Description: CONTAINERS REMOVED PMC 16 04.010
(1) Violation:
Failure to secure a City of Pasco building permit.
(2) Corrective Action:
Discontinue all construction activities and submit an application for a building permit from the City of Pasco (please
call (509) 543 -5726 for information on permit requirements). If no permit can be obtained, storage containers must be
removed.
Description: COMERCIAL STORAGE IN R -2 ZONE. PMC 25.34.020
(1) Violation:
Unpermitted use of a property in a R -2 Zone.
(2) Corrective Action:
The following uses are permitted: single - family dwellings, new factory assembled homes, two - family dwellings and
multiple dwellings.
Discontinue ALL upermitted uses on this property.
Description: OPERATING A BUSINESS W/O A LICENSE (Commerical Storage) PMC 5.04.020
(1) Violation:
Engaging in business within the City of Pasco without a required City of Pasco business license.
(2) Corrective Action:
Apply for a City of Pasco business license. Discontinue ALL business activities until such time as a business license
can-be obtained. Please call the City Clerk's office at (509) 545 -3402 for information on licensing requirements or
view requirements online at http: / /www.pasco- wa.gov /LicensePermits.

of Pasco building permits for the construction and modifications. PMC 16 04.010
(1) Violation:

Construction completed without securing a City of Pasco building permit.
(2) Corrective Action:
Discontinue all construction activities and submit an application for a building permit from the City of Pasco to remove
ALL the unpermitted improvements and restore the home to a single family dwelling (please call (509) 543 -5726 for
information on permit requirements).
Description: Single family dwelling illegally converted into a four Alex apartment complex. PMC 25.34.050
(1) Violation:
Unpermitted construction does not meet the development standards.
(2) Corrective Action:
Secure a building permit to restore the dwelling to its original condition. Contact the City Planner's office (509)
545 -3441 with development standard questions for an R -2 Medium Density Residential District.
Description. Renting a single family home that has been converted into a four -unit apartment complex. PMC
5.78.010
(1) Violation:
A City of Pasco rental license is required for all rental dwelling unit(s).
(2) Corrective Action:
Discontinue all use and occupancy of this property. Lawfully remove all tenants from the property, providing relocation
assistance if required by the law.

CODE ENFORCEMENT MINUTES
MEETING OF MARCH 6, 2014
A. CALL TO ORDER
Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00 p.m.
B. ROLL CALL

C. ADOPTION OF MINUTES:
Board Member Duncan moved, seconded by Board Member Gutierrez, that the minutes of the February
6, 2014 meeting be approved as mailed. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of
Pasco was the Petitioner and property owners and their authorized representatives who had appeared to
discuss the alleged violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Rick White, Community & Economic Development Director, asked that all City staff,
respondents and any witnesses who had appeared to offer testimony before the Board be sworn to
truthfulness. Chairperson Gottschalk asked the audience if there were any objections to any
Board Member hearing any matter. There were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the Board were
sworn to truthfulness.
b. Hearings Scheduled
Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and
asked the City to begin presentation of the cases to be heard.
City of Pasco vs. Talley, Geraldine, case number CEB2013 -3494, for the property
located at 1535 W. Jay Street
Rick White, Community & Economic Development Director, asked Debra Scott to read the
case facts into the record.
Ms. Scott indicated that the cited violations on this property were PMC 25.78.030 (4) —
Vehicles parked in the rear of this property on an unapproved surface, PMC 9.60.030 (I6) —
Weeds and large piles of yard waste and PMC 9.60.030 (6) — Trash, litter and debris located on
this property. Violations were observed and were determined to be repeat violations.

A previous notice was sent on October 4, 2012, case number CEB2012 -3421, for vehicles
parked on unapproved surface, large pile of yard debris, household furniture and miscellaneous
debris in public view and junk vehicle storage. The property was marginally in compliance on
December 23, 2012. A repeat notice of civil violation was issued on November 27, 2013 via
certified mail. The property owner was legally notified on November 29, 2013 of the
conditions believed to be repeat violations of the Pasco Municipal Code. Based on the final
inspection of the property completed on March 6, 2014, it is believed that the property is in
compliance at this time.
The City of Pasco recommended a repeat penalty of $200 be imposed but to be held in
abeyance for a period of 12 months and dismissed if no further violations are documented in
that time.
Jason Martin, 1535 W. Jay Street, spoke on behalf of this case for his mother.
CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member
Cooper that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Duncan further moved, seconded by Board Member Speer, that a repeat penalty
of $200 be imposed but held in abeyance for 12 months and dismissed if no further violations
are documented in that time. The motion carried unanimously.
ii. City of Pasco vs. Roberts, Kelly, case number CEB2014 -0084, for the property located
at 126 N. Owen Avenue
Rick White, Community & Economic Development Director, asked Debra Scott to read the
case facts into the record.
Ms. Scott indicated that the cited violations on this property were PMC 25.28.030 (5) — Nine
dogs on site in an R -I Zone and PMC 8.02.190 — Failure to license three dogs on site, one dog
license in 2013 but has expired for 2014. Violations were observed and were determined to be
repeat violations.
A previous notice was sent on July 1, 2013, case number CEB2013 -2789, for PMC 25.28.030
(5), more than three dogs on this property and PMC 8.02.190, failure to license excess dogs at
this location. The repeat notice of civil violation was issued on February 3, 2014 via certified
mail. The property owner was legally notified on February 6, 2014 of the conditions believed
to be repeat violations of the Pasco Municipal Code. Based on a final inspection of the
property and verification of license completed on March 5, 2014, it is believed that the property
is in compliance at this time.
The City of Pasco recommended a repeat penalty of $200 be imposed but to be held in
abeyance for a period of 12 months and dismissed if no further violations are documented in
that time.

CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member
Cooper that the actions taken by the City were appropriate and timely. The motion carried
unanimously.
Board Member Duncan further moved, seconded by Board Member Speer, that the case be held
in abeyance until the next regular meeting in April at which time the property owner can come
forward to prove the excess dogs do not belong to the property owner and to license the dogs
that do belong to the property owner. The motion carried unanimously.

Board Member Speer made a motion to approving Resolution No. 2014 -003, Board Member Duncan
seconded. The motion carried unanimously.
E. STAFF REPORT AND OTHER BUSINESS:
Rick White, Community & Economic Development Director, introduced Rosanna Johnson, as the new
Code Enforcement Officer. Mr. White added that Mr. Mitch Nickolds has taken a position with the Citv
of Tukwila and that the Inspection Services Manager position has been posted until March 17, 2014. He
will keep the board posted on the status of that position. Interviews will also be taking place for a fourth
Code Enforcement Officer.
F. ADJOURNMENT
There being no further business before the Pasco Code Enforcement Board, the meeting was adjourned by
Chairperson Gottschalk at 7:28 p.m.

Reports for the Month of March, 2014
Please find attached copies of the Code Enforcement Activity Reports for the month
of March:
(1) CEB Resolution, March 6, 2014
The resolution shows all the Code Enforcement Board actions and cases
that the Board has ruled on at their monthly hearing.
(2) Status Report Code Enforcement Inspections, March, 2014
This report lists all inspections performed by individual staff for the month.
To be counted as an "inspection" a written "correction notice" must have
been issued as a result of the initial inspection.
(3) Code Enforcement Compliance Actions /Rental Inspections /Certifications
2013 -2014
This report lists the total number of residential rental dwellings, by district
(No. 1 -8), requiring inspection certification over the two year period noted.
Each rental unit inspected and certified as in compliance with minimum
habitability standards is marked "passed ". Those that do not pass the initial
inspection or require substantial repair are marked "failed ".
(4) Pasco Rental License Program: January- December 2014
This report tracks progress in the annual licensing of rental units. As of
April 1, 2014, we estimated that there are 6,357 rental units in the City.
As license applications and non - rental certifications are received, these
units are deleted from the figure of our original estimate of the total number
of rental units.
