ORDINANCE NO. 3 59
AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, AMENDING
CHAPTER 13.61 OF THE PASCO MUNICIPAL CODE REGARDING
IRRIGATION UTILITY FEES.
WHEREAS, The City Council of the City of Pasco, Washington, has determined that
certain amendments regarding Irrigation Utility Fees are necessary.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1. That Section 13.61.060 of the Pasco Municipal Code is hereby amended to
read as follows:
13.61.060 IRRIGATION WATER USE REQUIRED WHEN AVAILABLE. In order to
promote the most efficient use of the City's domestic and irrigation water supplies and systems,
the utilization of irrigation water in lieu of domestic water is required when such service is
available. Provided. however, the City Manager is authorized to allow an exemption from this
requirement and from the monthly irrigation service charge, for individual property owners who
document their non-use of the irrigation utility since prior to September 1, 2002, and who remain
non-users of the system. Such property owners will be required to enter into an agreement with
the City which sets forth the conditions of the exemption. The exemption is non-transferable and
shall expire upon sale or disposal of the property. Such property owners shall pay an annual
system availability fee representing a proportionate share of the fixed capital costs of the
irrigation utility, as set forth in Chapter 3.07 of this code.
Section 2. That Section 13.61.220 of the Pasco Municipal Code is hereby amended to
read as follows:
13.61.220 REMEDIES. In the event a customer or property owner shall fail to pay the
irrigation water availability fee or service charge, the City shall have the authority to terminate
domestic water service to said property or customer. Termination of such water service shall not
limit other remedies available to the City under state law. (Ord. 3607 Sec. 1, 2003.)
Section 3. This ordinance shall take effect and be in force from and after its passage and
five days following its publication as required by law.
PASSED by the City Council of the City of Pasco at its regular meeting this 15th day of
March, 2004.
