SLT3JECT : BUSINESS LICENSE ENFORCEMENT .
The following Administrative Order is effective immediately .
I . RESPONSIBILITY :
The Community Development Department is hereby designated the city
agency primarily responsible for the active and uniform enforcement
of business license regulations during normal business hours ( 8 : 00 a . m . -
5 : 00 p . m . , Monday through Friday ) . During other hours , the Police
Department shall be responsible for such enforcement .
II . AUTHORITY :
The Community Development Director or his designee shall have the
authority to inspect the premises of any business establishment
required to be licensed under Title 5 ( P .M . C . ) . The Director or
his designee shall also have the authority to issue citations to
municipal court for violation (s ) of applicable municipal regulations .
III . COORDINATION OF ENFORME TT PROGRAMS :
(A) To the extent practical , the Conymmity Development Director
shall coordinate the business license enforcement program with
all other regulatory enforcement activities of the Community
Development Department . Inspections of business establishments
shall include the recording of any apparent violations of the
following :
(1 ) P.M . C . Title 5 ( Business Licenses ) .
( 2 ) P . M . C . Chapter 6 . 04 (Solid Waste ) .
( 3 ) P .M . C . Chapter 9 . 60 (Public Nuisances ) .
(4 ) P . M . C . Chapter 9 . 62 (Abandoned Vehicles/Vehicle Hulks ) .
( 5 ) P .M . C . Section 12 . 12 . 030 ( Unimproved Right-of-Way) .
(6 ) P . M . C . Section 12 . 12 . 080 (Private Property ) .
( 7 ) P . M . C . Section 13 . 52 . 020 , 13 . 52 . 030 and 13 . 52 . 080 ( Wastes ) .
(8 ) P . M . C . Title 16 (Buildings and Construction ) .
( 9) P .M . C . Title 17 ( Signs ) .
( 10 ) P . M . C . Title 19 (Mobile Homes ) .
( 11 ) P . 11 . C . Title 20 ( Swimming Pool Code ) .
(12 ) P . M . C . Title 22 ( Zoning ) .
(B) Inspection of those business establishments which are subject
to regulations under P .M .C . Chapter 6 . 08 , 6 . 12 , 6 . 16 , 6 . 20
• and 6 . 24 , should include , to the extent necessary , an authorized
representative of the Benton-Franklin Health District .
(C) When appropriate , the Community Development Department inspection
program shall note any obvious or potential threats to fire
and life safety observed during an inspection . Any such observations
shall be reported , in writing , to the Fire Chief for appropriate
action under applicable regulations of P . M . C . Title 18 (Fire
Prevention ) .
IV . CERTAIN PROCEDURES RECUUIRED :
( A) Upon discovery of a business knowingly and willfully operating
without a business license and without having submitted an
application for same , the inspector shall issue a citation .
( B) Upon discovery of a business which has failed to obtain a license
renewal by :March 1 of the current year , the inspector shall
issue a "Notice of Violation " directing the proprietor or manager
to obtain the license within two (2 ) business days ; failure
to comply within the specified time shall cause the inspector
to issue a citation for prosecution in municipal court .
(C ) Upon discovery of a business operating without a business license ,
without having filed an application for sank, and apparently
without knowledge of the license requirement , the inspector
shall use the enforcement procedure provided in ( B ) above .
(D) Upon discovery of violations of other applicable municipal
regulations , the inspector will issue a "Notice of Violation"
and an appropriate period of time for correction or abatement
of the violation( s ) . Failure to comply within the specified
time may be cause for issuance of a citation for prosecution
in municipal court .
V . REPORTS :
( A ) The Ccxrmunity Development Director or his designee will maintain
a daily log of inspections carried out under this Order . Such
log shall as a minimum include : date and time of inspection ;
name and address of business establistunent ; infractions noted
during inspection ; action taken .
(B) The Community Development Director will provide to the City
Manager a quarterly summary report of inspection activities
carried out under this Order .
