PMC 10. 52.020 (1) Violation: Parking a vehicle within an alley in such a manner or under such conditions as to leave available less than eight feet of the width of the roadway for the free movement of vehicular traffic, and/or stopping, standing, or parking a vehicle within an alley in such position as to block the driveway entrance to any abutting property. It is unlawful to park any vehicle in any alley except for loading and unloading purposes. (2) Corrective Action: Discontinue parking in any alley within the City of Pasco except for the purposes of loading and unloading only. Do not obstruct/block the alley. Description: ACCUMULATIONS OF DECAYING VEGETABLE MATTER PMC 6 29.010 (1) Violation: Permitting accumulations of filth, garbage, decaying animals or vegetable matter, etc. (2) Corrective Action: Remove and lawfully dispose of all garbage, waste, debris and any decayed/decaying matter. Maintain property free from all filth, waste and garbage at all times. Description: OFFENSIVE SMELL IN THE REAR OF THIS BUILDING. PMC 9.60.020 (2) (1) Violation: Any action or inaction which unreasonably offends the senses. (2) Corrective Action: Discontinue any act which violates the provisions of this ordinance. Description: Repeat -- Trash, litter and miscellaneous debris alley way PMC 9.60.030 (6) (1) Violation: Any parcel within the City which is filthy, littered or trash- covered due to placing, dropping, disposing, throwing away, or otherwise discarding litter, garbage, refuse, cans, bottles, paper or paper material, metal, organic or inorganic material on areas of the property other than approved garbage containers. CEB Agenda Page I of (2) Corrective Action: Remove and lawfully dispose of all litter, garbage, junk or vegetative waste on the property. Description: ROTTING MEAT AND VEGETABLE MATTER IN REAR ALLEY OF THIS PROPERTY. PMC 9.60.030 (8) (1) Violation: Garbage, butchers' trimmings and offal, parts of fish or any waste vegetable or animal matter in any quantity disposed of in places other than approved receptacles. (2) Corrective Action: Remove and lawfully dispose of any waste on property. Description: STORAGE OF BROKEN AND UNUSED SHELVING INALLEY WAY. PMC 9.60.030 (9) (1) Violation: Scrap metal, ashes, bric-a-brac, broken stone or cement, broken crockery, broken glass, broken plaster, automobile bodies and/or parts, and all such trash or abandoned material that are not kept in approved containers. (2) Corrective Action: Remove all vehicle parts, scrap metal, machinery, disassembled vehicles, etc. from the property or store these items in an enclosed container or building. Remove and lawfully dispose of all junk items (e.g. any items or which have served their intended original purpose) and unusable vehicle parts. CEB2012 -2761. 2404 W OCTAVE ST - DAVID & CECILIA D GARZA, owner Erin Spence, Code Enforcement Officer Description: Units have at least one window that does not stay in the window track and needs repair /replacement. IPMC 304.13 (1) Violation: Windows, skylights, doors and/or frames are not being kept in good repair and/or weather tight. (2) Corrective Action: Make any necessary repairs to the above areas so that they are weather tight. Maintain all such areas in good repair at all times. Window replacement requires a building permit from the City of Pasco. Description: Multiple windows are cracked in most of the units. IPMC 304.13.1 (1) Violation: Windows have cracks, holes or are completely broken out. (2) Corrective Action: Repair or replace all damaged or destroyed windows. Description: No bug screens on most windows. IPMC 304.14 (1) Violation: Required bug screen is missing on window or door of a habitable room, food preparation area, or food service area. (2) Corrective Action: Install an approved tightly fitting bug screen of not less than 16 mesh per inch (16 mesh per 25 mm) on window or door required for ventilation of habitable room or food preparation area. Description: Multiple windows do not have sash locking devices. IPMC 304.18.2 (1) Violation: Window is missing a required window sash locking device. (2) Corrective Action: Install a window sash locking device or new window with a sash locking device for all windows located in whole or in part within 6 feet above ground level or a walking surface below that provides access to a dwelling or rooming unit. Installation of new windows requires a City of Pasco building permit. Description: Attic vent blocked, rottingfascia boards around roof lines, peeling paint throughout. IPMC 304.2 CEB Agenda Page 2 of 5 (I) Violation: Exterior surfaces (i.e. doors, door and window frames, cornices, etc.) are not maintained in good condition. (2) Corrective Action: Paint or apply another protective treatment to all exterior wood surfaces that are not decay resistant. Remove all peeling, flaking and chipped paint and repaint the surface. Ensure all siding and masonry joints are weather resistant and water tight. Treat all metal surfaces subject to rust or corrosion with a rust /corrosion resistant coating, and stabilize all surfaces with rust or corrosion. Remove all oxidation stains from exterior surfaces. Description: Broken siding underneath the living room window ofunit C, peeling paint throughout the exterior of the structure, water leaking into dining area of unit D. IPMC 304.6 (1) Violation: Exterior walls are not free of holes, breaks, and/or loose or rotting materials and have not been maintained weatherproof with the surface properly coated (where required) to prevent deterioration. (2) Corrective Action: Repair exterior walls so that they are free of holes, breaks, and/or loose or rotting materials. Coat all surfaces (as required) to prevent deterioration. Description: No flashing around the roof line causing extensive rot /deterioration, roof is sagging over unit C IPMC 304.7 (1) Violation: Defects in the roof or flashing admit rain or do not drain properly to prevent dampness or deterioration in the walls or interior portions of the structure. (2) Corrective Action: Repair the roof or flashing so that it does not admit rain or drain improperly. Description: All units are in some state of disrepair and lack regular maintenance. IPMC 305.1 (1) Violation: The interior structure or equipment therein in not in good repair, is structurally unsound, or is in an unsanitary condition. (2) Corrective Action: Clean and sanitize the interior of the structure and/or equipment therein and maintain in a clean and sanitary condition. Due to the continued substandard conditions of these units, the property will need to be certified as habitable by a qualified inspector (per PMC 5.78.020) every six (6) months until the end of 2014. Description: Extensive mold /mildew in unit C (bathroom, bedrooms, living room), mold/mildew around windows in all units. Also, cracked and loose plaster around windows in all units. (REPEAT) IPMC 305.3 (1) Violation: Interior surfaces (i.e. windows, doors, floors, ceilings, etc.) are unsanitary or damaged. (2) Corrective Action: Clean and sanitize all interior surfaces and/or repair peeling, chipping, flaking or abraded paint. Cracked or loose plaster, decayed wood and other defective surface conditions need to be repaired. Surfaces contaminated by mold/mildew (such as those in unit C) which cannot be repaired must be replaced. A building permit from the City of Pasco Building Department is required for rehabilitation of unit C and all other applicable repairs. Description: Cockroach infestation in all units. (REPEAT) IPMC 308.1 (1) Violation: Rental dwelling unit is infested with rodents or insects. (2) Corrective Action: Promptly exterminate rodents or insects by an approved process that will not be injurious to human health. After extermination, proper precautions need to be taken to prevent reinfestation. Description: Unit B has a damaged toilet (no flushing handle). IPMC 502.1 CEB Agenda Page 3 of 5 (1) Violation: Bathtub or shower, lavatory, water closet and/or kitchen sink does not work or is unsafe. (2) Corrective Action: Repair or install bathtub or shower, lavatory, water closet and/or kitchen sink as required. Description: Kitchen faucet in unit C drips when off, plumbingfrom unit C appears to be leaking into unit A causing water damage in the bathroom and entry way. (REPEAT) IPMC 504.1 (1) Violation: Plumbing fixtures are not kept in working order or are not free of obstructions, leaks, or defects. (2) Corrective Action: Repair or replace plumbing fixture(s) so that it is in good working order and able to perform the functions for which it was designed. Description: Water heaters in all units have been improperly installed. Pressure Releif Valves (PM) are not properly drained to the outside of the building or afloor drain and pose a safety hazard to the occupants in the event ofa hot water release. IPMC 603.1 (1) Violation: Allowing unsafe conditions or improper installation of mechanical appliance, fireplace, solid fuel - burning appliance, cooking appliance or water heating appliance. (2) Corrective Action: Repair or replace appliance so that it is in a safe working condition and capable of performing its intended function. Description: No smoke alarms in the bedrooms of unit A & D, no smoke alarms at all in unit C. (REPEAT) IPMC 704.2 (1) Violation: Failure to provide smoke detector in all required habitable areas. (2) Corrective Action: Install smoke detector in all habitable spaces as required: outside of each separate sleeping area in the immediate vicinity of bedrooms, in each bedroom and in each story within the dwelling unit including basement. CEB2012 -2771 616 W A ST - HOLLISTER, SUSAN (ET, owner Debbie Scott, Code Enforcement Officer Description: OCCUPATION OF THE FRONT PORCHAND SHOP OF THIS PROPERTY IPMC 404.4.4 (1) Violation: PEOPLE OCCUPYING THE FRONT PORCH AND SHOP OF THIS PROPERTY FOR SLEEPING PURPOSES. Allowing occupancy of nonhabitable space (i.e. bathrooms, toilet rooms, closets, halls, storage or utility spaces or other similar areas) for sleeping purposes. (2) Corrective Action: Discontinue allowing the occupancy of nonhabitable space for sleeping purposes. Description: VEHICLE PARKED ON UNAPPROVED SURFACE PMC 25.78.030 (4) (1) Violation: Vehicles are being parked on an unapproved surface (such as dirt or grass) and/or more than four (4) vehicles at a time are being parked in the front driveway. (2) Corrective Action: Park ALL vehicles on an approved surface such as asphalt, gravel or concrete and/or discontinue parking more than 4 vehicles at a time in the front driveway. Description: PEOPLE LIVING ON FRONT PORCHAND FRONT YARD OF THIS PROPERTY. PMC 9.60.020 (1) CEB Agenda Page 4 of 5 (1) Violation: PEOPLE OCCUPYING, SLEEPING AND DEFICATING ON AND IN THE FRONT PORCH AND YARD OF THIS PROPERTY. Any action or inaction which unreasonably annoying injuring or endangering the comfort, repose, health or safety of others. (2) Corrective Action: DISCONTINUE THE OCCUPATION OF THE FRONT PORCH FOR SLEEPING, OCCUPATION AND LOITERING OF TRANSIENTS CAUSING NEIGHBORING PROPERTY OWNERS TO BE ENDANGERED AND UNSAFE IN THE OUTSIDE USE OF THEIR PROPERTY. Discontinue any act which violates the provisions of this ordinance. CALL TO ORDER Acting Chairperson Speer called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS ABSENT Daniel Gottschalk, Chairperson Dwayne Speer Don Cooper Mary Gutierrez Dennis Duncan Secretary Nickolds noted that there were four members present and a quorum was met. C. ADOPTION OF MINUTES: Board Member Cooper moved, seconded by Board Member Duncan, that the minutes of the June 7, 2012 meeting be approved as mailed. The motion carried unanimously. Board Member Cooper moved, seconded by Board Member Gutierrez, that the minutes of the June 28, 2012 meeting be approved as mailed. The motion carried unanimously. D. DETERMINATION HEARINGS: Acting Chairperson Speer explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Administration of Oaths All City staff who wished to provide testimony before the Board were sworn to truthfulness by Acting Chairperson Speer. b. Hearings Scheduled Acting Chairperson Speer noted no cases were scheduled for hearings and asked the Secretary to proceed with amendments to the resolution. c. Amendments i. City of Pasco vs. Ramos, Josephine case number CEB2012 -2441 for the property of 212 N Cedar Avenue Mr. Nickolds recommended this case be continued to the August 8, 2012 Code Enforcement Board Meeting. d. Motion Board Member Duncan made a motion, seconded by Board Member Cooper, to approving Resolution No. 2012 -07 as amended, finding that code violations have been corrected and may be dismissed, deferring on certain cases until proper notification is made, accepting voluntary corrective agreements, accessing penalties and opposing timeframes in certain cases. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: Secretary Nickolds stated that staff has completed over 2,000 dog license complaints in the past two months. They will be getting responses to backlogged nuisances in August. ADJOURNMENT There being no further business before the Pasco Code Enforcement Board, the meeting was adjourned by Acting Chairperson Speer at 7:05 p.m. r 07122012 Ceb Minutes Page 2 of 2 MEMORANDUM July 13, 2012 TO: Rick White, Director, Community & Economic Development FROM: Mitch Nickwdl, tion Services Manager SUBJECT: Code Enforcement Activity Reports Reports for the Month of June 2012 Please find attached copies of the Code Enforcement Activity Reports for the month of June: (1) CEB Resolutions, June 7 and June 28 2012 The resolutions show all the Code Enforcement Board actions and cases that the Board has ruled on at their monthly hearing, and at their special hearing in the month of June. (2) Status Report Code Enforcement Inspections June 2012 This report lists all inspections performed by individual staff for the month. To be counted as an "inspection" a written "correction notice" must have been issued as a result of the initial inspection. (3) Code Enforcement Compliance Actions/Rental Inspections /Certifications 2011 -2012 This report lists the total number of residential rental dwellings, by district (No. 1 -8), requiring inspection certification over the two year period noted. Each rental unit inspected and certified as in compliance with minimum habitability standards is marked "passed ". Those that do not pass the initial inspection or require substantial repair are marked "failed ". Code Enforcement Activity Report Em (4) Pasco Rental License Program: January- December 2012 This report tracks progress in the annual licensing of rental units. As of February, 2009, we estimated that there were 5,788 rental units in the City. As license applications and non - rental certifications are received, these units are deleted from the figure of our original estimate of the total number of rental units. As of June 30, 5,136 dwelling units have been licensed or certified as non - rentals. This is over 88% of the estimated total. June Code Enforcement/Rental License Program Highlights In June, the Pasco Code Enforcement Board conducted a special meeting to rule on 192 dog license violation notices issued by Pasco code enforcement officers. In the resolution passed by the Board, over 150 of the cases were dismissed because the dog owners responded by licensing their dogs or advised the City they no longer had a dog in their home.
