The following Administrative Order is effective February 10, 2011 and supersedes
Administrative Order No . 72, Section III, dated November 22, 1993 .
I. PURPOSE :
This Administrative Order is issued to establish a policy and expectations regarding
unpaid leaves of absence.

IV. POLICY:
The City Manager is authorized to approve an unpaid leave, such as the employee ' s need
for extended sick leave, call to duty in the Armed Forces of the United States, and
extended vacation. Unpaid leaves of absence are generally limited to one year. Leaves
of absence are not granted for other employment except for military leave. Department
Directors are authorized to grant unpaid leaves (leave without pay) for up to three (3)
days duration.
Applicable conditions regarding unpaid leaves of absence :
A. Non-medical leave : All accumulated leaves must be exhausted prior to applying for
a leave of absence, except for sick leave and up to forty (40) hours of vacation
leave.
B . Medical leave : All accumulated leaves, including eligible sick leave (but excepting
up to 40 hours of vacation leave) must be exhausted.
C. During an unpaid leave of absence (not subject to FMLA) an employee will be able
to continue medical, dental, vision insurance, subject to the rules of COBRA.
D. An employee is not entitled to accrue paid leave while on a leave of absence not
subject to FMLA.
E. Failure on the part of the employee to report for work promptly upon the expiration
of an unpaid leave of absence, without receiving an extension in advance, shall be
regarded as a voluntary resignation.
v. PROCEDURE :
An employee seeking approval for an unpaid leave of absence must follow the following
procedures :
A. A request for a leave of absence must be made in advance and in writing by
completing a "Leave of Absence Request" form and accompanied by a memo
detailing the reasons for the request. The form/memo must be forwarded to the
department director for recommendation and sent to the City Manager for approval.
B . If the leave is approved, Human Resources will coordinate the leave and benefits
with the employee . Human Resources may be directed to prepare a standard memo
for special conditions; such conditions shall accompany the approved request copy
returned to the employee.
C . If the initial approved leave of absence is for less than one ( 1 ) year in duration, an
extension may be granted. To request an extension, the employee must submit a
written request stating the need for the extension to the department director, who
will, in turn, forward the request to the City Manager for his decision.
D. If the reason for the leave is for medical reasons, a Physician ' s Release/Return to
Work form may be required. (Reference Administrative Order No. 246 "Sick
Leave" for details.)
