J?! 7 AN ORDINANCE AUTHORIZING THE ALLOCATION OF CERTAIN UTILITY TAX RECEIPTS AND AMENDING CHAPTER 5.32.070 OF THE PASCO MUNICIPAL CODE ENTITLED "USE OF FUNDS FOR STREET MAINTENANCE" WHEREAS, A portion of the Utility Taxes collected by the City of Pasco provides revenue for the maintenance of City streets; and WHEREAS,that portion of the Utility Tax received to date and designated for Street Maintenance has all been distributed to the Street Overlay Fund and used to fund the overlay projects; and WHEREAS, the cost of street maintenance is also paid out of the City Street Fund in the form of miscellaneous street repairs,maintenance of traffic control devises, street striping and snow removal; and WHEREAS, the City Street Fund also receives funds from the State of Washington in the form of Gasoline Taxes; and which amounts have not been sufficient to cover the expenditures in the City Street Fund; and WHEREAS, the General Fund has been required to make annual operating transfers to the City Street Funds to meet cover the costs of maintenance,NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Effective immediately, a portion of the Utility Tax revenues will be apportioned to the City Street Fund and the Street Overlay Fund. Section 2. Section 5.32.070 entitled "Use of Funds for Street Maintenance" of the Pasco Municipal Code shall be and hereby is amended and shall read as follows: 5.32.070 USE OF FUNDS FOR STREET MAINTENANCE. Such percent of the gross proceeds of annual taxes collected under this chapter as would be generated by a one percent tax rate on the gross operator revenues taxed under this chapter shall, after each q rly collection, be allocated 115` (20%) to the City Street Fund, such funds shall to be resen,ed used for the purposes described in PMC Chapter 3.72, and 4/5`"s (80%) to the Street,Overlay Fund laeed irate ° fim a °°*°b'i°''°� by ^, a:,,a^^°, such funds to be used for and maintenanee, by overlaying or sealing of asphaltic concrete streets in the Street Overlay Fund of the City. (Ord. 2454 Sec. 1, 1983; Ord. 2300 Sec. 7, 1981.) Section 3. This Ordinance shall take full force and effect immediately, after its approval, passage and publication as required by law.
