N ashington 99{01 uuw.pasco- �Na.goc October 3, 2014 Mr. Steve White Stealth Development Inc. 3710 E Man O War Dr. Nampa, ID 83686 -1314 RE: Navigator Villas (B13 -1899, B13 -1900, B13 -2058, B13 -2059, B13 -2060, 813 -2061 and B13 -1643) Letter Agreement — Reconciliation of Requirements for Certificate of Occupancy Dear Mr. White: This Letter Agreement between the City of Pasco and Steve White (Stealth Development) reconciles the remaining building permit requirements and defines the specific manner in which all of the requirements need to be satisfied in order to allow issuance of Certificates of Occupancy for the remaining Buildings 7A, 7B, 8A, 8B, 9A, 9B and In ground Pool. Beginning on March 21, 2012, a series of building permits were issued for the construction of the development known as Navigator Villas, located at the intersection of Road 68 and Powerline Road. Two of the requirements of the development were that Powerline Road would be constructed to a three - quarter roadway section along the north property frontage (this included roadway, curb & gutter, sidewalk, landscaping), as well as an Estate Block Wall (consistent with Pasco Municipal Code requirements for similar developments). During the construction of the development, Mr. White and the City agreed that construction of the segment of Powerline Road required of the development would be incorporated into the City's capital improvement project to construct Powerline Road between Broadmoor Boulevard and Road 68, and that Mr. White would contribute a mutually agreed upon dollar amount to the City's project in lieu of constructing the improvements. This agreement represents the specific conditions of satisfying the remaining requirements of the building permit as follows: • Mr. White shall deliver a private contribution to the City in the form of a Cashier's Check, in the amount of $118,500.00 that shall represent Stealth Development's share of the cost of constructing the required portion of Powerline Road. • Mr. White shall construct the Estate Block Wall along the northern property line of Navigator Villas to the standards of the City of Pasco. The City will provide Mr. White with copies of the Powerline Road project construction plans, as may be requested, in order that the wall is constructed in accordance with the development topography and the road project. es �� Mr. Steve White October 3, 2014 Page 2 Mr. White shall complete any and all other outstanding review, inspection and approval items required for completion of the project and request for certificate of occupancy. The City shall issue a Certificate of Occupancy for the remaining buildings: 7A, 7B, 8A, 8B, 9A, 96 and In- ground Pool upon satisfaction of the conditions stated above and deposit and acceptance of all cash (check) payments. In lieu of construction completion for the estate block wall, Mr. White may, at his option, post cash deposit of $25,000 in the form of a Cashiers Check, to ensure acceptable completion of the estate block wall. The City will retain this cash deposit until final approval of the wall construction and then promptly refund to Mr. White the entire amount, less any monies used to satisfactorily complete the wall construction. These conditions shall constitute the entire agreement between the parties and final acceptance of the project, Navigator Villas.
