Description: Failure to renew City of Pasco residential rental license for 2013 and 2014 (REPEAT). FMC 5. 78.010
(Renewal)
(I) Violation :
Failure to renew your City of Pasco rental Jicense(s).
(2) Corrective Action:
Renew your City of Pasco rental license and pay all outstanding fees and late fees. Licenses are to be renewed annually on
the first regular business day of January, but in no case later than the last regular working day of February each year. Pl ease
call the City Clerk's office at (509) 545-3402 for fee information. IF YOU ARE OUT OF BUSINESS, YOU MUST CALL
THE CITY CLERK'S OFFICE AT THE NUMBER LISTED ABOVE.
Description: Failure to schedule rental inspection. PMC 5. 78.020
(I ) Violation :
A certifi cate of inspection is required to be submitted to the City for all rental dwelling unit(s).
(2) Corrective Action:
S ubmit a certificate of inspection for the rental dwelling unit(s) (call (509) 543-5743 to schedule a habitability inspection or
submit an approved HUD inspection report).
Description: Pallets, bed frame, wooden boxes laying in side yard. PMC 9.60.030 (10)
(I) Violation:
Trash, litter, rags, accumulations of empty barrels , b oxes, crates, packing cases, mattresses, bedding, excelsior, packing hay,
straw, or other packing material; lumber or scrap metal not neatly piled or anything which may be a fire danger.
(2) Corrective Action:
Remove and lawfully di spose of all trash, litter, and other debri s which is not neatly piled and/o r which is a fire danger.

(2) Corrective Action:
Remove the advertising copy by painting or coating out within 30 days. All sign frame s and s upports of abandoned signs
must be removed within one year of the date of abandonment or business closure.
Description: Failure to maintain planting strip with live vegetation and free of weeds and litter. PMC 25.75.110 (I)
(I) Violation:
Failin g to maintiain landscaping and/or screening free of weeds and trash and not providing, protecting, an d permanently
maintaining all landscaping material, areas and plants in a healthy, growing condition , rep lacing it when necessary.
(2) Corrective Action:
Remove and lawfully dispose of all weeds and trash and replace any dead/dying plants and other vegetation. Restore and
maintain the planting strip withlive vegetation in compliance with the provisions described above.
Description: Weeds and litter throughout parking lot and planting areas. PMC 25.78.090 (7)

Faili ng to maintain a parking lot and/or keep it free of weeds and litter.
(2) Corrective Action:
Provid e regular maintenance for the parking lot. Maintenance shall include trash and weed removal, the repair of traffic
control devices ,
signs, light standards, fences, surfacing materials, curbs, landscaping, and drainage facilities .
Description: Weeds in excess of twelve inches and dead/dry which pose afire hazard. (REPEAT) PMC 9.60.030 (16)
(1) Violation:
Weeds, noxi ous weeds, grass, and other vegetation which constitutes a fire hazard, encroaches on sidewalks or neighborin g
properties, is damaging public improvements, impairs the vision of traffic signs or signals, and/or has reached a height of
twelve in ches (12").
(2) Correcti ve Action:
Eradicate weeds by chemicals, cutting or other acceptable means so that they do not exceed twelve inches (12 "), encroach on
neighboring properties, constitute a fire hazard, etc. Weeds that are cut or removed by the root must be removed from the
property and lawfully disposed of.

Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00p.m.

Board Member Speer moved, seconded by Board Member Glatt, that the minutes of the July 10, 2014
meetings be approved as mailed. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of
Pasco was the Petitioner and property owners and their authorized representatives who had appeared to
discuss the alleged violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Troy Hendren, Inspection Services Manager, asked that all City staff, respondents and any
witnesses who had appeared to offer testimony before the Board be sworn to truthfulness.
Chairperson Gottschalk asked the audience if there were any objections to any Board Member
hearing any matter. There were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the Board were
sworn to truthfulness.
b. Hearings Scheduled
Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and
asked the City to begin presentation of the cases to be heard.
i. City of Pasco vs. Cross, Lisa, case number CEB2014-1585, for the property located at
502 S. 23rd Avenue
Troy Hendren, Inspection Services Manager, asked Rosanna Johnson to read the case facts into
the record .
Ms. John son indicated that th e cited violation on thi s property was PMC 25.69.040(1) -
Recreational vehicle parked in side yard appears to be occupied on an overnight basis as a
permanent residence , PMC 25.78.030(4) -Parking vehicle on an unapproved surface in the
front yard and PMC 9.60.030(6)-Miscellan eous debris stored in public view on the porch and
front ya rd , which also po se a fire hazard . The property was inspected on April 25, 2014 for

violations of the Pasco Municipal Code. Violations were observed and a correction notice was
iss ued . A re-in spection of the property revealed that it was still in violation of the Pasco
Municipal Code and a notice of civil violation was issued on May 19, 2014 via certified mail.
The certified notice was returned as unclaimed a re-issued on June 23, 2014 via process server.
The property owner was legally notified on June 24, 2014 of the conditions believed to be a
violation of the Pasco Municipal Code. Based on a final inspection of the property completed
o n August 7, 2014 the property is not in compliance at thi s time.
The City of Pasco recommended a penalty of $45 to reimburse the C ity for the cost of personal
service of the notice and be given 10 days to correct any remaining violations or pay a penalty
of $50 per day for 10 days.
Lisa Cross, 502 S. 23'd Avenue, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Glatt moved, seconded by Board Member Speer
that the actions taken by the City were appropriate and timely. The motion carried
unanimous ly .
Board Member Speer further moved, seconded by Board Member Glatt, that a penalty of $45
impo se d to reimburse the City and be given 20 days to correct any remaining violations or pay
a penalty of$50 per day for 10 days. The motion carried unanimously.
u . City of Pasco vs. Perez, Antonio, case number CEB201 4-1619, for the property
located at 804 S. gth Avenue
Troy Hendren, Inspection Services Manager, asked Lloyd Coughlin to read the case facts into
the record .
Mr. Coughlin indicated that the cited violation on this property was PMC 13.16.020(b)(c)-
Failure to perform an annual backflow prevention assembly test. This is a repeat violation.
Notification was mailed to the property as well as the property owner. The Cross-Connection
Specialist, Jake Hickman, spoke to the property owner regarding the repeat violation. Mr.
Hickman was told that Mr. Perez does not pick up his mail regularly which is why this got
overlooked. Mr. Co ughlin discussed some difficulties due to different addresses listed for the
property owner. Based on a fin al in spection the property is in compliance at thi s time .
T he C ity of Pasco recommended a repeat penalty of$200 be imposed.
Tranita Perez, 4206 Road 105 , spoke on behal f of this case.
CODE BOARD DECISION: Board Member Speer moved , seconded by Board Member G latt
that the actions taken by the C ity were appropriate and timely. The motion carried
unanimous ly.
Board Member Speer further moved, seconded by Board Member Glatt, that a repeat penalty of
$200 be imposed but held in abeyance for 12 months and dismissed if no further violations are
documented in that time. The motion carried un animously.
iii. City of Pasco vs. Sanders, Kent & Rachael, case number CEB2014-1653, for the
property located at 9520 Welsh Drive

the record.
M s. Johnson indicated that the cited violation on this property was PMC 1 0.52.030(2) -Semi-
truck/trailer parked in a residential zone, PMC 5.04.020 -Operating a home occupation without
obtaining a City of Pasco bus iness licen se, PMC 5.78.020 -Failure to schedule rental
in s pection and PMC 9 .60 .030(1 0)-Pall et s, bed frame, wooden boxes laying in side yard . The
property was ins pected on May 21, 2014 for violations to the Pasco Municipal Code.
Violations were observed and determined to be a repeat violation. A notice of civil violation
was iss ued on June 30, 2012 , case number CEB2012-2858 for failure to renew the rental
li cense. The license was renewed on August 8, 2012 and the case was closed without penalty.
Again a notice of civil violation was issued on May 28, 2 014 via certified mail. The property
owners were legally notified on May 31, 2014. Based on a final in s pection of the property
completed on August 6, 2014 the property is not in compliance at this time as Big Team
Delivery LLC is not licen sed to operate a bu si ness in the City of Pasco or at this re sidence.
The C ity of Pasco recommend e d a repeat penalty of $200 be imposed an d be given 1 0 days to
correct the remaining violation and license their business or pay a penalty of $50 per day for 10
day s.
Thi s case was moved to the September 4 , 2014 meeting s ince Board Member Speer r ecu sed
himself from this cas e.
iv. City of Pasco vs. Mendoza, Aurora, case number CEB2014-1965, for the property
located at 8222 W. Ruby Street
Troy Hendren, Ins pection Services Manager, asked Rosanna Johnson t o read the case facts into
the re cord .
M s. J ohn son indi cated that th e cited violation on this pro perty was PMC 8.02.190 -Failure to
li cense a dog on s ite . The property owner did not renew their dog li c ense on or before M arch 1,
2 01 4 and was found to be a second offense of the Pasco Municipal Code. A correction noti ce
was sent on March 26 , 201 2, case number CEB2 012-0894 to license a dog on s ite . A first
offense notice was sent on November 10 , 2013, case number CEB20 13 -3 266 to licen se the dog
on s ite . Staff was n otified on Novemb er 20, 2 013 that the dogs were given away and the case
was c losed without pe nalty. A second offense notice was iss ue d o n Jul y 17, 2 014 v ia certified
mail. The property owner was lega lly notified on July 2 1, 20 14. Based on a final in s pection
completed on July 23, 2014 the property is in compliance at this time.
The C ity of Pasco r ecomme nd ed a penalty of $100 be imposed for a second offense penalty.
