(2) Corrective Action: Park ALL vehicles on an approved surface such as asphalt, gravel or concrete and/or discontinue parking more than 4 vehicles at a time in the front driveway. Description: PMC 9.60.020 (3) (1) Violation: Unlawfully interfering with, obstructing or tending to obstruct or render dangerous for passage any public right -of -way (i.e. stream, public park, parkway, square, street, highway or sidewalk) in the city. (2) Corrective Action: Remove all items /objects /vehicles /etc. which may be obstructing any public right -of -way. CEB2012 -0989 808 S 5TH AVE - JOANN FARRIS, owner Debbie Scott, Code Enforcement Officer Description: UNSAFE, DANGEROUS STRUCTURE (ENTERIOR),IPMC 108. 1.1 (1) Violation: Allowing a structure that is unsafe (i.e. damaged, decayed, dilapidated and/or structurally unsafe), or that does not provide minimum safeguards to protect or warn occupants in the event of a fire to be occupied. (2) Corrective Action: Rehabilitate or vacate the structure or portion thereof as required. Passing inspection must be completed within seventy two hours (72 hours) of this notice. Allowing a structure that is in disrepair, lacks maintenance, is insanitary, vermin or rat infested, lacks ventilation or heat, or other essential equipment or is determined to be a hazard for any other reason by the code official to be occupied. (2) Corrective Action: Obtain all required permits, City & State (L & I electrical) to rehabilitate this single family structure by making all necessary repairs in the time given or, if repairs cannot be made in that time, the sturcture and property MUST BE SECURED AND VACATED. Passing inspection must be completed within seventy two noui°s (72 hours) of this notice. Description: REPEAT - VEHICLE REPAIR IN P UBLIC VIEW IN THE FRONT YARD AND CITY RIGHT OF WAY. PMC 25.78.030 (2) (1) Violation: VEHICLE REPAIR IN FRONT YARD. Using the driveway for the storage of equipment or materials, or for the sale, repair or servicing of vehicle(s). (2) Corrective Action: Discontinue any of the actions described above. All vehicle repairs must be for personal vehicles only and must be performed within a fully enclosed building. Equipment and other materials must also be stored within an enclosed building. Description: REPEAT- -FAIL URE TO LICENSE THE DOG AT THIS LOCATION. PMC 8.02.190 (1) Violation: No current license for the dog at this location, a notice was sent to owner last year for dog license and the dog was licensed late with a Correction Notice. All dogs over seven (7) months of age must be licensed with the City of Pasco. (2) Corrective Action: License all dogs over the age of seven (7) months with the City of Pasco (please call (509) 545 -3488 for more information). Description: REPEAT- Front yard of property used for vehicle disassembling and storing of vehicles in the front yard. PMC 9.60.030 (12) (1) Violation: All places used or maintained as junkyards, or dumping grounds, or for the wrecking or disassembling of automobiles, trucks, tractors, or machinery of any kind, or for the storing or leaving of worn-out, wrecked or abandoned automobiles, trucks, tractors, or machinery of any kind, or of any of the parts thereof, or for the storing or leaving of any machinery or equipment used by contractors or builders or by other persons. (2) Corrective Action: Discontinue wrecking or disassembling automobiles, trucks, etc. Remove and lawfully dispose of all wrecked or abandoned vehicles, machinery, etc. along with any parts thereof. Discontinue the storage of heavy machinery or equipment (i.e. front end loaders, dump trucks, backhoes, etc.) at this property. Description: REPEAT- Trash, litter and miscellaneous debris located on this property in public view. PMC 9.60.030 (6) (1) Violation: Any parcel within the City which is filthy, littered or trash- covered due to placing, dropping, disposing, throwing away, or otherwise discarding litter, garbage, refuse, cans, bottles, paper or paper material, metal, organic or inorganic material on areas of the property other than approved garbage containers. (2) Corrective Action: Remove and lawfully dispose of all litter, garbage, junk or vegetative waste on the property. Description: REPEAT- Vehicle parts located in public view on this property. PMC 9.60.030 (9) (1) Violation: Scrap metal, ashes, bric- a -brac, broken stone or cement, broken crockery, broken glass, broken plaster, automobile bodies and/or parts, and all such trash or abandoned material that are not kept in approved containers. (2) Corrective Action: Remove all vehicle parts, scrap metal, machinery, disassembled vehicles, etc. from the property or store these items in CEB Agenda Page 2 of 4 an enclosed container or building. Remove and lawfully dispose of all junk items (e.g. any items or which have served their intended original purpose) and unusable vehicle parts. IPMC 108.1.3 (1) Violation: GARAGE IS NOT APPROVED OR PERMITTED FOR LIVING QUARTERS Allowing a structure that is in disrepair, lacks maintenance, is insanitary, vermin or rat infested, lacks ventilation or heat, or other essential equipment or is determined to be a hazard for any other reason by the code official to be occupied. (2) Corrective Action: VACATE THE GARAGE AND DISCONTINUE ANY OCCUPATION OF THE GARAGE AT ANY TIME. CALL TO ORDER Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS PRESENT Daniel Gottschalk, Chairperson Dwayne Speer Don Cooper Dennis Duncan Mary Gutierrez MEMBERS ABSENT C. ADOPTION OF MINUTES: Board Member Duncan moved, seconded by Board Member Gutierrez, that the minutes of the April 5, 2012 meeting be approved as mailed. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Administration of Oaths Mitch Nickolds, Inspection Services Manager, asked that all City staff, respondents and any witnesses who had appeared to offer testimony before the Board be sworn to truthfulness. Chairperson Gottschalk asked the audience if there were any objections to any Board Member hearing any matter. There were no objections. All City staff, respondents and witnesses who wished to provide testimony before the Board were sworn to truthfulness. b. Hearings Scheduled Chairperson Gottschalk advised that the Board was now ready to proceed with the hearings and asked the City to begin presentation of the cases to be heard. i. City of Pasco vs. Perez, Gerardo case number CEB2011 -3399 for the property at 829 S Myrtle Ave Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. 05032012 Ceb Minutes Page 1 of 7 T✓Is. (PMC) 9.60.030 (9) Automobile bodies and parts, and (PMC) 9.60.040 Unsecured vacant building. Ms. Scott advised the property was inspected on November 14, 2011 for violations of the Pasco Municipal Code. Ms. Scott advised the Board that violations were observed and the property is not in compliance with the Pasco Municipal Code at this time. The City recommended the property owner, Gerardo Perez, be given 10 days to correct the remaining violations or pay a penalty of $50 per day for 10 days. Victor Mejarez, 1712 N. 24th spoke for the record. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Duncan, that violation of the PMC had occurred. The motion carried unanimously. Board Member Duncan moved, seconded by Board Member Gutierrez, that the property owner has a timeframe of 20 days and a long -term penalty of $50 per day be imposed if the timeframe expires and the property is still in violation. Citv of Pasco vs. Alpizar, Jose & Rafaela case number CEB2011 -3400 for the Property of 811 S Myrtle Ave Mitch Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (PMC) 25.52.020 Unpermitted use of property as an auto wrecking /dismantling facility and (PMC) 9.60.020 (3) Vehicles parking /loading in alley way are obstructing access to alley for garbage pick -up. Ms. Scott advised the Board that violations were observed and the property is not in compliance with the Pasco Municipal Code at this time. The City recommended that the property owners be given 10 days to correct the remaining violations or pay a penalty of $50 per day for 10 days. Victor Mejarez, 1712 N. 24th spoke for the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (PMC) 25.78.030 (4) Vehicles parked on unapproved surface, (PMC) 9.60.030 (10) Large pile of limb debris causing an extreme fire danger, (PMC) 9.60.030 (11) Two large piles of dirt deposited in the front and rear yard areas, and (PMC) 9.60.030 (6) Large amount of grass clippings, limb debris, yard waste and black garbage bags located on this property. Ms. Scott advised the Board that violations were observed and the property is not in compliance with the Pasco Municipal Code at this time. The City recommended that the property owner be given 10 days to correct the remaining violations or pay a penalty of $50 per day for 10 days. Bernice Cave, 1216 N 161h Avenue spoke for the record. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Gutierrez, that violation of the PMC had occurred. The motion carried unanimously. Board Member Speer further moved, seconded by Board Member Gutierrez, that the property owner be given 30 days to comply with a monetary penalty of $50 per day if the timeframe expires and the property is still in violation and to authorize the City to approve extensions and timeframe for work in progress. The motion carried unanimously. iv. City of Pasco vs. Gutierrez, Maria & Manuel case number CEB2012 -0041 for the property of 216 N Wehe Ave Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (IPMC) 505.1 Water has been disconnected, (PMC) 25.78.030 (4) Vehicle parked on unapproved surface, (PMC) 9.60.030 (6) Miscellaneous debris front and rear yard (Repeat), and (PMC) 9.60.030 (9) Tires in the rear yard. Ms. Scott advised the Board that the violations have been corrected and the property is in compliance at this time. The City recommended that the property owners be assessed $200 for repeat violations. Manuel Gutierrez, 920 N Elm Avenue spoke for the record. Ms. Scott indicated that the cited violations on this property were Pasco Municipal Code (PMC) 9.60.030 (10) Boxes, trash, plastic thrown in the rear of this property and blowing onto neighboring properties (Repeat), (PMC) 9.60.030 (6) Plastic boxes (crates) stored in public view, and (PMC) 9.60.030 (9) Commercial equipment (refrigerators) stored in rear of this property in public view. Ms. Scott advised the Board that the violations have been corrected and the property is in compliance at this time. Mr. Barajas indicated that the cited violation on this property was Pasco Municipal Code (PMC) 9.56.030, 9.56.040 Blowing dust from entire site, including vacant lots in Phase 1. Mr. Barajas indicated that second repeat violation has been corrected and the property is in compliance at this time. Vile City of Pasco vs. Ochoa, Simon & Anita case number CEB2012 -0310 for the Property of 520 W Clark St Mr. Nickolds called Debra Scott, Code Enforcement Officer, to read the case facts into the record. Ms. Scott indicated that the cited violation on this property was Pasco Municipal Code (PMC) 6.04.090 Retail clothing business has failed to maintain required garbage service. Ms. Scott advised the Board that the violation has been corrected and the property is in compliance at this time. The City recommended that the property owners be assessed $200 for repeat violations. Ms. Scott advised the Board that the violations have been corrected and the properly is in compliance at this time. CODE BOARD DECISION: Board Member Duncan moved, seconded by Board Member Speer, that violation of the PMC had occurred and were shown by a preponderance of the evidence. Board Member Cooper moved, seconded by Board Member Duncan, that the property owners be assessed $200 for a repeat violation that has been corrected, to be held in abeyance for a period of 12 months and be dismissed if no other violations occur in that 12 month period. Ms. Scott indicated that the cited violation on this property was Pasco Municipal Code (PMC) 10.52.030 (2) Commercial vehicle (semi- truck) parked in front yard again. Ms. Scott advised the Board that the violations have been corrected and the property is in compliance at this time. STAFF REPORT AND OTHER BUSINESS: Upcoming summer session was discussed. Many correction notices have been written for unlicensed dogs and delinquent and unlicensed businesses. A second Code Board meeting will be necessary in June just to deal with dog licensing issues that have been cited over the course of the last month. F. Note, There is no resolution for April. The April meeting was continued to May 3 due to lack of a quorum. (2) Status Report Code Enforcement Inspections, April, 2012 This report lists all inspections performed by individual staff for the month. To be counted as an "inspection" a written "correction notice" must have been issued as a result of the initial inspection. (3) Code Enforcement Compliance Actions /Rental Inspections /Certifications 2011 -2012 This report lists the total number of residential rental dwellings, by district (No. 1 -8), requiring inspection certification over the two year period noted. Each rental unit inspected and certified as in compliance with minimum Code Enforcement Activity Report Page 2 habitability standards is marked "passed ". Those that do not pass the initial inspection or require substantial repair are marked "failed ". (4) Pasco Rental License Program: January- December 2012 This report tracks progress in the annual licensing of rental units. As of February, 2009, we estimated that there were 5,788 rental units in the City. As license applications and non - rental certifications are received, these units are deleted from the figure of our original estimate of the total number of rental units. As of April 30, 5,119 dwelling units have been licensed or certified as non - rentals. This is over 88% of the estimated total. April Code Enforcement /Rental License Program Highlights 1ts In April, Pasco Code Enforcement Officers issued 1,137 correction notices to owners of unlicensed dogs, which increased the total number of dog license violation notices issued in 2012 to 1,753. A special hearing of the Pasco Code Enforcement Board will be needed to deal with the 250 -300 dog owners who - after the City's verifies an unlicensed dog is still present on the property- have failed to respond to the City's previous notices.
