A RESOLUTION OF THE CITY OF PASCO, WASHINGTON,
AUTHORIZING PASCO PUBLIC FACILITIES DISTRICT'S
PARTICIPATION IN A REGIONAL CENTER BY INTERLOCAL
AGREEMENT; COLLECTION OF SALES AND USE TAX FUNDS
PURSUANT TO RCW 82.14.390; AND AUTHORIZING THE MAYOR
TO SIGN THE CONVENTION CENTER FINANCING INTERLOCAL
AGREEMENT WITH THE CITY OF KENNEWICK, WASHINGTON.
WHEREAS, the Pasco Public Facilities District has been created, in part,
for the purpose of participating with other public facilities districts in a joint
and cooperative development of a Regional Center within the Tri City area; and
WHEREAS, RCW 82.14.390 authorizes a public facilities district to
obtain sales and use tax funding for the creation of a Regional Center; and
WHEREAS, the enacting Ordinance requires the District to seek the
prior approval of the Pasco City Council before imposing the sales tax as
authorized by RCW 82.14.390; and
WHEREAS, by Interlocal Agreement, the City of Pasco can participate
with the City of Kennewick in facilitating the necessary funding for the
construction and operation of a Regional Center as consideration for the
authorization to the Pasco Public Facilities District for the collection of sales
and use taxes; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS: '
Section 1. That the Pasco Public Facilities District is authorized to
enter into an Interlocal Agreement with the Kennewick Public Facilities District
to provide for joint participation in the Regional Center to be constructed and,
conditioned upon the City of Kennewick and/or the Kennewick Public Facilities
District meeting the matching requirements of RCW 82.14.390 (4), adopt a
Resolution establishing the tax deduction from existing taxes for use in
creating a Regional Center for the community.
Section 2. The Mayor is hereby authorized to enter into and execute the
Convention Center Financing Interlocal Agreement between the City of Pasco,
Washington, and the City of Kennewick, Washington, a copy of which is
attached hereto as Exhibit A.
PASSED by the City Council of the City of Pasco, Washington, at its
regular meeting on the 2nd day of December, 2002.
