AN ORDINANCE of the City of Pasco, Washington,
Amending Section 25.12.156 "Community Service Facilities
Level Two" and Section 25.12.457 entitled "Transient Hotel or
Motel" Changing the Name and Clarifying the Definition of
Transient Hotel or Motel
WHEREAS, the Franklin County Superior Court in Cause No. 03-2-50019-7, Sea-Mar
Farmworker and Community Housing Development vs. City of Pasco, has determined that
portions of the definition of "transient hotel or motel" are impermissibly vague and further
clarification would assist in determining the application of this restriction,NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section 1. That Section 25.12.156 entitled "Community Service Facilities Level
Two" of the Pasco Municipal Code shall be and hereby is amended and shall read as follow:
25.12.156 COMMUNITY SERVICE FACILITIES LEVEL TWO. "Community
service facility" of the level two category include, but are not limited to, drug abuse and
alcoholic treatment centers, halfway houses, charitable organizations, nonprofit service groups,
juvenile care and treatment centers, crisis residential centers, correctional work release facilities,
correctional institutions, juvenile delinquency homes and facilities, any and all facilities for
incarceration or detainment, temporary shelters, emergency housing facilities,
moils community service housing, missions, community kitchens, food banks, and other similar
uses which provide social, health and welfare service for citizens; except any such use which
limits the activity solely to organizational or administrative office functions, whereby the actual
community service is provided, elsewhere, shall be excluded from this definition.
Section 2. That Section 25.12.457 entitled "Transient Hotel or Motel" of the Pasco
Municipal Code shall be and hereby is amended and shall read as follows:
25.12.457 TRANSIENT 140TEL OR MOTEL COMMUNITY SERVICE
HOUSING. "Transient Hotel or- Metoi Community Service Housing" means a facility that
principally offers or provides subsidized housing on a daily, weekly or monthly basis to
individuals who may Fely en p4lie. or private charitable assistanee for suppai4, of pr-evides
hotels and Motels ma�, also provide assistafwe dir-eedy ef indir-eedy NNith anyl)Te ef applica4ion
of any kind an of off the pfemises, and seeial and health welfiffe sef-,�iees of any kin and
provides one or more of the additional following services at a cost, if any, subsidized by
charitable or government

agencies, including:
A) Meals and food;
B) Child or adult daycare services;
C Employment, substance abuse or behavior counselin • and
D) Medical, dental or mental health services;
regardless of whether such community social and health welfare services are provided on
premises or off the premises for the benefit of such residents_.
Section 3. This Ordinance shall take full force and effect five (5) days after its approval,
passage and publication as required by law.
PASSED by the City Council of the City of Pasco, Washington, and approved as
provided by law this day of Lir2003.
