D. DETERMINATION HEARINGS:
C hairperson Gottschalk explained the procedure and purpose for the meeting, noting th at the City of Pasco
was th e Petitioner and property owners a nd their authorized representatives who had appeared to discuss the
a lleged iolations of the Pasco Municipal Code were the Respondents.

Troy Hendren, In spection Services Manager, asked that all City staff, respondents and any
witnesses who had appeared to offer testimony before the Board be sworn to truthfulness.
Chairperson Gottschalk asked the audience if the re were any objections to an y Board Member
hearing a ny matter. There were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the B oard were
sworn t o truthfulness.
b. Hearings Scheduled
Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and
asked the City to begin presentation ofthe cases to be heard.
i. City of Pasco vs. Defferding, Bryan, case number CEB2014-1878, for the property
located at 3612 Lantana Drive
Troy Hendren , Inspe ction Services Manager, asked Code Enforcement Officer Rosanna Joh nson to
read the case facts into the record.
Ms. Johnson indicated that the cited violations on this property were PMC 25.75.050(5)-Fai lure to
maintain landscape and proper dust control in rear and side yards, PMC 9.60.020(3) -Basketball
hoop stored in the street and PMC 9.60.030(16)-Weeds over 12 inches ta ll and encroaching onto
neighboring properties. Violations were observed and determined to be repeat violations . A courtesy
correction notice was issued on August 21, 20 12, case number CEB20 12-3131 for weeds in excess of
12 inches on this property and encroachin g onto nei ghboring properties. This case was closed as in
compliance on January 5, 2013. A repeat notice of c ivil violation was issued o n June 25,2014. The

property owner signed for the notice at th e door of the residence and was legally notified on August
22, 2014. O n Jul y 21 , 2014, Mrs . Defferding called stating that the v i o lations h a d been correct ed . A
reinspect io n was completed o n J u ly 29, 20 14 and M rs. Defferding was noti fie d via pho ne c all that
they were in compli a nce for the weed s but not for t he dust control. S he notifi ed staff th at they have
ordered rocks to cover the rear yard which were to be del ivered s hortly. Mrs. Johnson stated t hat th e
a dvised Mrs. Defferding that th ey keep a s prinkler in the area to p re vent blo w in g du s t. The case w as
co ntinued from August hearing to the September hearin g because the c e rti fied notice o f civi l vio lation
had not been delivered in tim e. On Decembe r 2, 2014, Ms. Johnson stated that she call ed the
pro perty owners but the rocks had not arrived at that tim e and the delivery was resch e duled t o
September I 0, 2 0 14. The hearing was continued o ne more month t o the October 2, 20 14 he a r ing.
The property own e r was rem ind ed at t his time that th e property mu st be ma in tained of dus t control
and remain f ree of weeds. On November 6 , 2014, Ms. Johnson received an u pdate t hat the rocks had
b een d elivered but had not be e n placed in the yard. Mrs. D efferding exp lained t hat he r husband had
n ot had the chanc e to p lace th e rocks. M s. Johnson re min ded the property owner t hat t he case had
been o pe ned in June and that t he re would be n o more continuations and t he v iolations needed to be
corrected. An inspection of the property was completed on Decemb er 3, 20 14 and the property was
no t in compliance.

t o correct any remaining violations or pay a penalty of $100 per day for I 0 days.

CODE BOARD DEC ISION: Board Membe r Speer moved, seconded by Board M e mber G latt th at the
actio ns taken by the City wer e appropriate and tim e ly. The motio n carr ied unanim o us ly.
Board Member Speer further moved, seconded by Board Member G latt, t o impose $400 fo r a repeat
penalty t o be he ld in abeyance until March 31, 2015 , at which time if the p roperty is in compliance
th e penalty w ill be di sm issed bu t if th e pro perty is no t in compliance, the p roperty owner wi ll 10 days
to correct any remaining v iolati ons or p ay $100 per day for I 0 days in additio n to the $400 repeat
p e nalty. The motion carri ed 3 t o I with Board Member Duncan dissenting.

A RESOLUTION fmding that code violations have been corrected and may be dismissed without penalty, deferring action on certain cases pending proper notification, accepting voluntary correction agreements, and assessing penaltie!

WHEREAS, the City of Pasco has found that there exist conditions on certain properties that constitute violations of the Pasco Municipal Code; and
