CALL TO ORDER CODE ENFORCEMENT MINUTES MEETING OF SEPTEMBER 4, 2014 Chairperson Speer called the regular meeting of the Code Enforcement Board to order at 7:00p.m. B. ROLLCALL a. Board Members MEMBERS PRESENT Dennis Duncan Russell Glatt Dwayne Speer Mary Gutierrez C. ADOPTION OF MINUTES: MEMBERS ABSENT Daniel Gottschalk Board Member Gutierrez moved, seconded by Board Member Glatt, that the minutes of the August 7, 2014 meetings be approved as mailed. The motion carried unanimous ly. D. DETERMINATION HEARINGS: Chairperson Speer explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the a lleged violations of the Pasco Municipal Code were the Respondents. a. Administration of Oaths Troy Hendren, Inspection Services Manager, asked that all City staff, respondents and any witnesses who had appeared to offer testimony before the Board be sworn to truthfulness. Chairperson Speer as ked the audience if there were any obj ection s to any Board Member hearing any matter. There were no objections. All City staff, respondents and witnesses who wi shed to provide te stimony before the Board were sworn to truthfulness. b . Hearings Scheduled Chairperson Speer advised that the Board was now ready to proceed with the hearings and asked the City to begin pre se ntation of the cases to be heard. i. City of Pasco vs. Woods, Rigel, case number CEB2014-1901, for the property located at 612 Road 38 Troy Hendren, Ins pection Services Manager, asked Lloyd Coughlin to read the case facts into the record. Mr. Coughlin indicated that the cited violation on this property was PMC 13 .16.020(b )(c) - Failure to install and maintain an approved backflow prevention assembly. In 2013, a violation occurred when the property owner failed to complete an annual test. The violation ha s not been corrected at thi s time. A new press ure vacuum breaker was installed , however, the pressure vacuum breaker was installed but did not meet the criteria for a Washington State approved 09042014 CEB Minutes Page 1 of2 backflow assembly. What was installed was a pressure vacuum breaker that has never been is s ued through the University of Southern California Foundations for Hydraulic Research and Cross-Connection Control for an evaluation and use for that purpose. Currently that pressure vacuum breaker remains attached to the underground sprinkler system, which is connected to the City's drinking water. Because it is not an approved assembly and doesn't meet the criteria for use in Washington State, it is considered to be unapproved and cannot provide the backflow prevention that is required . The City of Pasco recommended the property owner pay $45 for a process server, $200 for the repeat penalty and be given I 0 days to correct any remaining violations or pay a penalty of $100 per day for 10 days. If unresolved after 10 days, the City will cut off the water at this property. Seneca Hollenbaugh, 612 Road 3 8, spoke on behalf of this case. CODE BOARD DECISION: Board Member Duncan moved , seconded by Board Member Gutierrez that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Duncan further moved, seconded by Board Member Gutierrez, that a penalty of $45 be paid for the use of a process server, $200 for the repeat penalty and be given 14 days to correct any remaining violations or pay a penalty of $100 per day for 10 days . The motion carried unanimou s ly. Board Member Duncan moved , seconded by Board Member Gutierrez, that the water se rvice be terminated on thi s property in 20 days if an approved backflow prevention assembly has not been installed. The motion carried unanimou sly . c. Amendments d. Di s missals i. Citv of Pasco vs. Myricks, Dupree, case number CEB2014-1524, for the property located at 2219 E. Alvina Street e. Motion Board Member Speer made a motion to approving Resolution No. 2014-009 as amended , Board Member Glatt seconded. The motion carried unanimous ly. E. STAFF REPORT AND OTHER BUSINESS: F.
