(2) Corrective Action: Vacate the structure or portion thereof as required. Description: REPAIRS NOT COMPLETED ON THIS OCCUPIED PROPERTY. IPMC 108.1.3 (I) Violation: Allowing a structure that is in disrepair, lacks maintenance, is insanitary, vermin or rat infested, lacks ve ntilation or heat, or other essential equipment or is determined to be a hazard for any other reason by the code officia l to be occupied. Administration of Oaths Troy Hendre n , In spection Services Manager, asked that all City staff, respondents and any witnesses who had appeared to offer testimony b e fore the Board b e sworn to truthfulness. Chairperson Glatt a sked the audience if there were any objections to any Boa rd Member hearing any matter. There were n o objections . All City staff, respondents and witnesses who wi s hed to provide testimony befo re the Board we re swo rn to truthfulness. b. Hearings Scheduled C hairperson Glatt advised that the Board was now ready to proceed w ith the hearings and asked the City to begin presentati o n of the cases to be heard. 1. City of Pasco vs. Orellana, Jose, case number CEB2014-2149, for the property located at 919 W Lewis Street Troy Hendre n , Inspection Services Manager, asked Code E nforce ment Officer Rosanna John so n to r ead the case facts into the record. Ms. Johnson indicate d that th e cited violations on this property we re PMC 17.09.050 -Signage a round prope rty which pertains to or adverti ses any inactive o r c losed bu s in esses, PMC 25.75. I 1 0(1) -Fa ilure t o maintain a pl a ntin g strip with li ve vegetatio n and free of weeds and litter, PMC 25.7 8.090(7)-Weeds a nd litter throughout the parkin g lot and plant in g areas and PMC 9 .60.030(16) -Weeds in excess of twelve inch es and are dead/dry which pose a fire hazard. 01082015 CEB Minutes Page 1 of3 The prop erty was inspect ed on A ugus t 14, 201 4 for vio lations of the Pasco Municipal Code. Violations were o b served and determined to be repe at viol ation s . On August 16, 2013 a correct ion n otice was issued for fa ilure to maintain a platin g strip w ith live vegetatio n and fail ure to keep the property free of weeds. A repeat notice of c iv il violation was issued on August 20, 2014 via certified mail. The property owner was legally notified o n August 23, 2014 of t he conditio n s beli eved to be repeat v iolations of the Pasco Municipal Code. On Aug u st 26, 20 14 the pro perty owner, Mr. Ore llan a, notified the C ity that the property was being c leaned up that day and should be com pl eted by August 29, 2 014. Mr. Orellana scheduled an appearance at the September 4, 2014 hearing to di s pute the p ropo sed repeat pe na lty. M s. John so n stated th at she me t w ith Mr. Orel lana on th e mo rning of September 4 , 2014 to discu ss a ll necessary corrections. A t the time of inspection, weeds had been removed but la nd scaping ha d not been restored a s re quired . T ha t afternoon, Ms. Johnson called Mr. Orellana regarding hi s appearance for the Code Board Meeting b ut he felt he did not need t o atte nd as the weeds were removed. Staff explain ed that th e pr ope rty still was not in comp li ance and the hearin g wou ld be continued unti l October 2 , 20 14. On Septem ber 10, 20 14 the property owner informed Ms. J ohnson t hat he had met w ith the City P lanner to d iscuss t he landscap ing requirements fo r hi s bu s ines s location and that he would be sending a plan pri or to the October m e eting. On September 29, 2014 he called the Code E nfo rcement Office requesti ng t o cont in ue the hea ring a s he d idn 't have all of t he mat e rial s for th e landscaping project unti l October 20,2014. T he case was continued until th e Nove mber 6, 2 01 4 hearing. An appearance was not scheduled by the property owner for thi s hearing. Mr. Orella na called on November 6, 20 14 to request his ap pearance but it was too late to sc hedule and the case was di s mi ssed to December 4 , 2014. On Nove mber 21 , 20 14, Ms. Jo hnso n s poke to Mr. Orell ana regardin g the landscaping as some plant material had been p laced but due to the weather it did not survive. Du e to the w inter weather, Staff offered a vo luntary correction agreement which would allow the property owner unti l s pring to h ave all la ndscaping im provement s com pl eted. A copy was e ma il ed to hi m o n the same day. O n December 2, 2014 the property owner call ed stating th at the property was in complia nce as he had p lanted new bushes and install ed ne w lava rock, w hich is not permitted at commercial properties. He a s ked for more tim e to wh ich M s. Johnson to ld him t hat s he cou ld only grant fu rt her continu ation if he wo u ld s ig n a vo luntary correction agr eeme nt. M s . Jo hnson a dvised that s he wou ld inspect the property o n December 3 , 2014 prior to the hearing to in s pect the improvements that he had made. He was not wi lling t o s ig n the agreement and was n ot abl e to attend the hearin g o n December 4, 20 14. T he case was continued to J a nu a ry 8, 20 15 and an appearance was sch ed ul ed. On D ecember 18, 20 14, Ms. Johnson recei ved a phone call from Mr. Orell ana's assistant from his office requestin g the heari ng be delayed until late s pring. M s. Jo hn son advised her that she had alre ady continued the case multiple times and no further exten s ion s would be g ranted. She al so advise d hi s assistant that he coul d st i II attend th at J a nua ry hearing t o d is pute the penalty . Based on th e fi na l in s pectio n of t he pro perty completed o n January 7, 2015 , th e property is not in compli ance. The C ity of Pasco recommended to g ive the respondent a n a dditio nal ten (I 0) days to abate the v iolati o ns or pay a d a il y pe nalty of one hundred do lla rs ($1 00) per day fo r ten (I 0) days and to impose a repeat pena lty o f two hundred ($2 00) dollars. CODE BOARD DECISION: Board Membe r Gutierrez m oved, seconded by Board Member Duncan that the actions taken by the City were appropriate and timely. T he moti on carried un a nimously . Board Member Gutierrez further moved , seconded by Boa rd Member Duncan, to impose a $200 repeat pen a lty and require the property owner to s ig n a v ol u ntary correcti on agreement by January 9 , 2015 or th e property must be in co mpliance w ithin I 0 days or pay a pe na lty of $100 per day fo r l 0 days.
