Fair Labor Standards Act (FLSA) Rules re: Exempt and Initial Effective Date: Non-exempt Positions 7/30/96 — G . Crutchfield Revised 7/29/02 1 /05 i Approved G The Fair Labor Standards Act (FLSA) authorizes the distinction between non- exempt (commonly known as "hourly") and exempt positions for overtime and other payroll purposes . It is the purpose of this Administrative Order to clearly establish that distinction as the FLSA rules apply to the City of Pasco workforce. DEFINITIONS : For purposes of the Administrative Order, exempt means not subject to overtime rules and regulations. Non-exempt means subject to overtime rules and regulations. EXEMPT POSITIONS: The following positions are deemed to meet the FLSA tests for exempt status and, accordingly, are exempt from the overtime provisions of the Act. Executive Positions Department Position Executive City Manager Public Works Director City Engineer Plant Services Manager Field Services Manager Administrative & Community Services Director Information Systems Manager Financial Services Manager Customer Service/Utility Billing Manager Administrative Services Manager Recreation Services Manager Facilities Division Manager Community & Economic Development Director Inspection Services Manager Fire Fire Chief Police Police Chief Police Captains Municipal Court Judge Court Administrator Administrative Positions Department Position Executive Human Resources Division Manager Fire Assistant Fire Chief Public Works Assistant Field Division Manager Professional Positions Administrative & Community Services Accounting Supervisor Senior Accountant Community Development City Planner Associate Planner Engineering Senior Engineer — Design Senior Engineer - Construction NON-EXEMPT POSITIONS : All other positions shall be considered non-exempt positions for FLSA purposes. - 1 . Most non-exempt positions are covered by the overtime provisions of the FLSA. If applicable this means payment of overtime, or, if approved, compensatory time off in accordance with AO 443 . Non-exempt positions not covered by overtime provisions include all seasonal recreational positions [29 USC § 213 (a) (3)] . 2. Except for public meetings and presentations to the public, professional positions are eligible for payment of overtime wages or, if approved, compensatory time off in accordance with AO *43 , for hours worked over 40 hours per work week. PERSONNEL RECORDS The Human Resources Office is hereby directed to establish an appropriate and effective record system for the maintenance of the distinctions set forth herein. EFFECTIVE DATE This amended order shall take effect January 1 , 2005, and replaces all previous amendments and original issues of OA #47.
