Home My WebLink About2757 Resolution RESOLUTION NO. 2757 A RESOLUTION OF THE CITY OF PASCO, WASHINGTON, PROVIDING FOR THE CONVEYANCE OF A RIGHT-OF-WAY FOR EAST FOSTER WELLS ROAD EXTENSION TO FRANKLIN COUNTY, WASHINGTON, AND AUTHORIZING THE CITY MANAGER TO SIGN THE TEMPORARY CONSTRUCTION EASEMENT AND RIGHT-OF- WAY DEED WHEREAS, the City of Pasco is record owner of real property consisting of Tax Parcel Number 113-160-017; Tax Parcel Number 113-070-070; and Tax Parcel Number 113-170-042, and more particularly described in Exhibit A attached hereto and incorporated hereinby this reference; and WHEREAS, the City of Pasco has received a request from Franklin County, Washington, to acquire right-of-way over the above-described real property for the extension of East Foster Wells Road; and WHEREAS, in addition to the right-of-way necessary for extension of East Foster Wells Road, Franklin County further requires a temporary construction easement providing for encroachment upon adjacent properties for the construction of East Foster Wells Road; and WHEREAS, after due consideration by the City Council of the City of Pasco, it appears that it will be in the best interest of both the City of Pasco and Franklin County that the City of Pasco convey such real property to Franklin County by Quit Claim Deed for a total purchase price for the right-of-way and the temporary construction easement in the amount of$57,169.00, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, THAT: Section 1. That in consideration for the payment of $57,169.00, the City of Pasco, shall sell, transfer and convey to Franklin County, Washington, by a Right-Of-Way Quit Claim Deed,the following described real property: Tax Parcel 113-160-017 All that portion of the before described Tract "X" lying between the following described Lines 1 and 2: Line 1: Beginning at County Engineer's Station (hereinafter referred to as CES) F10+00.00 of East Foster Wells Road Extension; thence easterly along the center line of said East Foster Wells Road Extension, 5320.60 feet to CES PC 63+20.60; thence easterly 53.28 feet along the arc of a circular curve concave to the northwest, said curve having a radius of 12,000.00 feet, a central angle of East Foster Wells Road Resolution- 1 0'15'16" and a long chord that bears North 88'06'17" East 53.28 feet to CES F63+73.88 and the end of this line description. Line 2: Beginning at a point opposite County Engineer's Station (hereinafter referred to as CES) F9+98.07 of East Foster Wells Road Extension and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension, 3001.93 feet to a point opposite CES F40+00.00 and 45.00 feet southerly therefrom; thence southerly to a point opposite CES F40+00.00 and 50.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 850.00 feet to a point opposite CES F48+50.00 and 50.00 southerly therefrom; thence southerly to a point opposite CES F48+50 and 65.00 southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 600.00 feet to a point opposite CES F54+50 and 65 feet southerly therefrom; thence northerly to a point opposite CES F54+50 and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 870.40 feet to a point opposite CES PC 63+20.60 and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 51.03 feet along the arc of a circular curve concave to the northwest, said curve having a radius of 12,045.00 feet, a central angle of 0°14'34" and a long chord that bears North 88°06'38" East 51.03 feet to a point opposite CES F63+71.43 and 45.00 feet southerly therefrom and the end of this line description. Tax Parcel 113-070-070 All that portion of the before described Tract "X' lying between the following described Lines 1 and 2: Line 1: Beginning at County Engineer's Station (hereinafter referred to as CES) F15+50 of East Foster Wells Road Extension; thence easterly along the center line of said East Foster Wells Road Extension, 1526.93 feet to CES F30+76.93 and the end of this line description. Line 2: Beginning at a point opposite County Engineer's Station (hereinafter referred to as CES) F15+49.90 of East Foster Wells Road Extension and 45.00 feet northerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension, 1526.72 feet to a point opposite CES F30+76.62 and 45.00 feet northerly therefrom and the end of this line description. Tax Parcel 113-170-042 —Tract"X" All that portion of the hereinafter described Tract"X lying between the following described Lines 1 and 2: East Foster Wells Road Resolution-2 Line 1: Beginning at County Engineer's Station (hereinafter referred to as CES) F 63+73.88 of East Foster Wells Road Extension; thence easterly along the center line of said East Foster Wells Road Extension 53.28 feet along the arc of a circular curve concave to the northwest, said curve having a radius of 12,000.00, a central angle of 0°I5'l 6" and a long chord that bears North 87°51'01"East 53.28 feet to CES PT 64+27.17; thence easterly along the center line of said East Foster Wells Road Extension, 2768.94 feet to CES F 91+96.11 and the end of this line description. Line 2: Beginning at a point opposite County Engineer's Station (hereinafter referred to as CES) F 63+71.43 of Foster Wells Road and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells road Extension 55.94 feet along the arc of a curve concave to the northwest, said curve having a radius of 12,045.00 feet, a central angle of 0°15'58" and a long chord that bears North 87°51'22" East 55.94 feet to a point opposite CES PT 64+27.17 and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension, 1772.83 feet to a point opposite CES F 82+00 and 45.00 feet southerly therefrom; thence southerly to a point opposite CES F 82+00 and 55.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension, 993.91 feet to a point opposite CES F 91+93.91 and the end of this line description. The City Manager is authorized and directed to execute such Deed and all of the documents necessary for the transfer of the above-described real property. Section 2. That a temporary construction easement shall be granted to Franklin County, Washington, that includes all that portion of the herein described Tract "X" constituting all of Section 11, Township 9 North, Range 30 East, W.M. records of Franklin County, Washington, lying between the following described Lines 1 and 2: Line 1: Beginning at a point opposite CES F54+50.00 and 45.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 100.00 feet to a point opposite CES, F55+50.00 and the end of this line description. Line 2: Beginning at a point opposite CES F54+50.00 and 95.00 feet southerly therefrom; thence easterly along a line parallel with the center line of said East Foster Wells Road Extension 100.00 feet to a point opposite CES F55+50.00 and the end of this line description. The City Manager is authorized and directed to execute a temporary construction easement and all of the documents necessary for the transfer of the above-described real property.
