CALL TO ORDER Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS PRESENT MEMBERS ABSENT Daniel Gottschalk, Chairperson Dwayne Speer Don Cooper Mary Gutierrez Dennis Duncan C. ADOPTION OF MINUTES: Board Member Cooper moved, seconded by Board Member Gutierrez, that the minutes of the May 3, 2012 meeting be approved as mailed. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Administration of Oaths Mitch Nickolds, Inspection Services Manager, asked that all City staff, respondents and any witnesses who had appeared to offer testimony before the Board be sworn to truthfulness. Chairperson Gottschalk asked the audience if there were any objections to any Board Member hearing any matter. There were no objections. All City staff, respondents and witnesses who wished to provide testimony before the Board were sworn to truthfulness. b. Hearings Scheduled Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and asked the City to begin presentation of the cases to be heard. i. City of Pasco vs. Clark, Pauline case number CEB2012 -0263 for the property at 937 Empire Dr Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violation on this property was Pasco Municipal Code (PMC) 6.04.090 Failure to maintain required garbage service. Ms. Scott advised the property was inspected on April 10, 2012 for violations of the Pasco Municipal Code. Ms. Scott advised the Board that a violation was observed but the property is in compliance with the Pasco Municipal Code at this time. 06072012ceb Minutes Page 1 of 4 The City recommended the property owner pay a $200 repeat penalty to be held in abeyance for a period of one year and dismissed if no violations of the same or similar occur at this location during that time frame. Pauline Clark, 3007 N. 70'h Place, spoke for the record. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Cooper that violation of the PMC had occurred. The motion carried unanimously. Board Member Cooper moved, seconded by Board Member Gutierrez, that a repeat penalty of $200 be imposed but held in abeyance for a period of twelve months and dismissed if no violations occur in that period. The motion carried unanimously. ii. City of Pasco vs. Garcia, Andres case number CEB2012 -0315 for the property of 728 W. Park St Mitch Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (PMC) 25.78.030 (4) Vehicles parked/driven on unapproved surface and (PMC) 9.60.020 (3) Vehicles driven over city right of way (sidewalk). Ms. Scott advised the property was inspected on March 6, 2012 for violations of the Pasco Municipal Code. Ms. Scott advised the Board that violations were observed but the property is in compliance with the Pasco Municipal Code at this time. The City recommended the property owner pay a $200 repeat penalty to be held in abeyance for a period of one year and dismissed if no violations of the same or similar occur at this location during that time frame. Alecia Garcia, 728 W. Park Street spoke for the record on Andres Garcia's behalf. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Gutierrez that violation of the PMC had occurred. The motion carried unanimously. Board Member Gutierrez moved, seconded by Board Member Cooper, that a repeat penalty of $200 be imposed but held in abeyance for a period of twelve months and dismissed if no violations occur in that period. City of Pasco vs. Farris, Joann case number CEB2012 -0989 for the property of 808 S. 5'h Ave Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (IPMC) 108.1.1 Unsafe, dangerous structure (Interior), (IPMC) 108.1.3 Interior of the house is in extreme disrepair, unsanitary and a fire hazard, (PMC) 25.78.030 (2) Vehicle repair in public view in the front yard and city right of way, (PMC) 8.02.190 Failure to license the dog at this location, (PMC) 9.60.030 (12) Front yard of property used for vehicle disassembling and storing of vehicles in the front yard, (PMC) 9.60.030 (6) Trash, litter and miscellaneous debris located on 06072012ceb Minutes Page 2 of 4 this property in public view and (PMC) 9.60.030 (9) Vehicle parts located in public view on this property. Ms. Scott advised the property was inspected on March 26, 2012 for violations of the Pasco Municipal Code. Ms. Scott advised the Board that violations were observed and the property is not in compliance with the Pasco Municipal Code at this time. The City recommended that Joann Farris pay a third repeat penalty of $600 and be given 10 days to correct the remaining violations or pay a penalty of $100 per day for 10 days. Joann Farris, 813 S. 5t` Avenue spoke for the record. CODE BOARD DECISION: Board Member Cooper moved, seconded by Board Member Speer that violation of the PMC had occurred. The motion carried unanimously. Board Member Speer moved, seconded by Board Member Gutierrez, that a penalty of $300 be assessed with 90 days to correct the violations, given that the City inspects every 30 days to insure progress is being made; if in any of those 30 days in the 90 day period the work is not completed or progress has not been properly made, there will be 10 days given with $100 per day to correct those violations; a $1,000 penalty is to be held in abeyance for one year and dismissed is no similar violations occur in that period; the dwelling is to remain vacant until the City inspects and approves the house for habitation. The motion carried unanimously. iv. City of Pasco vs. Flores, Benito & Guadalupe case number CEB2012 -1571 for the property of 1919 W. Irving St Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (IPMC) 108.1.3 Garage being used as living quarters /sleeping room, (lPMC) 108.1.4 Illegal occupation of the garage, (PMC) 25.78.030 (4) Vehicles parked on unapproved surface and (PMC) 9.60.030 (6) Mattresses, washing machine and miscellaneous debris located in the rear yard. Ms. Scott advised the property was inspected on April 19, 2012 for violations of the Pasco Municipal Code. Ms. Scott advised the Board that violations were observed and the property is not in compliance with the Pasco Municipal Code at this time. The City recommended that the property owner be given 10 days to correct the remaining violations or pay a penalty of $100 per day for 10 days. Alex Flores, 1931 W. Opal Street spoke on behalf of his mother, Guadalupe Flores, 1919 W. Irving Street, for the record. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Gutierrez that violation of the PMC had occurred. The motion carried unanimously. Board Member Speer moved, seconded by Board Member Cooper, that a repeat penalty of $200 be imposed but held in abeyance for a period of twelve months and dismissed if no violations occur in that period and give the respondent an additional 20 days to correct the violations or pay a penalty of $100 per day for 10 days. Christopher & Felicia case number CEB2012- Mr. Nickolds explained that Mr. and Mrs. Perez failed to appear, as such, their case will be moved to the resolution for consent vote. d. Dismissals None e. Motion Board Member Cooper made a motion, seconded by Board Member Gutierrez, to approving Resolution No. 2012 -06 as amended, finding that code violations have been corrected and may be dismissed, deferring on certain cases until proper notification is made, accepting voluntary corrective agreements, accessing penalties and opposing timeframes in certain cases. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: A special hearing was discussed for 7:00 p.m., Thursday, June 28, 2012 to hear an agenda for dog violations. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Gutierrez to hold a special hearing for dog licensing violations at 7:00 p.m., Thursday, June 28, 2012. The motion carried unanimously. F.
