HomeMy WebLinkAbout2843 Resolution RESOLUTION NO. 22 +3 A RESOLUTION OF THE CITY OF PASCO, WASHINGTON, PROVIDING FOR THE CONVEYANCE OF A RIGHT-OF-WAY FOR THE AINSWORTH AVENUE RAILROAD OVER CROSSING. WHEREAS,the City of Pasco is the record owner of the following described lands: Those portions of Lot 13 and Lot 14, Block 16, Gantenbein's Addition to the City of Pasco, lying West of South 4th Avenue, TOGETHER WITH that 10-foot wide portion of Ainsworth Avenue adjacent to said Lot 13, vacated by Ordinance No. 2401, AND TOGETHER WITH that 10-foot wide portion of South 5th Avenue adjacent to said Lots,vacated by Ordinance No. 322; and WHEREAS, in the improvement of the Port of Pasco, SR 397 (Ainsworth Avenue) Railroad Over Crossing by the City of Pasco, acting as agent for the Port of Pasco, it is necessary and advisable for the City of Pasco to acquire title to the following described portion of said lands for a right of way for said highway. The City is also purchasing an uneconomic remnant, as determined by the review appraiser, and described as: That portion of Lot 14, Block 16, Gantenbein's Addition to the City of Pasco, lying West of South 4th Avenue, AND TOGETHER WITH that 10-foot wide portion of South 5th Avenue adjacent to said Lot, vacated by Ordinance No. 322 lying North of the following described line: Commencing at the Northwest corner of said Lot 14; thence N89°16'56"W on an extension of the North line of said Lot 14, 10.00 feet to the East right-of-way line of said South 5th Avenue as it is currently defined by said Ordinance No. 322; thence S00°42'43"W on said East right-of-way line, 6.51 feet to the TRUE POINT OF BEGINNING for the line being described; thence S69°16'29"E, 124.56 feet to the point of terminus at a point on the West right-of-way line of said South 4th Avenue; and WHEREAS, after due consideration by the City Council of the City of Pasco, it appears to said Council that it will be for the best interest of both the City of Pasco, and the State of Washington, that the City of Pasco convey said lands to the City of Pasco, acting as agent for the Port of Pasco, by Quitclaim Deed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, THAT: 1. The City of Pasco in accordance with RCW 47.12.040 (RCW 84.64.320 for tax title lands)and through its City Manager, execute and deliver said deed to the City of Pasco.
