A RESOLUTION approving a planned density development
preliminary plat for Loviisa Farms.
WHEREAS, RCW 58.17 enables the City to uniformly administer the
process of subdividing property for the overall welfare of the community; and,
WHEREAS, owners and developers of property situated in the northwest
quarter of Section 17, Township 9 North, Range 29 East, W.M. have requested
approval of a preliminary plat; and,
WHEREAS, the Planning Commission has reviewed said preliminary plat
which is named Loviisa Farms; and
WHEREAS, following a public hearing, the Planning Commission found
the proposed plat promoted the general welfare of the community and
recommended said preliminary plat be approved with conditions; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO:
That the preliminary plat for Loviisa Farms located in the northwest
quarter of Section 17, Township 9 North, Range 29 East W.M., is hereby
approved with the following conditions:
1) At the time lots are developed all abutting roads and utilities shall be
developed to City standards. This includes but is not limited to water,
irrigation and sewer lines, streets and storm water retention. Sidewalks
must be installed no later than the time each lot is developed with a
house. The handicapped sections, the Broadmoor Boulevard sidewalk
and the sidewalks on the major (northern most street) east/west street
must be completed with the street and curb improvements prior to final
plat approval for phase abutting said streets. Water and street
improvements shall include necessary pressure reducing valves and
utility extensions as approved by the City Engineer.
2) Lots abutting Broadmoor Boulevard and the northern most street shall
not have direct access to those streets. Access shall be prohibited by
means of deed restrictions or statements on the face of the final plat(s).
3) Lots 145 to 152 shall be held in reserve by the developer for a
neighborhood park. Lot 144 shall be reserved for the future extension of
Shire Drive to run along the south side of a future park. These
reservations will be held until the submittal of construction drawings for
the phase that includes said lots. If it is determined at that time a golf
course will be built east of the plat the park reservation will expire. If a
golf course is not to be built said lots .shall be incorporated into a park
with a future phase of Loviisa Farms.
4) The developer/builder shall pay the City a "common area maintenance
fee" of $350 per lot upon issuance of all building permits for homes.
These funds shall be placed in a fund and used to finance the
maintenance of lands along Broadmoor Boulevard and the northern most
street. The City shall not accept maintenance responsibility for the
landscaping abutting said streets until such time as all homes are
permitted in each phase that but said streets.

5) Excess right-of-way along the northern most street and Broadmoor
Boulevard must be landscaped. Said landscaping along the northern
most street shall include turf and Bradford pear trees or approved equal
spaced at 50 foot intervals. Broadmoor Boulevard must be landscaped
similar to and consistent with the existing landscaping on Sandifer
Parkway. All landscaping plans shall be reviewed and approved by the
Parks Department prior to installation. An irrigation system must be
included with the landscaping.
6) The northern most east/west street shall be improved with a center
landscaped island as determined by the City Engineer. The street shall
contain 4 travel lanes and turn pockets where needed all designed as per
the requirements of the City Engineer. The developer shall design the
full road (north & south sides) from Broadmoor Boulevard east to the end
of the plat. The developer shall construct a full intersection (north &
south sides) with turn pockets at Broadmoor Boulevard. The developer
will constructed the south two lanes along the north boundary of the
plat. The developer will also construct the northern two lanes for a
distance that would be equal in cost to the traffic mitigation fee
($50,400). Any required construction of the northern two lanes beyond
what the mitigation fee will cover will be reimbursed to the developer by
the City.
7) The owner/developer shall assign and transfer to the City any perfected
application, certificate, permit or right of withdrawal of ground water or
surface waters, or such other waters rights as may be appurtenant to the
property.
8) The developer shall install a common solid fence 6 feet in height adjacent
the rear line of all lots backing on Broadmoor Boulevard and the
northern most street as a part of the infrastructure improvements
associated with each phase abutting said streets. Said fence must be

approved by the City prior to installation. Consideration must be given to
the vision triangle at the intersection of streets. The City may make
repairs or replace the fencing as needed. Property owners adjoining said
fence shall be responsible for payment of all costs associated with
maintenance and upkeep. These fencing requirements shall be noted
clearly on the face of the final plat (s).
9) The developer shall install a common solid fence 6 feet in height along
the rear line all lots abutting the FCID canal.
10) The developer shall be responsible for all costs associated with
construction inspection service expenses incurred by the City of Pasco
Engineering Department.
11) The developer shall insure active and ongoing dust and litter abatement
activities occur during the construction of the subdivision and
construction of the houses thereon.
12) The final plat shall contain 10-foot utility easements parallel to all
streets.
13) The developer shall install a properly designed irrigation system with
stubs to all lots in the subdivision for future irrigation needs. The
irrigation lines shall run in easements as directed by the City Engineer.
14) All engineering designs for infrastructure and final plat drawings shall
utilize the published City of Pasco Vertical Control Datum.
15) Broadmoor Boulevard shall be widened to accommodate the appropriate
half street section (31 feet) as determined by the City Engineer. A five-
foot wide sidewalk shall be placed between the curb and the property
line.
16) A note shall be placed on the final plat(s) explaining the property use and
fencing restrictions for the BPA easement.
17) Sixty percent of the lots within the plat must be traditional lots of 8,200
square feet or more. The planned density lots (1-76 and 77-109) shall be
located convenient to Broadmoor Boulevard.
18) The assignment of water rights to the City is a requirement for
subdivision approval. If no water rights are available to transfer to the
City the property owner/developer must pay a water right fee of $1,500
per acre in lieu thereof. The Public Works Director may waive the fee if
the developer mixes a soil additive in the ground that provides 30%
retention of irrigation water.
