A RESOLUTION approving a preliminary plat for The Villages at Chapel Hill.
WHEREAS, RCW 58.17 enables the City to uniformly administer the process of
subdividing property for the overall welfare of the community; and,
WHEREAS, owners and developers of property situated in a portion of the South half
of Section 15, Township 9 North, Range 29 East, W.M. have requested approval of a
preliminary plat; and,
WHEREAS, the Planning Commission has reviewed said preliminary plat which is
named The Villages at Chapel Hill; and
WHEREAS, following a public hearing, the Planning Commission found the proposed
plat promoted the general welfare of the community and recommended said preliminary plat be
approved with conditions;
WHEREAS, the applicant and some adjoining property owners appealed the Planning
Commission's recommendation;
WHEREAS, the City Council held a closed record hearing to review the Planning
Commission recommendation and found that the record supported approval of the proposed
preliminary plat for The Villages at Chapel Hill with additional conditions; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO:
That the preliminary plat for The Villages at Chapel Hill located in the South half of
Section 15, Township 9 North, Range 29 East W.M., is hereby approved with the following
conditions:
TENTATIVE PUD/PLAT APPROVAL CONDITIONS
1) At the time lots are developed all public utilities shall be developed to City standards.
All private utilities shall be developed per the City Municipal Code pertaining to
private utilities. This includes, but is not limited to, water, irrigation and sewer lines,
storm water, and fire hydrants. Sidewalks must be installed along Chapel Hill
Boulevard in conjunction with and no later than the time at which construction
occurs. Water utility improvements shall include necessary utility extensions/looping
as approved by the City Engineer.
2) The developer shall be responsible for extending sewer service to and through the
PUD/plat.

D) The developer must establish Conditions, Covenants and restrictions subject to the
written approval of the Community and Economic Development Director, binding the
owners of each lot to share in the perpetual management, maintenance and upkeep of
all common properties and amenities, including, but not limited to fencing, parking
areas, driveways, recreation areas, management buildings, pools and landscaping
within the PUD.
4) Sound mitigation. Upon completion of sound mitigation measures the developer shall
retain a licensed acoustical sound engineer to test and certify the design and
construction of mitigation measures meets the desired 70 dba.
5) The developer shall be responsible for all costs associated with construction
inspection service expenses incurred by the City of Pasco Engineering Department.
6) The developer shall ensure that dust and litter shall be abated during the construction
of the subdivision and construction of the houses thereon.
7) The final plat shall contain necessary utility easements in locations approved by the
utility providers.
S) Any and all utilities shall be located as directed by the City Engineer. This shall
include but not be limited to gas, phone, power, cable and all other utilities located
within or adjoining this proposed plat. Any existing utilities that present difficulties
shall be relocated at the developer's expense, pursuant to the direction of the City
Engineer.
9) All engineering designs for infrastructure and final plat drawings shall utilize the
published City of Pasco Vertical Control Datum and shall be identified on each
submittal.
10) The final plat shall contain the following Franklin County Public Utility District
statement: "The individual or company making improvements on a lot or lots of this
plat is responsible for providing and installing all trench, conduit, primary vaults,
secondary junction boxes, and backf ll for the PUD's primary and secondary
distribution system in accordance with PUD specifications; said individual or
company will make full advance payment of line extension fees and will provide all
necessary utility easements prior to PUD construction and/or connection of any
electrical service to or within the plat."
11) All common open space, recreation areas, and parking must be clearly identified on
the final plat.
12) A "revised" preliminary plat incorporating all changes and modifications, including
phasing, approved by the City shall be submitted within 30 days of plat approval. The
documents must be submitted in both paper and an electronic format acceptable to the
City Engineer.

13) All irrigation, water, sewer & storm utilities within this development shall be
designated as private. The point of designation as private for water, sewer &
irrigation shall be from the point of connection with the existing city utilities. The
roads shall be from the edge of the Right of Way line. The storm system shall be all
items pertaining to storm outside of the existing right of way.
14) The existing 20' (foot) easement located in the eastern portion of the plat shall not
have any structure (permanent or temporary) located upon, under, over or within this
easement.
15) The existing well located in the eastern portion of the plat shall be decommissioned
per Department of Ecology requirements with certification of this being done
submitted to the City prior to final plat approval.
16) The Villages at Chapel Hill shall retain the R-3 density requirements subject to the
provisions of the zoning regulations.
