A RESOLUTION of the City Council of the City of Pasco, Washington, relating to Utility Local Improvement District No. 133; declaring its intention to amend Ordinance No. 3246, by adding additional territory to the district and providing additional sewer improvements to serve that added territory; and to set March 1, 1999 at 7:00 p.m. in the City Council Chambers as the time and place for the hearing on that amendment and on the final assessment roll for Utility Local Improvement District No. 133; and directing that notice thereof be given in the manner required by law. WHEREAS, by Ordinance No. 3246, the City Council of the City of Pasco, Washington created Local Improvement District No. 133 for the purpose of carrying out improvements of properties within that district by constructing sanitary sewer lines, sewer stubs, a street overlay, and other work necessary or incidental thereto; and WHEREAS, the Council has received letters from property owners outside of ULID No. 133 requesting to be included within the District and receive service from the improvements therein; and WHEREAS, the final assessment roll for ULID No. 133 has been prepared as provided by law and is on file with the City Clerk, and it is necessary to fix a date for a hearing thereon before the City Council; Now THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON as follows: Section 1. It is the intention of the City Council of the City of Pasco, Washington to amend Ordinance No. 3246 as amended by adding additional property and improvements to ULID No. 133, and such additional property and improvements are described on Exhibit A, attached hereto and by this reference made a part hereof. The total estimated costs of the improvements in ULID No. 133 including the improvements specified herein is declared to be $410,010, and the entire cost and expense of the improvements shall be born by and assessed against the property special benefited by the improvements to be included in ULID No. 133. The actual assessments may vary from the estimated assessments as long as C they do not exceed a figure equal to the increased true and fair value of the improvements the improvements add to the property. Section 2. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time, and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land, or other property within the proposed local improvement district by mailing such notice at least 15 days before the date fined for public hearing to the owner or reputed owner of the property as shown on the rolls of the Franklin County Treasurer at the address shown thereon, as required by law. This resolution, shall be published in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least fifteen days prior to the date fixed for the public hearing and the City Clerk is instructed to cause notice to be given both by mailing in publication as required of the hearing on the final assessment roll as required by law. Section 3. A public hearing on the amendment Ordinance No. 3246 as amended and on the final assessment roll for Utility Local Improvement District No. 133 will be held before the City Council at 7:00 p.m. local time, in the Council Chambers, City Hall, 525 N 3rd Avenue, Pasco, Washington on March 1, 1999. All persons who may desire to object to the improvements specified in the above referenced amendments to Ordinance 3246 or to the assessments against their property are notified to appear and present those objections at the hearing before the City Council as specified in this section. The foregoing resolution was ADOPTED by the City Council of the City of Pasco, Washington at a regular open public meeting thereon the 1st day of February, 1999. n Charles D.
