HomeMy WebLinkAbout3720 Ordinance ORDINANCE NO. 72-6 AN ORDINANCE of the City of Pasco, Washington, Amending the Zoning Classification of Certain Real Property Located in the South half of Section 15, Township 9 North, Range 29 East from R-3 (Medium Density Residential) to R-3/PUD (Medium Density Residential/ Planned Unit Development). WHEREAS, a complete and adequate petition for change of zoning classification has been received and an open record hearing having been conducted by the Pasco Planning Commission upon such petition; and, WHEREAS,that the effect of the requested change in zoning classification shall not be materially detrimental to the immediate vicinity; and, WHEREAS, based upon substantial evidence and demonstration of the Petitioner, that: (A) the requested change for the zoning classification is consistent with the adopted Comprehensive Plan; (B) the requested change in zoning classification is consistent with or promotes the goals and objectives of the Comprehensive Plan serving the general public interest in the community; and (C) there has been a change in the neighborhood or community needs or circumstances warranting the requested change of the zoning classification in that municipal infrastructure is available to the neighborhood. There has also been a shifted from agricultural functions to residential within the area and (D) the request for change in zoning classification is categorically exempt Linder the Washington State Environmental Policy Act, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. That the Zoning Ordinance for the City of Pasco, Washington, and the Zoning Map, accompanying and being part of said Ordinance shall be and hereby is changed from R-3 (Medium Density Residential) to R-3/PUD (Medium Density Residential/Planned Unit Development) for the real property as shown in the Exhibit "1" attached hereto and described as follows: A parcel of land in a portion of the Southwest quarter and the Southeast quarter of Section 15, Township 9 North, Range 29 East, Willamette Meridian, Franklin County, Washington, more particularly described as follows: Beginning at NW corner of the SW 1/4 of said Section; Thence N 88°38'28" E along the N line of said SW 1/4 for 593.60 ft to a point on the Southerly R-O-W line of I-182; Thence along said R-O-W line the following courses: Thence South 71'21'40" E, for 101.27 ft; Thence S 72°40'03" E, for a 602.99 ft to the TRUE POINT OF BEGINNING; Thence continuing along said R-O-W line the following courses: Thence S 66°57'25" E, for 750.00 ft; Thence S 62°22'59" E, for 250.80 feet; Thence S 66°57'25" E, for 883.11 ft; Thence leaving said Southerly R-O-W line S 23°02'35" W, for 270.00 feet; Thence N 66°57'25" W, for 950.69 ft; Thence along the arc of a 730.00 feet radius tangent curve to the left, for an are distance of 288.40 feet, through a central angle of 22°38'08", the radius of which bears S 23°02'35" W, the long chord of which bears N 78'16'29" W for a chord for 286.53 feet; Thence N 89°35'33" W, for 301.99 ft; Thence N 85°43'29" W, for 148.24 ft; Thence N 89°35'33" W, for 12.29 ft; Thence N 00°11'22" W, for 560.32 ft to the TRUE POINT OF BEGINNING. Section 2. That uses permitted in the R-3/PUD District created by this ordinance shall be limited to 198 multifamily dwelling units divided between 48 stand alone buildings. Ancillary uses such as a parking lot, recreation facilities and a clubhouse/management building are also permitted. Section 3. This ordinance shall take full force and effect five (5) days after its approval, passage and publication as required by law.
