(2) Corrective Action:
Restore/replace all vegetation in planting strips /swales to alive and healthy condition. Maintain planting strips and swales in
this manner at all times.

(1) Violation:
Any unsightly building, billboard, fence, excavation, or other structure, or any abandoned or partially destroyed building,

(2) Corrective Action:
Make necessary repairs to building(s), billboard(s), fence(s) and/or other dilapidated structures, complete structure or
excavation or demolish and lawfully remove structure(s) from the property.

Discontinue ALL construction activities on this property. Remove the unpermitted patio cover in its entirety.

Description: Dry weeds over 12 inches tall along the fence and sidewalk. PMC 9.60.030 (16)
(1) Violation:
Weeds, noxious weeds, grass, and other vegetation which constitutes a fire hazard, encroaches on sidewalks or neighboring
properties, is damaging public improvements, impairs the vision of traffic signs or signals, and/or has reached a height of
twelve inches (12 ").
(2) Corrective Action:
Eradicate weeds by chemicals, cutting or other acceptable means so that they do not exceed twelve inches (12 "), encroach on
neighboring properties, constitute afire hazard, etc. Weeds that are cut or removed by the root must be removed from the
property and lawfully disposed of.

MEETING OF MAY 29 2013
A. CALL TO ORDER
Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00 p.m.

C. ADOPTION OF MINUTES:
Board Member Speer moved, seconded by Board Member Duncan, that the minutes of the April 11,
2013 meeting be approved as mailed. The motion carried unanimously.
D. DETERMINATION HEARINGS:
Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of
Pasco was the Petitioner and property owners and their authorized representatives who had appeared to
discuss the alleged violations of the Pasco Municipal Code were the Respondents.
a. Administration of Oaths
Mitch Nickolds, Inspection Services Manager, asked that all City staff, respondents and any
witnesses who had appeared to offer testimony before the Board be sworn to truthfulness.
Chairperson Gottschalk asked the audience if there were any objections to any Board Member
hearing any matter. There were no objections.
All City staff, respondents and witnesses who wished to provide testimony before the Board were
sworn to truthfulness.

Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and
asked the City to begin presentation of the cases to be heard.

Mr. Nickolds called Debbie Scott, Code Enforcement Officer, to read the case facts into the
record.
Ms. Scott indicated that the cited violations
on this
property
were Pasco Municipal Code
(PMC) 6.04.010 — Failure to maintain garbage
service.
The status
has been corrected.

Ms. Scott stated that the property was inspected on February 5, 2013. Violations were observed
and it was determined to be a repeat violation. A previous notice was sent on November 17,
2011 for a sited violation of failure to maintain garbage service and the violation was corrected.
A repeat notice of served violation was issued on February 15, 2013 via processed server. The
property owners were legally notified on March 22, 2013 of the conditions which are repeat
violations of the PMC. Based on final inspection of the property completed on May 1, 2013 the
property is in compliance at this time.
The City recommended that Mirna Aguayo shall pay $35 to reimburse the City for the cost of
personal service of the notice, pay $200 for the repeat penalty to be held in abeyance for one
year and dismissed if no further violations of the same or similar occur within that time frame.
Javier Rodriquez, 1427 N. 4 °i Avenue, spoke on behalf of this property and explained the
circumstances leading to the lack of garbage service.
CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member
Cooper, that violation of the PMC had occurred and were shown by a preponderance of the
evidence. The motion carried unanimously.
Board Member Speer further moved, seconded by Board Member Duncan, and assessed a $45
service fee to be paid immediately and a $50 penalty be imposed on this property but held in
abeyance for one year and dismissed if no further violations of the same or similar occur within
that time frame. The motion carried unanimously.

ii. City of Pasco vs. AHO Construction Inc., case number CE132013 -1630 for the property
located at 4315 Phoenix Lane
This case was scheduled to appear but was unable. AHO Construction did abate the problem
and the recommendations were modified to impose a $200 repeat violation penalty but held
in abeyance for one year and dismissed if no further violations of the same or similar occur
within that time frame.
iii. City of Pasco vs. AHO Construction Inc., case number CE132013 -1631 for the property
located at 4111 Phoenix Lane
This case was scheduled to appear but was unable. AHO Construction did abate the problem
and the recommendations were modified to impose a $200 repeat violation penalty but held
in abeyance for one year and dismissed if no further violations of the same or similar occur
within that time frame.

located at 4220 Phoenix Lane
This case was scheduled to appear but was unable. AHO Construction did abate the problem

Board Member Speer made a motion to approving Resolution No. 2013 -005 as amended, Board
Member Duncan seconded. The motion carried unanimously.
E. STAFF REPORT AND OTHER BUSINESS:
Mitch Nickolds, Inspection Services Manager, advised the Code Board Members that a Special Meeting
needed to be adopted for Wednesday, May 15, 2013 to schedule delinquent dog license violations.
Board Member Duncan made a motion to approve a Special Meeting for Wednesday, May 15, 2013 at
7:00 p.m., Board Member Gutierrez seconded. The motion carried unanimously.
Mitch Nickolds, Inspection Services Manager, updated the Code Board Members that the City is roughly
200 building permits ahead of schedule from last year at this time.
F. ADJOURNMENT
There being no further business before the Pasco Code Enforcement Board, the meeting was adjourned by
Chairperson Gottschalk at 7:25 p.m.

SUBJECT: Code Enforcement Activity Reports
Reports for the Month of April, 2013
Please find attached copies of the Code Enforcement Activity Reports for the
month of April:
(1) CEB Resolution, April 4, 2013
The resolution shows all the Code Enforcement Board actions and cases that
the Board has ruled on at their monthly hearing.
(2) Status Report Code Enforcement Inspections, April 2013
This report lists all inspections performed by individual staff for the month.
To be counted as an "inspection" a written "correction notice" must have
been issued as a result of the initial inspection.
(3) Code Enforcement Compliance Actions/Rental Inspections /Certifications
2013 -2014
This report lists the total number of residential rental dwellings, by district
(No. 1 -8), requiring inspection certification over the two year period noted.
Each rental unit inspected and certified as in compliance with minimum
habitability standards is marked "passed ". Those that do not pass the initial
inspection or require substantial repair are marked "failed ".
Code Enforcement Activity Report

(4) Pasco Rental License Program: January- December 2013
This report
tracks progress in
the
annual licensing of rental
units.
As of
February 1,
2013, we estimated
that
there are 6,357 rental units
in the
City.
As license applications and non - rental certifications are received, these units
are deleted from the figure of our original estimate of the total number of
rental units. As of April 30, 5,284 dwelling units have been licensed or
certified as non - rentals. This is over 83% of the estimated total.
April Code Enforcement /Rental License Program Highlights
In April, Pasco City Council revised the City's yard sale permit regulations,
making it much easier for residents to acquire yard sale permits and clarifying
yard sale sign placement restrictions. The new rules require residents to acquire a
no -fee yard sale permit which is valid for two consecutive days, and allow two
such sales per calendar year, per residence. Yard sale permit applications can be
completed on the City's website and the no -fee permits can be printed from the
applicants home computer. Pasco Code enforcement officers will investigate
reports of unlicensed and excessive yard sales and improper sign placement on
Saturdays and Sundays, during their weekend code enforcement patrols.
The May report will be submitted on June 10, 2013. If you have any questions
