort the city from place to place
an'L sells or offers to sell any goo s, wares or merchandise from any wagon, bug -y
or authmobile or other vehicle. Tho,,e of the second class to include those who
go about the city on foot and so offers goods for sale. Peddlers of the first class
shall pay a license fee of 1'�5.00 per day. Those of the second class shall ray
a license fee of 5p2.00 per day. Persons who peddle or sell farm or garden pro-
ducts which they have themselves arowa shall not be required to pay any license
fee whatever. Persons who peddle fish, fruit and vegetables only, and which
they have not themselves grcan or caught shall pay a license fee of 9`10.00 per
year.
Section 16. Public Carriers. Every person owning or operating an automobile
for hire or en -aged in the carrying of passengers therein for hire shall pay an ,
annual license fee equal to two dollars per year for each passen#er such authmobile
has the capacity to carry. !to license shall. issue to any person who has not paid
an- license fee required by the State of Washington, and the possession o' such a
license from the :;tate to carry passengers for hire shall be prima facie proof of
the fact that a person is engaged in such business.
Section 16 B. Public Carriers fdr fdre, subject to call- by the public, common-
ly known a draymen or expressmen shal- pay an annual license fee of ;;112.00 for
each auto truck or one horse or two horse vehicle cased in snch business. Teams
and trucks used exclusively in the hauling of sand, ,7-favel, rock, earch, fuel,
or building material and 'not 'doing a general dray or express business shall pay
a license fee of `12.00 -er year to be pdid by the owner of the same or the user
the re o f .
Section 16 C. All vehicles licensed to carry passengers for hire shall at
all ti ffies keep such license about said vehicle in some convenient place and the
owner or driver thereof must exhibit the same upon demand of any Police Officer
of the City. The City Clerk shall supply the licensee with a card on which shall
be printed in large type the license number and date of expiration thereof and
the licensee shall attach the same to his vehicle in some conspicuous place.
Section 17. All restaurants in the City of Pasco shall pay a license fee of
.AO.00 per annum. Any place in said city wherein meals are commonly furnished
to the public for pay and paid for by the meal, or which advertises itself as
a restaurant or cafe, or holds itself out to the puolic as such public eating
house, shall be deemed a restaurant under this section.
Section 18. Bankrupt Sales. Every person who shall conduct any sale of
merchandise, other than a public officer conducting a judicial sale, where such
mer, handice is bro ght or shipped into the City for the purpose of this sale,
or where said sale is made or conducted by persons other than the o:,mers of _'aid

of '.;aid goods, oY where the owners thereof employ either on commission or
otherwise, any agency "or the purpose of conducting said :ale other than the
regular force of clerks or employees shall pay a license fee of •2.00 per day.
Section 19. Temporary Merchants. Any person who shall bring into
the city any stock of goods, or merchandise for the purpose of opening or
conducting any temporary sale in any room, building,dtent or ether structure
and without intending to engage permanently in such business in such city
shall be required to pay a license fee of ,5.00 per day for each an(' every day
snch temporary sto-e is conducted. Provided that any person opening a business
in said city, under claim that the same -is intended to be permanent, may be
req:,.ired by the Chief of Police in lieu of the payment pfovided for in this
Section to deposit with the City Clerk a sum equal to thirty times such daily
license fee by way of bond to guarantee that said person shall remain in said
business for a period of not less than sixty days. At the end of said ,r riod
of ci::ty days if the person shalllhave remained in said business he may then
draw down such deposit and no license fee shall be charged. Otherwise such
deposit shall remain the property of the city and taken instead of the deposit
required hereunder.
Section 20. Second Hand Dealers and Junk Dealers. All persons engaged
in conducting second hand stores in the City of Pasco shall pay an annual
license fee of `10.00. All dealers in junk shall pay a license fee of y510.00
per year. Junk is hereby defined to mean lead, metals, bottles, rope, rags,
rubber, bags, bagging, sacks, plumbing, fixtures, anc: odds and ends of every
na ture in an old or second hand condition including parts of machinery, but
not including hm sehold furniture, carpets or rugs.
Section 21. No license hereunder shall be deemed to authorize the conduct
of any business except in strict accordance with law and all ordinances of the

City of Pasco regulating such business. Th Words person or pers,ns, owner
or ,owners or other equivalent expressions shall be understood to include both
singular and plural, individuals, partnerships and associations and corporations
Section 22. All ordinances or parts of ordinances requiring the payment
of any license fees to the city of Pasco, except that requiring a license
for tapping of irrigation mains, and that requiring the -ayment of a dog
license are hereby repealed.
Section 23. This o_dinance shall be in force and effect five days after
its passage and publication.

AN Ordinance granting to A. B. & H. V. Custer, herein designated as Custer
Bros., and tl,-eir successors and assirns, the right and authority and privileg=e
to u, -.e and occupy that certain propert belonging to the City of Pasco, known
and described an the plat of said City as the City Park, lying north of
Gerry's Addition and east of Sylvester's Park Addition, and imposing certain
restrictio.s on the use thereof.
BE IT ORDAINED BY THE CITY COUiJCIL 02 THE CITY OF PASCO:
Section 1. There is hereby granted to A. B. and H. V. Custer on the
terms and conditions herein set forth, the right to the free use and occupancy
o' the City Park in Pasco, Viashington, lying and being north of Gerry's
Addition and East of Sylvester's Park A-dition to said City, Said grant
shall be for the term of ten years from date of passage thereof, but reserv-
ing therefrom 1OC- feet on so,ith end of said park.
Section 2. The said Custer Bros. shall have during the term of this
grant, the right to the exclusive use o ' the said park for the purpose of
erecting and maintaining therein, dance the
or halls, refreshment
bo_ths, band stands, swimming pool and -ymnasium, with dressing rooms, and
other forms of amusement on said park grounds, and shall have the right
to do all things necessary to be clone for the proper conduct of aid amusement
features.
Section 3. T;;is -rant is made upon the followin- express conditions,
which must be complied with before any rihts shall accrue hereunder. Custer
Bros. shall procure architects plans and specifications and details of the

such a -,=oval Custer Bros. if they accept this grant shall be held to have under-
taken and agreed to build and erect in sai' city park all of said buildings and said
sprinkling system, in strict accordance with all of said plans and specifications and
details, and to have agreed to com-lete the same within the times herein mentioned.
At the expiration of the term hereo all such property and buildings shall belong
to and be the property of the City.
Section 4. Work shall be commenced on said dance hall or pavillion within
sixty days after the passage of this ordinance and the same must be completed
in strict accordance with said plans and specifications within 90 days from the
passage thereof. Work must be commenced on the installing of the sprinkling
system within 300 days after the passage hereof, and completed in accordance with
said plans within 330 days after such passage; work must be commenced on all of
the other buildings and improvements herein provided for within 300 days after
the passage hereof and all of said work and all such improvements must be completed
in accordance ith such approved plans within sixteen months after the passage
hereof.
Section 5. Custer Bros. by the acceptance of this ordinance shall be deemed
to have agreed to immediately proceed to the leveling of said park, and to have
undertaken to care for the same at their own expense, and of, all trees and the lawn
thereon, or which may hereafter be pmt thereon in first class manner, during all
the term hereof, to wit ten year:;, and to have agreed to supply any necessary labor,
seeds or plants for the beatifying of said park, and that all such work, care and
attention shall be done by them in accordance with the best practice of park
cultivation and care. Custer Bros. shall construct within sixty days two lawn
tennis courts which shall be free to the public.
Section 6. Before the said Custer Bros. shall proceed to the erection of
any buildings on the :aid_ park they must procure and file with the City Clerk a
surety bond conditioned that the said Custer Bros. shall pay all laborers or
mechanics or sub -contractors and material men and all persons who shall supply
said Custer Bros. or any person doing work hereundar with provisions or su -lies
for the carrying on of such work, and. all just debts and demands incurred in the
perdbrmance of such z,ork. Said, bond shall be in a sum not less than the entire
estimated cost of making the -aid improvements according- to said plans and spec-
ifications. Any person performing any labor or supplying any material or any
supplies, or having any just debt against the said Custer Bros. or any contractor
on said work, incurred in the performance of said work, shall have a right to
recover on ::aid. bond in the same manner and to the same extent, and the liability
of principal and surety thereon shall be the same as on a bond riven under Section
1159 of ReminF:ton an,! Ballingers Code of the State of Washington, with amendments
thereto. Said bonds shall be payable to the State of Washington, and shall be
given for the protection of all persons so sapplying labor, material, or supplies
in the making of said improvements. And said bond must be further conditioned
that the principal and surety thereon will protect the city again:t any liens
growing out of the making of such improvements.
Section 7. Nothing herein contained shall be construed so as to limit in
any way the authority of the city over the saidpark except that no other amusement
privileges shall be granted in said park during- the tern hereof.

for the trees and grass therein, or shoe Id they fail to commence or to com,.lete
any of the buildings or other improvements within the tine herein specified, or

then the City Coluicil may terminate all of their rights hereunder after giving
of 30 days notice of intention so to do. Such notice may be served on Custer

ial paper shall be deemed sufficient. In the event of the termination hereof as
in this section provided, all improvements on said park shall revert to and become
the property of the city, and be taken and 'held as in lieu of -rental on said park.
Section 9. No rights hereunder shall be sold, assigned or transferred, nor
any privileges herein granted, let or under let without the consent_ of the City
Council.
section 10. All expense of the publication hereof shall be paid by Custer
Bros. and it shall not be in force unless Custer Bros shall. within 30 days after
its passage file plans and specifications and details provided in Section 3
hereof. Upon the approval thereof by the co ,ncil said ordinance may be published
and beco�ie effective five days after its publication. Upon its publication
Custer Bros. shall be held to be bound by all the terms of this ordinance.
