HomeMy WebLinkAbout2605 Resolution RESOLUTION NO. 2605 A RESOLUTION OF THE CITY OF PASCO, WASHINGTON, AFFIRMING RESOLUTION NO. 2603 PROVIDING FOR THE CONSTRUCTION AND ASSESSMENT OF SIDEWALK, CURB AND GUTTER IMPROVEMENTS ON WEST LEWIS STREET AND PROVIDING FOR ASSESSMENT OF A PORTION OF THE COST OF SUCH IMPROVEMENTS. WHEREAS, the City Council earlier approved Resolution No. 2603 declaring its intent to install curb, gutter and sidewalk improvements on West Lewis Street between 20' and 28" avenues and to assess a portion of the cost against adjacent properties; and WHEREAS, the City Council conducted a public hearing on July 23, 2001 of which affected property owners and the public were duly notified; and WHEREAS, after consideration of the need for said improvements and the input of those property owners to be assessed, the City Council finds the need for said improvements exists and that adjacent property owners should be assessed not more than $ 10.0 per lineal foot; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, THAT: (1) Sidewalks, curbs and gutters shall be installed as set forth in the plans and specifications for the West Lewis Street Beautification project, on file with the City of Pasco City Engineer. (2) Those properties having adjacent sidewalks installed under the project shall be assessed at a rate not to excee .'J -) per lineal foot of sidewalk installed. The final assessment shall be determined and established as provided under RCW 35.68. (3) Those portions of the West Lewis Street right-of-way remaining unimproved after completion of the project should be made available for use and improvement by the adjacent properties at no charge, provided said use and improvements are consistent with the project and all applicable laws and regulations.
