HomeMy WebLinkAbout3486 ResolutionRESOLUTION NO. 34 Y A RESOLUTION ACCEPTING THE PLANNING COMMISSION'S RECOMMENDATION AND APPROVING A SPECIAL PERMIT FOR THE LOCATION OF A CELLULAR TOWER AT 6600 BURDEN BOULEVARD. WHEREAS, AT &T, submitted an application for the location of cellular antenna tower at 6600 Burden Boulevard (Tax Parcel 117- 380 -022); and, WHEREAS, the Planning Commission held a public hearing on May 16, 2013 to review the proposed cellular tower; and, WHEREAS, following deliberations on June 20, 2013 the Planning Commission recommended approval of a Special Permit for the proposed cellular tower with certain conditions; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO: 1. That a Special Permit is hereby granted to AT &T for the location of cellular tower in a C -1 (Retail Business) District under Master File # SP2013 -009 with the following conditions: a) The special permit shall apply to Parcel # 117- 380 -022; b) The property shall be developed in substantial conformity with the site plan and elevations submitted with the application; C) The cellular antenna tower shall not exceed 120 feet in height; d) The cellular antenna tower shall be designed to resemble a flag pole and shall continuously display a flag kept in good condition and appearance and mounted to be lower than the U.S. flag on the adjacent cellular tower; e) The cellular antenna tower shall be painted to match the color of existing flag pole cellular antenna tower which shares an equipment enclosure with the proposed tower; f) The cellular equipment shall be located within a sight obscuring enclosure; g) The wireless communication antenna shall not be used for advertising or other non - communication purposes; h) A Determination of No Hazard to Air Navigation from the FAA for the tower must be submitted to the Planning Department prior to location of the tower; and i) The proposed cellular facility must comply with all FCC regulations regarding radio frequency emissions.
