HomeMy WebLinkAboutN-231.2 - Pregnancy Leave .�N CITY OF PASCO ADMINISTRATIVE ORDERS Administrative Order No. 231 .2 Personnel Policies & Procedures Subject: Pregnancy Leave Initial Effective Date: June 25, 1987 Revised 3/25/09 5/6/10 Approved GC The following Administrative Order is effective May 6, 2010 and supersedes Administrative Order No. 231 .2 dated 3/25/09 and Administrative Order No. 58, dated 6/25/87. 1. PURPOSE: This Administrative Order is issued to establish a policy and expectations regarding leave for pregnancy disability and to care for a newborn. II. DEPARTMENTS AFFECTED: All III. REFERENCES: Federal FMLA law; Washington Family Leave Act. IV POLICY: Federal and state laws provide certain leave rights in connection with pregnancy-related disability and to care for a newborn. A. Regardless of whether an employee is eligible for FMLA leave, she is entitled to Pregnancy Disability leave for the period of time that she is temporarily disabled because of pregnancy or childbirth. B. Medical certification may be required to confirm the need for leave. C. If the employee is eligible for FMLA leave, the Pregnancy Disability (pre-delivery) may run concurrently with FMLA leave, if the employee so chooses. D. Pregnancy Disability leave is unpaid and health benefits are not automatically continued (unless the employee is also FMLA eligible — health benefits). However, accrued leave may be used for the leave to be a paid leave. E. Washington Family Care Act leave allows for 12 weeks of leave for care of a newborn. It does not run concurrently with Pregnancy Disability leave. 1 . Washington Family Leave Act is an unpaid leave and health benefits are not automatically continued unless the leave time is run concurrently with FMLA (health benefits) and/or accrued leave (paid time off).
