Chairperson Speer called the regular meeting of the Code Enforcement Board to order at 7:00 p.m.

Board Member Duncan moved, seconded by Board Member Gutierrez, that the minutes of the June 5,
2014 meetings be approved as mailed. The motion carried unanimously,
D. DETERMINATION HEARINGS:
Chairperson Speer explained the procedure and purpose for the meeting, noting that the City of Pasco
was the Petitioner and property owners and their authorized representatives who had appeared, to discuss
the alleged violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Rick White, Corrununity & Economic Development Director, asked that all City staff,
respondents and any witnesses who had appeared to offer testimony before the Board be sworn to
truthfulness. Chairperson Speer asked the audience: if there were any obMjections to any Board
Member hearing any matter. There were no objections,.

Chairperson Speer advised that the Board was now ready to proceed with the hearings and asked
the City to begin presentation of the cases to be heard.
L City of Pasco vs. Frenette, Don and Sbaron, case number CEB2013-0371, for the
property located at 8,013 W. Margaret Street
Rick White, Community & Economic Development Director, asked Mai-tin Barajas to read the
case facts into the record.
Mr. Barajas indicated that the cited violation on this property was PMC 12,1.2.047(A) —
Planting strip landscape has been covered with wood chips. The property was inspected on.
March 16, 2013 for violations of the Pasco Municipal Code. A correction notice was issued on
March 16, 2011 A re-inspection of the property revealed that it was still in violation of the
Pasco Municipal Code and a notice of civil violation was issued on June 13, 2013. The

property owner was legally notified on July 20, 2013 via process server of the conditions
believed to be in violation of the Pasco Municipal Code, Based on final inspection of the
property completed on June 4, 2014 the property is not in compliance of the Pasco, Municipal
Code at this time.
The City of Pasco recommended a penalty of$45 be imposed to reimburse the City tbr the cost
of"personal service of the notice and be given 30 days to correct the violation or pay as penalty
of$50 per day for ten(10)days.
Don Frenette, 803 W.Margaret Street, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member
Gutierrez that the actions taken by the City were appropriate and timely, The motion carried
unanimously.
Board Member Duncan further moved, seconded by Board Member Glatt, that the respondent
pay $45 immediate penalty to repay the City the cost of personal service of the notice and
impose a $50 penalty to be deferred for 90 days and be given 30 days to work out as plan with
the City. The motion carried unanimously.

Rick White, Community & Economic Development Director, asked Martin Barajas to read the
case facts into the record.
Mr. Barajas indicated that the cited violation on this property was PMC 13.02,190 — Failure to
renew dog license. The property was inspected on March 1, 2014 for violation of the Pasco
Municipal Code. A violation was observed and determined to be a second offense. A previous
notice was sent on April 30, 2013, case number CEB2013-0561 for failure to renew a dog
license. A second notice of civil violation was issued on April 18, 2014, The property owner
was legally notified on May 21, 2014 of the conditions believed tea be a second offense
violation of the Pasco Municipal (,,ode. Based on a final inspection of the property on May 29,
2014 the property is in compliance and the license has been renewed.
The City of Pasco recommended penalty of$100 be imposed for a second offense.
Tate Andrews, 1904 N. Road 35, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Glatt moved, seconded by Board Member Duncan

Mr. Barajas indicated that the cited violation on this property was PMC 8.02,190 Failure to
renew dog license, The property was inspected on March 1, 2014 for violations of the Pasco
Municipal Code. Violations were observed and determined to be a second offense. A previous
notice was sent on June 1, 2012 in case CEB2012-2435 for failure to license a dog found on the
property. A second notice of civil Violation was issued on April 18, 2014 via certified mail.
The property owners were legally notified on April 22, 2014 of the conditions believed to be a
second offense. Based on a final inspection of the property completed on April 22, 2014 the
property is in compliance and all three dog licenses were renewed,
The City of Pasco recommended a repeat penalty of$100 be imposed for a second offense.
Patrick and Joy Dunyon, 1911 N, 13"'Avenue, spoke on behalf of this case.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member Glatt
that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Glatt further moved, seconded by Board Member Duncan, that a repeat penalty
of$100 be imposed but held in abeyance for 12 months and dismissed if no further violations
are documented hi that time. The motion carried unanimously,
iv. City of Pasco vs. Ponce, Frances, case number CEB2014-0958,....for the roper(y
located at 3071 . Wehe Avenue
Rick White, Community & Economic Development Director, asked Debbie Scott to read the
case facts into the record.
Ms, Scott indicated that the cited violation on this property was PMC 8.02.190 — Failure to
renew dog license. The dog license for this property was not renewed for 2014 and was
determined to be second offense violation of the Pasco Municipal Code, A previous correction
notice was sent on April 20, 2012 for case number CEB2012-1885. The dog was license on
May 4, 2012 and the case was closed, On May 5, 2013 a first offense notice was sent for case
number CEB2013-0683 for failure to renew the dog license. The dog was licensed on May 22,
2013 and the case was closed without penalty, A second offense notice of"civil violation was
issued on April 18, 2014 via certified mail. The property owners were legally notified on April
19, 2014 of the conditions believed to be a second offense violation of the Pasco Municipal
Code. Based on the final inspection completed on June 4, 2014 the properly is in compliance at
this time.
The City of Pasco recommended a penalty of$100 be imposed for a second offense.
Adam and Frances Ponce, 307 N. Wehe Avenue, spoke on behalf of this case.

Board Member Glatt further moved, seconded by Board Member Gutierrez, that a repeat
penalty of $100 be imposed but held in abeyance for .12 months and dismissed if no further
violations are documented in that time, The motion carried unanimously.
V. Cill of Pasco vs. Twitty, Tyler, case number CEB20,14-0973, for the pro pert located

Rick White, Community & Economic Development Director, asked Debbie Scott to read the
case facts into the record,
Ms. Scott indicated that the cited violation on this property was PMC 8.01190 — Failure to
renew dog license. On March 1, 2014 the license for two dogs at this property were not
renewed for the year of 2014 and determined to be a third offense violation of the Pasco
Municipal Code. A correction notice was sent on May 28, 2011 for case number CEB201 I-
1866, This case was closed on March 17, 2012., On June 1, 2012 a first offense notice, case
number CEB20 t 2-2460 was sent for failure to license the two dogs on site. Both dogs were
licensed and the case was closed, On May 19, 2013 a second offense notice, case number
CEB2013-0709 was sent for failure to renew the licenses of the two dogs on site. This case
was sent to the C,ode Board on July 11, 2013 and was assessed a $100 penalty and the two dogs
were licensed on August 16, 2013, A third offense notice of civil violation was issued on April
21, 2014 via certified mail. The property owners were legally notified on May 22, 2014 of the
conditions believed to be third offense violations of the Pasco Municipal Code. Based on a
final inspection completed on June 4, 2014 the property is in compliance at this time and two
dogs were licensed on May 23, 2014.
The City of Pasco recommended a penalty of$200 be imposed for a third offense penalty.
Tyler-Twitty, 328 N. Beech Avenue, spoke on behalf of this case,

case facts into the record.
Mr. Barajas indicated that the cited violation on this property was PMC &02,190 — Failure to
renew dog license. The property was inspected on March 1, 2014 for violations of the Pasco
Municipal Code and a violation was observed and determined to be a second offense violation.
A previous notice was sent on April 14, 2011, case number Cl.`B2011-0601 for failure to
license a dog found on the property. A second offense of civil violation was issued on May 8,

2014 via certified mail,. The property owners were legally notified on May 10, 2014 of the
conditions believed to be a second offense violation. Based on a final inspection of the
property completed on May 16, 2014 the property is in compliance at this time.

the proj2erty located at 5107 Robert Wayne Drive
Rick White, Community & Economic Development Director, asked Rosanna Johnson to read
the case facts into tire record.
Ms. Johnson indicated that the cited violation on this property was PMC 8.02.190 Failure to
renew dog license oil or before March 1, 2014 which was found to be a second offense
violation of the Pasco Municipal Code. A previous notice was sent on March 26, 2012, case
number CEB2012-0607 which was a correction notice to license a dog on site. 'rhe case was
closed on May 19, 2012. Another notice was sent on November- 8, 2013, case number
(713132013-3157 for a first offense notice of civil violation. The dog was licensed on November
22, 2013 and the case: was closed without penalty. A second offense notice of civil violation
was issued on May 6, 2014 via certified mail. The property owners were legally notified on
May 10, 2014 of the conditions believed to second offense violations of the Pasco Municipal
Code, Based oil final inspection reviewed on.rune 5, 2014 the property is in compliance.
The City of Pasco recommended a penalty of$100 for a Second offense.

the case facts into the record.
Ms. Johnson indicated that the cited violation on this property was P 8.02.190 —Failure to
license a dog. The property owner did not renew their dog license on or before March 1, 2.014
which was found to be a second offense violation of the Pasco Municipal Code. A previous
notice was sent on March 23, 2012, case number CEB2012-0,680 which was a correction notice
to license the dogs on site. The case was closed on May 19, 2012, Another notice was sent on
November 9, 2013 for case number CEB2013-3177 which was a first offense notice of civil
violation. The dogs were licensed on December 2, 2013 and the case was closed without
penalty. A second offense notice of civil violation was issued on May 7, 2014 via certified
mail. The property owners were legally notified on May 9, 2014 of the conditions believed to
be second offense violation,,, Of the Pasco Municipal Code, Based on a final inspection
completed on May 9, 2014 the property is in compliance at this time,
The City of Pasco recommended a penalty of$100 be imposed for a second offense.

The resolution shows all the Code Enforcement Board actions and cases
that the Board has ruled on at their monthly hearing,
(2) Status Report Code Enforcement Inspections, Mgy2.014
This report lists all inspections performed by individual staff for the
month. To be counted as an "inspection" a. written "correction notice"
must have been issued as a result of the initial inspection.
(3) Pasco Rental License Program: . January-December 2014
This report tracks progress in the annual licensing of rental units.
As license applications and non-rental certifications are received, these
units are deleted from the figure of our original estimate of the total
number of rental units.
