AN ORDINANCE OF THE CITY OF PASCO, AMENDING CHAPTERS 13.61 AND 3.07
OF THE PASCO MUNICIPAL CODE, PROVIDING FOR CHANGES TO THE
IRRIGATION WATER UTILITY REGULATIONS AND RATES.
WHEREAS, the City Council of the City of Pasco has determined that certain amendments
regarding Irrigation Water Utility are warranted;
NOW, THEREFORE, The City Council of the City of Pasco, Washington, Does Ordain as
Follows: (deletions by interlineations,additions by underlining)
Section 1. That Section 13.61.040 DEFINITIONS is hereby amended with a new definition to read
as follows:
D) "Irrigation Unit" shall mean 5,000 square feet of lot size or increment thereof for single family
residential properties or 5,000 irrigated Square feet of area or increment thereof for properties not used for
single family residential purposes.
(All subsequent existing definitions shall be relabeled accordingly.)
Section 2. That Section 13.61.060 of the Pasco Municipal Code is hereby amended to read as
follows:
13.61.060 IRRIGATION WATER USE REQUIRED WHEN AVAILABLE. In order to
promote the most efficient use of the City's domestic and irrigation water supplies and systems, the
utilization of irrigation water in lieu of domestic water for single family residential properties is required
when such service is available. Provided, however, the City Manager is authorized to allow an exemption
from this requirement and from the monthly irrigation service charge, for individual property owners who
document their non-use of the irrigation utility prior to September 1, 2002, and who remain non-users of the
system. Such property owners will be required to enter into an agreement with the City which sets forth the
conditions of the exemption. The exemption is non-transferable and shall expire upon sale or disposal of the
property. Such property owners shall pay an annual system availability fee, representing a proportionate
share of the fixed capital costs of the irrigation utility, as set forth in Chapter 3.07 of this code. (Ord. 3659

Section 3. That a new Section 13.61.065 of the Pasco Municipal Code is hereby added to read as
follows:
13.61.065 IRRIGATION WATER FOR NON- SINGLE FAMILY RESIDENTIAL
PROPERTIES. Irrigation water for properties, other than single family residential, shall be made available at
the discretion of the Director who shall consider the following constraints of the utility in making such
determinations:
A Legal — whether there are sufficient and applicable water rights available to the utility to service
the subject property;
B)Operational—whether the utility can provide the water in such a way that existing customers will
not be adversely affected;
C) Physical —whether the storage,pumping, transmission and distribution facilities of the utility are
sufficient to supply irrigation rrigation water to the subject property.
Section 4. That Section 13.61.190 of the Pasco Municipal Code is hereby amended to read as
follows:

13.61.090 RATES AND CHARGES. Irrigation water service shall be charged on a monthly
basis for each month of the irrigation season, as set forth in Chapter 3.07 of this code, for the following rate
categories:
A) Base rate, per uni each single family residential property less than
15,000 square feet in size. For larger properties, the base rate, plus a charge for the applicable number of
irrigation units shall apply,
B) Base rate, per unit, for each property containing landscaped, irrigated area of less than 10,000
square feet in area. For larger irrigated areas, the base rate, plus a charge for the applicable number of
irrigation units shall apply;
C) Per irrigation unit;
D) Per irrigated acre, for public parks, playgrounds and open spaces.
Charges may be pro-rated for partial months. (Ord. 3607 Sec. 1, 2003.)
Section 5. That Section 3.07.210 IRRIGATION WATER UTILITY of the Pasco Municipal Code is
hereby amended to read as follows:

Section 6. This ordinance shall take effect November 1, 2004 after its approval, passage and
publication as required by law.
