A RESOLUTION OF THE CITY OF PASCO, WASHINGTON,
PROVIDING FOR SEGREGATION OF ASSESSMENT FOR CERTAIN
PARCELS IN LOCAL IMPROVEMENT DISTRICT NO. 139; AND
AUTHORIZATION FOR THE MAYOR TO SIGN ASSESSMENT
AGREEMENT.
WHEREAS, RCW 35.44.410 provides that whenever land against which there has been
levied a special assessment has been sold in part or subdivided, the legislative authority of that
City shall have the power to order a segregation of the assessment; and
WHEREAS, Copper Basin Construction, Inc. has subdivided three tracts of land as
identified into 35 parcels designated as Account Numbers 3, 4 and 5 into Account No. 003-001,
Account No. 003-002, Account No. 004-001, Account No. 004 -002, Account No. 004-003,
Account No. 004-004, Account No. 004-005, Account No. 004-006, Account No. 004-007,
Account No. 004-008, Account No. 004-009, Account No. 004-010, Account No. 004-011,
Account No. 004-012, Account No. 004-013, Account No. 005-001 Account No. 005 -002,
Account No. 005-003, Account No. 005-004, Account No. 005-005, Account No. 005-006,
Account No. 005-007, Account No. 005-008, Account No. 005-009, Account No. 005-010,
Account No. 005-011, Account No. 005-012, Account No. 005-013, Account No. 005-014,
Account No. 005-015, Account No. 005-066, Account No. 005-077, Account No. 005-088,
Account No. 005-019, Account No. 005-020, upon real property legally described in Exhibit A,
attached hereto and incorporated hereinby this reference, and
WHEREAS, on October 7, 2002, the City Council of the City of Pasco adopted the final
assessment roll for L.I.D. 139 levying assessments in the amount of$4,068.47, $18,492.44 and
$24,817.19 respectively against Account Numbers 3, 4 and 5; and
WHEREAS, the request for segregation shall be made as nearly as possible on the same
basis as the original assessment was levied, the total of the segregation parts of the assessment
shall equal the assessment before segregation, and by such segregation, the security of the liens
for such assessments shall not be so jeopardized as to reduce the security for any outstanding
local improvement district obligations payable from such assessments; and
WHEREAS, a Segregation Agreement has been negotiated for contemporary execution
with the approval of this Resolution designating the terms upon which such segregation shall
occur and the costs, assessments and the basis for payment thereof shall be made; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
Section 1. That the City Council of the City of Pasco hereby directs the City staff to
segregate the assessments for Account Numbers 3, 4 and 5 of Local Improvement District 139

into Account No. 003-001 in the amount of$2,034.24, Account No. 003-002 in the amount of
$2,032.23, Account No. 004-001 in the amount of $1,422.50, Account No. 004-002 in the
amount of$1,422.50, Account No. 004-003 in the amount of$1,422.50, Account No. 004-004 in
the amount of$1,422.50, Account No. 004-005 in the amount of$1,422.50, Account No. 004-
006 in the amount of$1,422.50, Account No. 004-007 in the amount of$1,422.50, Account No.
004-008 in the amount of$1,422.50, Account No. 004-009 in the amount of$1,422.50, Account
No. 004-010 in the amount of $1,422.50, Account No. 004-011 in the amount of $1,422.50,
Account No. 004-012 in the amount of $1,422.50, Account No. 004-013 in the amount of
$1,422.44, Account No. 005-001 in the amount of $1,240.86, Account No. 005-002 in the
amount of$1,240.86, Account No. 005-003 in the amount of$1,240.86, Account No. 005-004 in
the amount of $1,240.86, Account No. 005-005 in the amount of$1,240.86, Account No. 005-
006 in the amount of$1,240.86, Account No. 005-007 in the amount of$1,240.86, Account No.
005-008 in the amount of$1,240.86, Account No. 005-009 in the amount of$1,240.86, Account
No. 005-010 in the amount of $1,240.86, Account No. 005-011 in the amount of $1,240.86,
Account No. 005-012 in the amount of $1,240.86, Account No. 005-013 in the amount of
$1,240.86, Account No. 005-014 in the amount of $1,240.86, Account No. 005-015 in the
amount of$1,240.86, Account No. 005-016 in the amount of$1,240.86, Account No. 005-017 in
the amount of $1,240.86, Account No. 005-018 in the amount of $1,240.86, Account No. 005-
019 in the amount of$1,240.86, Account No. 005-020 in the amount of$1,240.85.
Section 2. The Mayor is hereby authorized and directed to enter into and execute that
Segregation Agreement providing for the assessment of fees, costs and the payment of the
assessment upon the segregated tracts in the form attached as Exhibit B.
PASSED by the City Council of the City of Pasco, at its regular meeting, February 18,
2003.
