A RESOLUTION confirming City obligations under Chapter 41.26 of the Revised
Code of Washington
WHEREAS, RCW 41.26 created the LEOFF I Retirement System; and
WHEREAS, RCW 41.26.150 (2) states "the medical services payable under this
section will be reduced by any amount received or eligible to be received by the member
under worker's compensation, social security including the changes incorporated under
Public Law 89-97 as now or hereafter amended, insurance provided by another employer,
other pension plan or any other similar source"; and
WHEREAS, this council has considered the option of reimbursing LEOFF I members
for their share of any insurance or medical benefit plan under worker's compensation, social
security including the changes under Public Law 89-97 as now or hereafter amended,
insurance provided by another employer, other pension plan or any other similar source;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
RESOLVE AS FOLLOWS.
Section 1. That the City Council of the City of Pasco, Washington will not authorize
expenditure of City funds to reimburse LEOFF I members for any costs they are required to
pay or have withheld from an income source for medical benefits or services from agencies
listed in RCW 41.26.150 (2); and
Section 2. That the LEOFF Disability Board will make every effort to reduce
reimbursement for medical services payable under this plan by any amount received or
eligible to be received by the member under worker's compensation, social security including
the changes incorporated under Public Law 89-97 as now or hereafter amended, insurance
provided by another employer, other pension plan or any other source similar to those
medical services payable under section 41.25.
PASSED by the City Council of the City of Pasco at a regular meeting this 19th day
of March, 2001.
