AN ORDINANCE OF THE CITY OF PASCO RELATING TO THE
REGULATION OF FIRE AND POLICE ALARMS AND PROVIDING
PENALTIES, AND ADDING A NEW SECTION, CHAPTER 9,74
TO THE PASCO MUNICIPAL CODE ENTITLED "ALARM SYSTEMS"
THE CITY COUNCIL OF THE CITY OF PASCO DOES ORDAIN AS FOLLOWS:
Section 1: A new Chapter 9.74 shall be added to the Pasco
Municipal Code and shall be entitled as follows:
"9.74 Alarm Systems."
Section 2: A new section 9.74.010 shall be added to the Pasco
Municipal Code and shall provide as follows:
"9.74.010. It is unlawful for any person, business
or legal entity having or conducting a private alarm
system for fire, theft, burglary or other protection
to have three (3) or more false alarms within a
ninety (90) day period. The owner of any residence,
business or premises in which said alarm system
exists shall pay a Twenty -five and no /100 ($25.00)
false alarm fee for the third and each subsequent
false alarm in a ninety (90) day period."
Section 3: A new section 9.74.020 shall be added to the Pasco
Municipal Code and shall provide as follows:
"9.74.020. False Alarm. For the purposes of this
chapter, the term "false alarm" means the activiation
of a burglary and /or robbery or fire alarm by other
than a forced entry or attempted forced entry to the
premises, or a fire and at a time when no burglary
or robbery is being committed or attempted on the
premises, or when no fire exists on the premises."
Section 4: A new section 9.74.030 shall be added to the Pasco
Municipal Code and shall provide as follows:
"9.74.030. Penalty. The police department and /or fire
department shall notify the party responsible for
paying the fee and if said fee is not paid to the City
Clerk within ten (10) days a Summons and Complaint shall
be executed by the police or fire officer and the
responsible party shall thereby be brought within the
jurisdiction of the Municipal Court."
Section 5:
This Ordinance
shall be in
full force
and
effect
its passage and
publication
as required
by
law,
