PURPOSE: To provide a safe and violence-free working environment for the employees of the City of Pasco. II. DEPARTMENTS AFFECTED: All III. REFERENCES: 9.41 RCW, 9A.16 RCW IV. DEFINITIONS: A. Weapon means: 1. Any firearm, rifle or handgun, whether or not such person has a license or permit to carry such firearm, and whether or not such firearm is concealed. 2. Any knife, sword, dagger, or other cutting or stabbing instrument, with a blade of a length of three inches or more, or any razor with an unguarded blade, whether or not such weapon or instrument is concealed. 3. Any instrument or weapon of the kind usually known as a slingshot, Taser, throwing star, bow, sand club, blackjack, metal knuckles, or any stick, chain, metal pipe, bar, club or combination thereof including a device thrown as numchuk sticks, or any device having the same or similar components or parts, whether or not connected by a rope, chain or other device, or any explosive or poison or injurious gas (excluding those normally used in the course of one's employment duty), or any other instrument capable of producing bodily harm, whether or not such instrument or weapon is concealed. B. Carrying means: Carrying, exhibiting, displaying or drawing any weapon apparently capable of producing bodily harm, in a manner, under circumstances, and at the time and place that either manifests an intent to intimidate another or that would lead a reasonable person to be concerned for the safety of another person or persons. C. Carrying does not include: 1. Legal possession of a firearm and said firearm is secured within an attended personal vehicle concealed from view or concealed from view within a locked unattended personal vehicle. 2. Possession of any tool or device, which could fall under the definition of a "weapon," but is issued by the City and used in the normal course of work, and is not displayed or brandished in a manner so as to threaten or intimidate another person. 3. Possession of a personal knife or other tool, which could fall under the definition of a "weapon," but is used in the normal course of work, as authorized by the Department Director, and is not displayed or brandished in a manner so as to threaten or intimidate another person. D. City Property means: All areas within the ownership and/or control of the City, and includes offices, buildings, parking lots, vehicles, desks, cabinets, lockers, or storage areas. V. POLICY: It is the policy of the City of Pasco to prohibit all employees, while on City property or time, or while performing City business, from carrying weapons. VI. EXCEPTIONS: This policy shall not apply to or affect the following: A. Any person who is vested by law with a duty to preserve public safety, maintain public order, or to make arrests for offenses, while in the performance of such duty. B. Any person making or assisting in making a lawful arrest for the commission of a felony. C. Any person lawfully engaged in military activities. D. Any person in possession of a tool which could fall under the definition of a "weapon," who employs such tool as reasonably necessary for self - defense purposes, consistent with RCW 9A.16.010 and .020. Any employee violating this policy may be subject to disciplinary action, up to and including termination.
