HomeMy WebLinkAboutPasco Specialty Kitchen with the DPDA MEMORANDUM OF AGREEMENT COMMERCIAL KITCHEN BUSINESS INCUBATOR PROGRAM YEAR 2012 A MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF PASCO AND THE DOWNTOWN PASCO DEVELOPMENT AUTHORITY REGARDING THE USE OF CDBG GRANT FUNDS FOR THE OPERATION OF A COMMERCIAL KITCHEN BUSINESS INCUBATOR LOCATED AT 110 SOUTH FOURTH AVENUE IN THE CITY OF PASCO, WASHINGTON. WHEREAS, the use of the Commercial Kitchen Business Incubator in the downtown assists in the revitalization of the area and create new job opportunities; and WHEREAS, the Downtown Pasco Development Authority currently operates the Commercial Kitchen Business Incubator; and WHEREAS, the Community Development Block Grant Program Year 2012 Annual Action Plan awards an estimated $50,000 in CDBG funds to the Downtown Pasco Development Authority (DPDA) to be used for the operation of the commercial kitchen business incubator in the downtown, NOW, THEREFORE, THE CITY OF PASCO AND DOWNTOWN PASCO DEVELOPMENT AUTHORITY MUTUALLY AGREE AS FOLLOWS: 1. The Downtown Pasco Development Authority will manage the commercial kitchen business incubator on behalf of the City, which will retain ownership of the property, and invoice in 12 monthly increments not to exceed the award amount. If the actual award from HUD is less than estimated and allocations are reduced, any amount over the actual allocation in the subrecipient agreement must be repaid. 2. The specific terms of the Commercial Kitchen Business Incubator Management Agreement will be mutually agreed upon by the Pasco City Council and Downtown Pasco Development Authority Board of Directors. 3. The City and Downtown Pasco Development Authority agree to comply with all terms and conditions of the U.S. Department of Housing and Urban Development laws and regulations incorporated by reference (24 CFR 570) for Community Development Block Grant Entitlements (CFDA 14.218).
