HomeMy WebLinkAboutPasco Police Officers Association - 2014 MOU schedule Patrol & Non-Patrol2014 MOU for City of Pasco & PPOA — Officer Work Schedule Addendum MEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CITY OF PASCO, WASHINGTON AND THE PASCO POLICE OFFICERS' ASSOCIATION REGARDING CONTINUATION OF THE 10.67 HOUR WORK SCHEDULE FOR PATROL OFFICERS AND INITIATION OF A 10 HOUR SCHEDULE FOR NOON -PATROL O- FFICERS. This MOU is made and entered into this day of G�[.(�.y�Y-� ; 2014 by and between the City of Pasco, acting by and through its City Manager, hereinafter referred to as CITY, and the Pasco Police Officers' Association, acting by and through its governing body, the Executive Board, hereinafter referred to as PPOA, both of Franklin County, State of Washington, witnesseth: WHEREAS, the CITY and PPOA agreed to the continuation of a 10.67 hour work schedule for a period of three (3) years for police officers assigned to patrol duties; and WHEREAS, the CITY and PPOA agreed to 10 hour work schedule for non -patrol officers, with exception of the School Resources Officer (SRO), and based on assignment by the Chief or designee; and WHEREAS, the CITY and PPOA agree that the terms "police officer" or "officer" shall mean commissioned personnel subject to this MOU holding the classifications of police officer or sergeant; and WHEREAS, the CITY and PPOA believe it to be in their best interest to define the operational requirements for such work schedules; and WHEREAS, the City and PPOA agree that questions or issues regarding items, provisions, or portions thereof, not specified in the MOU shall defer to the current Collective Bargaining Agreement (CBA) between the parties for application, clarification, and resolution. NOW THEREFORE, the CITY and PPOA agree as follows: Section 1. Work Schedule and Work Cycle The purpose of this MOU is to continue a 10.67 hour work schedule for police officers assigned to patrol duties. The designated work cycle length shall be 28 days. The regular scheduled time worked (RSTW) for each officer is 15 days in each 28 day work cycle. The regular schedule time off (RSTO) for each officer is 13 days in each 28 day work cycle. Officers shall work their assigned shift following this pattern: 5 ON — 4 OFF — 5 ON — 4 OFF — 5 ON — 5 OFF. In addition, officers not assigned to patrol, or as a SRO, will be allowed to work a 10 hour schedule. The designated length of the work cycle shall be 28 days. The regular scheduled time worked RSTW for each officer is 16 days in each 28 day work cycle. ibl o 2014 MOU for City of Pasco & PPOA — Officer Work Schedule Addendum Section 2. Shift Length and Maximum Hours of Work Patrol officers shall work shifts consisting of 10.67 consecutive hours. Based on assignment by the Chief or designee, officers not assigned to patrol or as a SRO may work shifts consisting of 10 consecutive hours. Except in the event of an emergency, officers may not work more than 16 consecutive hours. Officers are scheduled to work 160 hours in each 28 day work cycle. Section 3. Patrol Shifts and Squads There shall be three patrol shifts designated as Days, Swings, and Graves to cover the 24 hours of each day. There shall be two squads designated as "A" and `B" created within each shift. (Example: Days -A, Days -B, Swing -A, Swing -B, Graves -A, and Graves -B.) Squads within each shift shall alternate work days and off days. (Example: when Days -A is working, Days -B is on days off; and when Days -A is on days off, Days -B is working). Section 4. Patrol Shift Hours The start and stop times for the three patrol shifts shall be: Days 0700 hrs to 1740 hrs Swings 1600 hrs to 0240 hrs Graves 2120 hrs to 0800 hrs The City may adjust the start and stop times based on operational needs and information developed through the comprehensive evaluation process. Shift hours for non -patrol will depend on the assignment as determined by the Chief of Police or designee. Section 5. Patrol Shift and Sauad Assignment The Captain in charge of the Field Operation Division is responsible for assignment of officers to shifts and squads, with final approval by the Chief of Police. When possible, the Captain shall attempt to balance the experience levels and skills of officers assigned to each shift and squad. Officers shall have the opportunity annually to submit a request for shift assignment, consistent with Article 25 of the Agreement. Section 6. Overtime Overtime shall be paid at one and one-half times the officer's regular rate of pay for work hours in excess of the 10.67 consecutive hours set forth in this MOU as the standard patrol work shift. For authorized non -patrol officer positions, overtime is paid at a one and one-half times the officers' regular rate of pay for the hours worked in excess the regular scheduled shift hours. Typically, this section applies when an officer is called to work early before the start of a scheduled shift or held over past the end of a scheduled shift. An officer called to work on a scheduled day 2014 MOU for City of Pasco & PPOA — Officer Work Schedule Addendum off shall be paid at the overtime rate for all hours worked. However, this provision does not include the first 11 hours of in-service training during the 28 day work cycle. Section 7. Training Time The first I 1 hours of in-service training during a 28 day work cycle which occur on an officer's scheduled time off shall be paid at the officer's straight time regular rate of pay. All training hours in excess of 11 hours during a 28 day work cycle which occur during an officer's regular scheduled time off shall be paid at the officer's overtime rate of pay. Section 8. Denartment Trainine Days. Each 28 day work cycle of the 10.67 hour patrol work schedule includes two department training days. All officers are required to either report for duty or attend training as schedule by their supervisor on department training days. Normally, the "A" Squad officers from all shifts will attend one training day and the `B" Squad officers from all shifts will attend the other training day. An exception to this provision may occur when an individual officer is unable to attend monthly training on the day designated for his or her squad and must then attend training on the alternate day. It is important that all officers attend their scheduled training day; therefore, leave use on department training days shall be limited to sick leave, pre -approved extended vacations (40 or more hours), and emergency situations. Officer shall not be allowed to use accrued comp time on Department Training Days. Section 9. Leave Time Accrual and Use Leave time accrual, accumulation, and use are based on hours not days. The rate of accrual in hours shall not change except for when it is required by the CBA based on an officer's tenure with the department. The number of bargaining unit members that may be off at any one time shall be determined by the Chief of Police or designee. Section 10. Pavroll Related Items Officers shall submit a time sheet in a manner and on a schedule prescribed by CITY payroll practices for each pay period. Such time sheet shall accurately reflect hours worked, overtime hours worked, training time, any leave time used, and regular scheduled time off during the pay period. A payroll check received for a particular pay period might be more or less than the payroll check received for another pay period due to the difference in hours worked. The number of days an officer worked during a pay period is determined by squad assignment. All "A" Squad officers will have the same number of work days in a pay period. All `B" Squad officers will have the same number of work days in a pay period. However, the number of work days for "A" Squad officer will be different than `B" Squad officers within the same pay period. Section 11. Term of Agreement This continuation Memorandum of Understanding is effective the first full pay period of January 2015 and shall conclude on November 30, 2017. Absent a further agreement to continue the 10.67 2014 MOU for City of Pasco & PPOA — Officer Work Schedule Addendum and 10 hour work schedules, the standard work schedule of officers assigned to patrol and non - patrol duties shall revert to the 8 hour work day and 5 day work week on December 1, 2017. Section 12. Alternative Work Schedules Nothing in this MOU shall be deemed to prohibit or prevent either party, CITY or PPOA, from proposing other alternative work schedules for patrol and non -patrol officers, which may be implemented by mutual agreement of the parties. Section 13. Relationship of MOU to Bargaining Agreement In the event of a conflict between this MOU and the parties' bargaining agreement, the terms and conditionals of the Agreement shall control. By entering into this MOU, the parties do not intend to create any obligations expressed or implied other than those set out herein.
