HomeMy WebLinkAbout3626 Ordinance ORDINANCE NO. 1&J A AN ORDINANCE of the City of Pasco, Washington, Authorizing the Initiation of a Petition for Condemnation of Easement Rights at 32nd Avenue and Court Street WHEREAS, a City project has been initiated for the improvement of the entrance road to the Pasco Autoplex at 32nd Avenue and Court Street involving the relocation of the Franklin County PUD electrical substation and the extension, improvement and signalization of such intersection; and WHEREAS, to facilitate this project, the City needs additional room for sidewalks, handicapped ramps, retaining wall, entrance sign and traffic signalization pole on property owned by U-Haul Company of Washington; and WHEREAS, the City, pursuant to Chapter 8.12 RCW, is authorized to acquire by eminent domain the interest in real property, including easement rights and surface possession, for public use after just compensation therefore has been made; and WHEREAS, it is hereby determined to be in the best interest of the City to acquire a surface easement to approximately 450 square feet of such real property for this public use, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Findings of Facts A. The City Council does hereby find that the reconstruction and extension of 32nd Street at Court Street constitutes a public use as enumerated by RCW 8.12.030; B. The acquisition of the below-described real property easement rights for surface use of approximately 450 square feet for the location of additional sidewalks, handicapped ramps, retaining wall, entrance signs and the setting of a traffic signal pole constitutes a public necessity; and C. The acquisition of the easement is to be paid from the General Fund. Ordinance Authorizing the Initiation of a Petition for Condemndation- 1 Section 2. Le al Description. The surface easement to be acquired by eminent domain effects the following described real property: COMMENCING AT THE NORTHWEST CORNER OF SECTION 25, TOWNSHIP 9 NORTH, RANGE 29 EAST W.M. FRANKLIN COUNTY, WASHINGTON, THENCE NORTH 88 054'28" EAST ALONG THE CENTERLINE OF COURT STREET, AND THE NORTH LINE OF SAID SECTION 25, A DISTANCE OF 1293.36 FEET; THENCE SOUTH 00°04'56" EAST A DISTANCE OF 36.00 FEET TO THE TRUE POINT OF BEGINNING; THENCE CONTINUING ALONG SAID BEARING A DISTANCE OF 30.00 FEET; THENCE NORTH 45 033'57" WEST A DISTANCE OF 42.03 FEET; THENCE NORTH 88 054'28" EAST A DISTANCE OF 30.00 FEET TO THE TRUE POINT OF BEGINNING. CONTAINING 449.92 SQUARE FEET MORE OR LESS. Section 3. Authorization for Condemnation. The City Manager shall be and hereby is authorized to proceed with the acquisition of the surface easement by negotiation, and, if necessary, by the initiation of the Petition for Condemnation in Franklin County Superior Court for determination of just compensation. Section 4. This Ordinance shall take fall force and effect five (5) days after its approval, passage and publication as required by law.
