Report of City Attorney and Street & Allen Committee on matter of
cutting
into
the city paving, made by City Attorney, who presented the following ordi-
nances, which were read by the Clerk, viz:
ORDINANCE No.
An ordinance relating to excavations in or under the paved portions of the
streets of Paeco, Washington.

The City Council of the City,of Pasco, Washington, do ordain as follows:
Sec. 1. That any person, firm or corporation desiring to lay any water,
gas, sewer or other pipes or do any other work beneath the surface of the pave-
ment in any of the streets of Pasco, shall before in any way disturbing such
pavement file vd th the City Entineer an application for a permit so to do, in
which application he shall describe the place where such is to be done, the
nbture and extent thereof, and an estimate of the number of square feet of
paving which he desires to remove or undermine.
;ec. 2. The City Engineer shall examine such application and determine
the probab,e cost of repairing the street and pavement after such work shall
have boen completed, and if he shall approve such application he shall require
from the applicant a cash deposit of not less than the entire estimated cost
of so repairing the street _ind pavement, together with the cost of supervising
such repairs, and in no case shall such deposit be less than....
Sec. 3. Permission to cut into or excavate under the p.vement in the
streets of Pa..co shall not be s•iven except the applicant for such permission
shall first file with the City Clerk a bond to be approved by him conditioned
as follows: That the applicant will save the city harmless from any liability
arising from or growing out of the said cutting or excavating beneath the pave-
ment and from any damage done to persons or to property by reason of such cut-
ting or excavating or by reason of any negligence on the pert of the applicant.
Such bond to be in the sum of $?. ..
Sec. 4. If the City Engineer shall approve such application and the bond
aforesaid shall hove been filed and approved the said Entineer shall issue to
the said applicant a permit which shall be in the following form, to -wit:
"Permit to Excavate under Pavement".

under and to cut the pavement at the following place............ ...
and having deposited with the city engineer the sum of�...... .. and
filed with the City Clerk a bond as required by ordinance, and said
application and bond h ving been approved, permi sion is hereby grant-
ed to out and exc^vete in said streets as follows . . . . . . . . . ..
.Such permission is granted upon the following conditions; that
the said will take all proper care to protect with lights
at night 9nd with ropes and barriers in the day time any excavation in
the streets made hereunder, will not unnecessarily obstruct traffic on
s•?ch streets, and save the city harmless from damages occassioned by
such excavat"on.

Sec. 5. Immediately upon the completion of the work for which such per-
mission was granted, the person obtaining such permission shall notify the City
Engineer, and shall proceed under the direction and supervision of the City
Engineer to replace and repair any such pavement, and shall place it in all
respects in as good condition as it was prior to the excavation and to the sat-
isfaction of the City Engineer. upon the City Engineer being satisfied with
the work of repairing such street he shall return to the person depositing the
same, the deposit specified in section two hereof, les cost of supervision of
such repair work. Should the person obtaining such permit fail or refuse to
have said street repaired as herein provided, then the city Engineer shall pro-
ceed to have the same done in the best end most economical manner according to
his judgment, and shall pay for cuch work out of such deposit. If any surplus
remain it shall then be turned over to the City Clerk and be deemed forfeited
to the City as stipulated damages.
Sec. 6. Ordinance No. 156 and all ordinances and parts of ordinances
in conflict herewith are hereby repealed.
Sec. 7. This ordinance shall be in full force and effect five days after
its passage and publication as required by law.

"AN Ordinance declaring it unlawful to cut, or excavate beneath the paved
surface of the streets of Fusco without permit rind relating to the obtaining of
such permit and making and repairing of such excavations."
The City Council of the City of Pasco, Washington, do ordain as follows:
Section 1. It shall be unlawful for any person, firm or corporation to
cut the pavement, or excavate beneath the same in any of the paved portions of
the streets of Pasco without first having obtained the permit herein provided
for and made the deposit required herein.
2. Any person,firm or corporation desiring to cut or cause to be cut of
to excavate beneath any of the paved portions of the streets of the city shall
apply for permi sion so to do, to the City Engineer, in writing. in such ap-
plication shall be set forth in square feet, the extent of such cut or excavation.
the purpose for which it is to be made, the place it is to be made and the length
of tike the work will regnire.
3. The City Engineer shall immediately investigate the application and
determine the probable cost of repairing such cut or excavation - the length of

time for doing the work and repairing the street th^t will be consumed. He sha#1

then demand of the applicant a cash deposit equal to the estimate cost of making
such rep irs with cost of supervising and inspecting the doing of such work and
the making of such repairs with ten per cent added for contingencies. In no
case shall such deposit be less than p.......
4. If such applicant shall make such deposit with the City Engineer such
Engineer shall issue to him a written permit to do the work and make the ousts and
excavations set forth therein, describing the place where the work is to be done
the time within which it is to be done, the extent and purpose of the work.
5. The City Engineer shall assume supervision of such work, provide for
the protection of the excavations with proper safe guards for traffic during
the continuance thereof, and at the conclusion of the work shall proceed to
repair the street placing it in as good condition as it was prior to the com-
mencing of such work, all of which shall be paid for out of the deposit afore-
said. Provided that the engineer may permit the party making such excavation
to :cake the said repairs, but only under the direct supervision, direction -nd
control of such engineer.
6. When the work of makins: such repairs is completed to the satisfaction
of such engineer and all costs thereof shall have been paid for out of such de-
posit, any balance remaining shall be returned to the party depositing the same.
7. Any person, firm or corporation violating any of the provisions of
this ordinance shall be fined in any sum not less than w25.00 nor more than
4?100.00.
B. Ordinance Edo. 156 and all other ordinances and parts of ordinances
in conflict herewith are hereby repealed.
9. This ordinance shall be in full force and effect from and after five
days from its passage and pub-ication as required by law.

Communication from Thomas Corkery of Spokane, in regard to certain property
which the writer claims lies in Bridge Street, in Pasco, was read by Clerk.

Contract between Pasco Reclamation Co., City of Pasco, encl Nchool District
No. 1 of Franklin County, Washington, was real to council. Said contract is
in words and figuures as follows:
CONTRACT
WHEREAS, School District 'lo. 1 of _<'ranklin County, 'Washington, his agreed to
sell and convey to the United States of America the following described property,
to -wit:
That part of °chool Block Addition to the City of Pasco, Wash-
ington, described as Lots numbers One (1), Two (2), Three (3) and
Four (4) and that part of Lot number Five (5), in said School Block
Addition, described as follows: Beginning at the Southeasterly
corner of said Lot Five (5) as the point of beginning; thence southwesterly,
along the south line of said lot, a distance of twenty (20) feet; thence
in a northwesterly direction, parallel with the west line of said lot,
q distance of one hundred and forty feet (140) to the alley in said
bloc]_; thence along the North line of said lot five, a distance of
twenty (20) feet, to the northeasterly corner of said lot; thence in
a southeasterly direction, aldnm the East line of Laid lot, a distance
of lot, a distance of one hundred and forty (140) feet, to the point of
beginning; all according to the plat of said achool Block Addition on
file in the office of the County Auditor of Franklin County, Washington,
and recorded in Book 23, at page 135, of Deed Records; said lots or
pLircels of land lying and being in Section Twenty-nine (29) Township
Nine (9) North of Ranr-e thirty (30) East of the Willamette leridian.
AND WHEREAS the said property is located in Local improvement District
No. 43,created by Ordinance Ito. 172, and by reason thereof is subject to
assessments for annual maintenance charges due thereon by reason of a g:,ant
of water right dated June 3rd, 1913, and executed by the Pasco Reclamation
Company, a corporation, to the city of Pasco, Franklin County, Washington,
pursuant to Ordinance No. 212, for the benefit of said Local improvement
Di st r is t.
AND WHEREAS A. G. Smith, has heretofore been appointed Receiver of the
said Pasco Reclamation Company, a corporation, and now is the duly appointed,
qualified and acting Receiver of said comp'ny.
AND WHEREAS it is desired that the said described property be released
and exempt from liability for said annual maintenance charges. from
NOW THEREFORE, to secure the release as aforesaid of said property
liability for said maintenance charges, fhe said SCHOOL DISTRICT No. 1 of
Franklin County, Washington, does hereby assume and agree to pay to the said
City of P,:sco, for the use of said Local Improvement District No. 43, the said
annual mainten^nce charges against said property, in an amount to which the said
property should be chargeable hal not this agreement been entered into, the said
payment thereof to be made by the said School District on or before the first
day of April of each year.
And the said City of Pasco, and the said A. G. Smith as Receiver of the
said Pasco Reclamation Company, do hereby release and exempt the above de-
scribed property from all liability for the said annual maintenance charges
which would otherwise be chargeable against the same, and do hereby accept the
agreement of the said School District to pay said charges.
It is understood and agreed between the said city of Pasco, and the said
A. G. Smith as Receiver of the said Pasco Reclamation Company that this agree-
ment shall not other%.vi:;e in any way impair or affect the said contract for said
water right.

Special committee on telephone matters reported no further action taken
since previous meeting account of rumor that local telephone plait had been sold.
Committee on Library investigation reported that they had met -with the
Library �onrd and that the Library -card had atised them that by removing the
telephone, cutting off the janitor's salary and making other retrenchments

taken in regard to Pacific Power & Light Co. controversy. Mayor granted committee
