A RESOLUTION OF THE CITY OF PASCO, WASHINGTON,
PROVIDING FOR THE CONSTRUCTION AND ASSESSMENT OF SIDEWALK,
CURB AND GUTTER IMPROVEMENTS ON EAST LEWIS STREET,
PROVIDING IN PART ASSESSMENT OF THE COSTS OF SUCH
IMPROVEMENTS;AND SETTING A PUBLIC HEARING.
WHEREAS, the City is authorized, pursuant to RCW 35.68.010, to construct and repair
sidewalks, curbs,and gutters necessary to provide for the public safety and conveyance; and
WHEREAS,the City Council has determined the installation of sidewalks on East Lewis
Street between Elm Avenue and Cedar Avenue is necessary to provide for the safe passage of
pedestrians and motorists on East Lewis Street; and
WHEREAS,the City has funds available to pay for a portion of the costs incident to these
improvements,however, such funds are insufficient to pay all of the costs for such improvements;
and
WHEREAS, State law allows for the assessment of portions of the cost of such
improvements against the abutting property owners, after public hearing;NOW,THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON,THAT:
(1) That sidewalks, curbs and gutters shall be installed, reconstructed, or repaired as
required to render a safe and functional walkway on both sides of East Lewis Street between Elm
Avenue and Cedar Avenue within the City of Pasco, Washington. Owners of abutting properties
shall be assessed an amount sufficient to pay the cost of such improvements,except that the cost to
property owners shall not exceed ten(10)dollars per linear foot of sidewalk installed. Expenses,if
any, in excess of ten(10) dollars per linear foot shall be the responsibility of the City.
(2) That a Public Hearing shall be held at 7:00 p.m.,July 19, 2004,in the City Council
Chambers at Pasco City Hall, located at 525 North 3`d, Pasco, Washington, at such time the City
Council shall hear persons who appear for or against the improvements,determine whether it will or
will not proceed with the improvements,and whether it will make any changes to the original plan,
what changes shall be made, and the assumption of the cost of these improvements.
(3) Notice of this Public Hearing shall be given to each owner or reputed owner of the
abutting property, and published according to law.
PASSED by the City Council of the City of Pasco,Washington,and signed in authentication
of its passage this 21" day of June, 2004.
