SUBJECT: PROCEDURE FOR HANDLING ABATEMENT OF NUISANCES .
The following procedures shall be followed in the abatement of nuisances
by the various City departments and the Health District:
1 . The Building Inspector , or his designate , assigned to general City clean-up
and alley inspections , will issue a courtesy notice to violators for the
first offense .
2 . Depending on the nature of the violation , and provided the first courtesy
notice does not remedy the nuisance , the Building Inspector , or his designate ,
will then assemble all pertinent data from the Building Division of the
Community Development Department and , if necessary , the Fire Department
and the Health District , and submit all of the information to the City Attorney
for his review , looking to his prosecuting the enforcement of the City code .
The material submitted to the City Attorney should include at least four
photographs of the alleged problem , including the dates and names of persons
taking the pictures .
3 . The City Attorney shall review the information to determine whether or not the
case is properly prepared to go to Court , and may call on the appropriate
departments for additional information , if needed. The City Attorney shall
make a monthly report to the City Manager , giving the number of cases filed
and the dispositions thereof .

4 . The City Attorney , in situations or circumstances requiring that a case
be taken to Court , will file the complaint and have it served on the violating
individual .
50 For cases involving the initiation of the action by the Health District or the
Fire Department , a similar procedure to the above will be followed .
However , instances where other than Health or Fire problems are involved ,
the appropriate individuals will work through the Building Inspector so that
he can coordinate the overall presentation of information for the City
Attorney .
6 . If a second case involving the same individual with the same or similar
nuisance occurs within a twelve-month period dating from the first nuisance ,
it will not be necessary to send a second courtesy notice .
7 . Time is of the essence in closing out nuisances , and City departments are to
grant all possible assistance in the execution of the nuisance abatement
program .
8 . This administrative order supplants the memorandum of August 12 , 1977 from
former City Manager , George Smith , on the same subject .
