HomeMy WebLinkAbout022 - Construction Contract Claims ADMINISTRATIVE ORDER NO . 22 TO: Department Heads March 17 , 1981 FROM: Lee Kraft , City Manager ' , SUBJECT: PROCEDURE FOR HANDLING CLAIMS INVOLVING CONSTRUCTION CONTRACTS . PURPOSE: This Administrative Order is to establish a procedure to deal with claims against the City involving accidents dealing with work done by contractors who are under a contract with the City of Pasco . PROCEDURE: Whenever the City receives a claim relating to work being done by a contractor on a public works contract or similar type contract , the City Clerk shall immediately send a copy of the claim to the contractor; a copy to the contractor ' s insurance company; a copy to the contractor' s bonding company; and a copy to the Director of Public Works and a copy to the City Attorney . A copy of the claim should also be submitted to Dunning-Ray for information purposes , and this copy should be clearly marked "FOR INFORMATION ONLY NO ACTION REQUESTED " . The City Clerk ' s letter of submittal to Dunning- Ray should also indicate that the claim is alleged to have arisen from the contractor' s work done for the City and should indicate . that the claim is being tendered to the contractor , contractor' s insurance company , and contractor' s bonding company . In each case , the specific information should be provided on . the name of the contractor , the name of the insurance company , and the name of the bonding company . At this time , the City Clerk shall also write to the claimant and advise the claimant that his/her claim is being rejected by the City because it is related to a job under contract , and the claimant is to be informed that the claim has been submitted to the contractor , to the contractor' s insurance company , and to the contractor' s bonding company . Again , this letter should give specific information on the name of the contractor , the insurance company , and the bonding company . Copies of the Clerk ' s letters regarding contractor-related claims shall go to the Director of Public Works and to the City Attorney . Information required by the City Clerk as to the name of the insurance company and the name of the bonding company , if not known to the Clerk ' s office , shall be provided by the City Engineer . As soon as any city employee is on notice , either verbally or in writing , of a potential claim against a contractor , his/her department head shall be notified by that employee immediately so that the department head can put the contractor on notice regarding the potential claim . At this time , the department head shall submit a written report to the City Attorney with pertinent information . LFK:pt
